 On 11.11.1998 at about 4.30 arm. while he was<\/p>\n

station, the lorry bearing Reg.No.KA-03\/A–2360, driven

manner came and dashed against the petitioner to<\/p>\n
which he sustained grievous injuries. Imrriediately  <\/p>\n
was shifted to Chigateri General Hospital;.1:’Dai\u00a5angere””<\/p>\n
and from there to Bapuji hospital,  forfbetter<\/p>\n
treatment where he was admitted as an i\u00b0npattie.n.t–*for <\/p>\n
period of 110 days. lie  surgeries. Due

expartve, The second respondent–insurer appeared and<\/p>\n
it  contested the petition by \ufb01ling objections. The insurer<\/p>\n
in his objections, among other things, while admitting<\/p>\n
the accident contended that, the accident that took<\/p>\n
place was not on account of the rash and negligent<\/p>\n

it  documentary evidence placed on record held that<\/p>\n
Vfthe accident in question took place due to the rash and<\/p>\n
negligent driving of the offending lorry by its dziver and<\/p>\n
thereby the petitioner has established that the accident<\/p>\n
av<\/p>\n

has taken piace due to the actionable negligence of the<\/p>\n
driver of the lorry. Further, the Tribunal looliinginto<\/p>\n
the medical evidence on record, taking   <\/p>\n
the petitioner at 10% ~l6% and  ”\n<\/p>\n
record, awarded compensation ftow*ard.s <\/p>\n
suffering at ?75,000\/–, “tV_towards’~   L’<\/p>\n

it   awarded to him has preferred the<\/p>\n
 present appeal seeking enhancement of compensation.<\/p>\n
it   The learned counsei for the appellant submitted<\/p>\n
that the Tribunai has not awarded commensurate<\/p>\n
compensation for the injuries sustained by the<\/p>\n
petitioner in the accident and further it has aiso not<\/p>\n
a\\,\/<\/p>\n
awarded just compensation towards conveyance,<\/p>\n
nourishing food and attendant charges, towards of<\/p>\n
amenities, cliscomforts and unhapp.ine’ss,’ftowardsig <\/p>\n
medical expenses for which he  jj.prodii’ced’\u00bb.1ried.ical ‘<\/p>\n
bills. Hence, a case for enhancernent is  V<\/p>\n

 Ttilaunatgtogpttiiep petitioner is just and reasonable?<\/p>\n
 are not in dispute. That the petitioner<\/p>\n
havin’g,r’sustained injuries in the accident and the<\/p>\n
v.””\u00ab.AaccitAient having taken place due to the negligence of the<\/p>\n
 .,_dEriver of the offending lorry are not in dispute. The<\/p>\n
medical evidence on record discloses that the petitioner<\/p>\n
has sustained a lacerated wound on the face near right<\/p>\n
eye measuring 5 ems x 2 ems, suspected fracture.-of ribs<\/p>\n
on right side, laeerated wound of right forearrn:..”upper<\/p>\n
1\/8 and elbow measuring 8 ems X 4 ems   <\/p>\n
fracture of right tibia upper I \/S.””He  in   T<\/p>\n
for nearly 110 days and unei’ergone .surge’ries.-up<\/p>\n
Taking these aspects into e’oITisideration’;Agwe\u00e9ddeedm it fit<\/p>\n
to award a further sum  towards’ pain and
\nsufferings in addition  \/?,\u00a7\\’.ol’a.iNarded by the
\nTribunal. Fui’ther, ipwep   Tribunal has<\/p>\n
awarded  ‘conveyance, nourishing food<\/p>\n
and attendant.’e_harges\ufb01’\u00bbIfIa_ving regard to the period for
\nwhich  in the and the nature of injuries<\/p>\n
hegliass. suffe1’-eVd,V the treatment that he has taken, we<\/p>\n

  awarded by the Tribunal under the said<\/p>\n
head’. V”‘VFurther, the Tribunal has awarded only a sum of<\/p>\n
  — towards loss of amenities, diseomforts and<\/p>\n
hdurdihappiness. As already pointed out, the petitioner has<\/p>\n
sustained four injuries which comprises of fractures<\/p>\n
and has underwent four surgeries and he was in the<\/p>\n
.\u00bbv<\/p>\n

hospitai for 110 days. Taking these facts into<\/p>\n
consideration, we are of the View that_’…fer_d~.._the<\/p>\n
diseornforts and unhappiness he has  <\/p>\n
should be awarded ?10,000\/hjuprnore teweseeeexees <\/p>\n
amenities, diseomforts and unhappir1ess_inadditio\ufb01lito<\/p>\n
?30,000\/– awarded by the_v’Tribuna1:._  fdutureedd<\/p>\n
medical expenses that has ‘awarded-at  rate of
\n‘\u20ac10,000\/– by the   regard to the
\nevidence on    it just and proper<\/p>\n
and there’t’oi_’eV,1″e~deeds’-:_Vjno’t. _ for any enhancement.<\/p>\n
Coming ._ toy’ihevdieal’expenses, though the petitioner
\ncIa1’ms’dth’a’t he   ?1,42,366.76p as per bills<\/p>\n
 theV”eoV1:1:nse:1 for the insurer submits that there<\/p>\n
. are some-.re-petitions in the bills. Hence, both counsei<\/p>\n
 ~remydis{ibmpit’ted that a further sum of $40,000\/~ be<\/p>\n
 addition to 340,000\/– awarded by the<\/p>\n
it \u00bb tribunal. Having regard to the same, we award a further<\/p>\n
 of ?”‘40,000\/– towards medical expenses, there by<\/p>\n
in all the petitioner is entitled to a compensation<\/p>\n
?80,000\/– towards medical expenses. Thus, in our view,<\/p>\n
c5\\}\/<\/p>\n
the petitioner is entitled to compensation _..___under<\/p>\n
different heads as follows :-\n<\/p>\n

enhpahoed co’rnpeVnsa:’;ion comes to ?70,000\/-.<\/p>\n
A    Accordingly, the appeal is allowed in part. The<\/p>\n
l’ ‘petitioner:..isc:=.Ventitled to the enhanced compensation of<\/p>\n
 \/.\u00a7~xwith interest at 6% p.a. from the date of the<\/p>\n
2  xpetitiori till realisation in addition to the compensation<\/p>\n
‘awarded by the tribunal.\n<\/p>\n
The insurer is directed to deposit the enhanced<\/p>\n
compensation of ?70,000\/– with interest at 6% p.a. from<\/p>\n

the date of petition till the date of realisation, within
\nfour weeks from the date of receipt of the <\/p>\n
judgment and award.\n<\/p>\n
