Justice M.C.HARI RANI\n\n Dated :08\/11\/2010\n\n O R D E R\n               K.M.JOSEPH &amp; M.C.HARI RANI, JJ.\n         ------------------------------------------------------\n                  W.P.(C) No.32226 of 2010-C\n             ----------------------------------------------\n          Dated, this the 8th day of November, 2010\n\n                          J U D G M E N T\n<\/pre>\n<p>K.M.Joseph, J.\n<\/p>\n<p>              Petitioner has approached this Court seeking the<\/p>\n<p>following reliefs:\n<\/p>\n<blockquote><p>     &#8220;i) to issue a writ of mandamus or any other appropriate<\/p>\n<p>     writ, order or direction directing the respondents 1 to 4<\/p>\n<p>     to afford adequate and sufficient police protection to<\/p>\n<p>     Muthuvazhy Subramonia Swamy Temple and its Poojari<\/p>\n<p>     and worshipers from the unknown anti social elements<\/p>\n<p>     who creates constant threat in the temple premise.<\/p>\n<\/blockquote>\n<blockquote><p>     ii) to issue a writ of mandamus or any other appropriate<\/p>\n<p>     writ, order or direction directing the respondent to take<\/p>\n<p>     appropriate action on the matter so as to maintain the<\/p>\n<p>     law and order situation ensuring tranquility in the<\/p>\n<p>     locality.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>              2.   Briefly put,the case of the petitioner is as<\/p>\n<p>follows.     Petitioner is the Manager of the            Muthuvazhy<\/p>\n<p>Subramonia Swamy Temple           and the said temple belongs to<\/p>\n<p>their family. There is rumours spread in the locality that the<\/p>\n<p>Thazhikakudom (dome) of the sanctum sanctorum of the<\/p>\n<p>temple contains a valuable and very costly substance, there<\/p>\n<p><span class=\"hidden_text\">WPC 32226\/2010                    -2-<\/span><\/p>\n<p>happened series of occurrences for conducting robbery. Five<\/p>\n<p>persons were arrested by the police and crime was registered.<\/p>\n<\/blockquote>\n<p>The said matter is on the committal stage. Recently, there<\/p>\n<p>occurred another unpleasant and terrible incident and because<\/p>\n<p>of that terror the worshipers and Poojari are under fear.<\/p>\n<p>            3. Learned Government Pleader, on instructions,<\/p>\n<p>submits as follows: There is a civil case pending between the<\/p>\n<p>members of the family of the petitioner regarding the<\/p>\n<p>ownership of the temple. In 2008 the Director of Archeology,<\/p>\n<p>Thiruvananthapuram has requested the Superintendent of<\/p>\n<p>Police, Alappuzha to provide security to the temple in view of<\/p>\n<p>the fact that very valuable substance is found in the<\/p>\n<p>Thazhikakudom.      Beat Register   has been established and<\/p>\n<p>regular patrolling is being done. Attempt of theft was made<\/p>\n<p>and that was thwarted on 16.6.2010. Learned Government<\/p>\n<p>Pleader would further submit that effective patrolling is being<\/p>\n<p>done and security measures are adopted so as to protect the<\/p>\n<p>property of the temple.     We record the submission of the<\/p>\n<p>learned Government Pleader and dispose of the writ petition in<\/p>\n<p>terms of the said submission. We make it clear that, it should<\/p>\n<p><span class=\"hidden_text\">WPC 32226\/2010                    -3-<\/span><\/p>\n<p>not be understood as meaning that we have pronounced on<\/p>\n<p>any issue which is pending before the civil Court and the civil<\/p>\n<p>Court is free to decide the matter untrammeled by anything<\/p>\n<p>contained in this judgment. We further make it clear that, this<\/p>\n<p>must not be treated as a pronouncement of any right in favour<\/p>\n<p>of the petitioner who has approached this Court as between<\/p>\n<p>the petitioner and any other party to civil suit.
