Justice ANTONY DOMINIC\n\n Dated :11\/12\/2008\n\n O R D E R\n                     ANTONY DOMINIC, J\n\n    -----------------------------------------------------------\n                    W.P.(C).No.36479\/2008\n    -----------------------------------------------------------\n          Dated this the 11th   day of December, 2008\n\n\n                           JUDGMENT\n<\/pre>\n<p>     By Ext.P1 order, the 4th respondent appointed the<\/p>\n<p>petitioner   as      LPSA,     with    effect   from     1.6.2007.<\/p>\n<p>Subsequently, by Ext.P2 order, with effect from 16.7.2007,<\/p>\n<p>the petitioner was transferred to another school under the<\/p>\n<p>same management within           the Trithala Educational Sub<\/p>\n<p>District. According to the petitioner, though a proposal for<\/p>\n<p>approval was made to the 3rd respondent, in Ext.P4<\/p>\n<p>communication the 3rd respondent took the stand that<\/p>\n<p>certain documents for considering the request for approval<\/p>\n<p>were not received and therefore he is not in a position to<\/p>\n<p>consider the same. Petitioner submits that, the documents<\/p>\n<p>were still available with the Manager and the representation<\/p>\n<p>made to him did not evoke any result.                    In these<\/p>\n<p><span class=\"hidden_text\">WP(c).No.36479\/08            2<\/span><\/p>\n<p>circumstances,     the   petitioner approached      the   6th<\/p>\n<p>respondent by filing Ext.P7 and in this writ petition what is<\/p>\n<p>sought for is a direction to the 6th respondent to consider<\/p>\n<p>and pass orders on Ext.P7, taking note of Ext.P1, by which,<\/p>\n<p>approval was granted by the 2nd respondent for his initial<\/p>\n<p>appointment.\n<\/p>\n<p>      2. Having regard to the aforesaid factual situation and<\/p>\n<p>taking note of the fact that Ext.P7 has been filed before the<\/p>\n<p>6th respondent invoking the power under Rule           8-A of<\/p>\n<p>chapter XIV-A KER, it is for the 6th respondent to consider<\/p>\n<p>and pass orders on Ext.P7 with notice to the petitioner and<\/p>\n<p>the 4th respondent.
