No.30362 of 2010\n                       PRAKASH CHUAHAN, SON LATE RAMCHARITRA\n                       CHAUHAN, RESIDENT OF VILLAGE KAMRUP, P.S.\n                       KADWA, DISTRICT KATIHAR.\n                                             Versus\n                                  THE STATE OF BIHAR\n                                          -----------\n<\/pre>\n<p>02.   12.10.2010                Heard learned counsel for the petitioner and<\/p>\n<p>                   the State.\n<\/p>\n<p>                                Petitioner husband is apprehending his<\/p>\n<p>                   arrest in connection with a case registered for the<\/p>\n<p>                   offence under Section-498A of the Penal Code and<\/p>\n<p>                   Section-4 of the Dowry Prohibition Act. It is submitted<\/p>\n<p>                   on behalf of the petitioner that he is ready and willing to<\/p>\n<p>                   continue     the   matrimonial       relationship   with    the<\/p>\n<p>                   complainant and to that effect he shall file written<\/p>\n<p>                   undertaking on affidavit in the court below within four<\/p>\n<p>                   weeks from the date of receipt of this order in the court<\/p>\n<p>                   below.\n<\/p>\n<p>                                No sooner the petitioner above named file<\/p>\n<p>                   such undertaking on affidavit, he be admitted to the<\/p>\n<p>                   privilege of provisional bail on furnishing bail bond of<\/p>\n<p>                   Rs.5,000\/-(Five thousand) with two sureties of the like<\/p>\n<p>                   amount each to the satisfaction of Sub-Divisional<\/p>\n<p>                   Judicial     Magistrate,   Katihar     in   connection     with<\/p>\n<p>                   Complaint Case No.1897 of 2008, thereafter notice be<\/p>\n<p>                   issued to the complainant and once she appears<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>          petitioner in presence of the court should persuade her<\/p>\n<p>          to come back to the matrimonial home not only by<\/p>\n<p>          words of mouth but also with suitable conduct and<\/p>\n<p>          gesture which should generate confidence in her.<\/p>\n<p>                        In the event, complainant comes back to the<\/p>\n<p>          matrimonial home or the matrimonial dispute is<\/p>\n<p>          resolved      or   the       complainant   is   found     to   be<\/p>\n<p>          unreasonable, provisional bail allowed to the petitioner<\/p>\n<p>          should be confirmed, failing which the court below<\/p>\n<p>          should pass appropriate order in accordance with law<\/p>\n<p>          considering the reasonableness of the stand of the<\/p>\n<p>          parties.\n<\/p>\n<p>                        This application is, accordingly, disposed of.<\/p>\n<p>                        Let this order be communicated to the court<\/p>\n<p>          below through fax on payment of usual charges by the<\/p>\n<p>          petitioner.\n<\/p>\n<\/p>\n<pre>Rajesh\/                                        ( V.
