Justice ANTONY DOMINIC\n\n Dated :16\/02\/2010\n\n O R D E R\n                       ANTONY DOMINIC, J.\n              --------------------------------------------------\n                 W.P.(C) NO.27364 OF 2009 (m)\n              --------------------------------------------------\n          Dated this the 16th day of February, 2010\n\n                           J U D G M E N T\n<\/pre>\n<p>       According to the petitioner for            want of repair to the<\/p>\n<p>Vidhodaya School-Mukkottil Temple Road, which is vested in the<\/p>\n<p>first respondent Panchayat, the road is not in a motorable condition<\/p>\n<p>and therefore a direction is sought for improving the condition of<\/p>\n<p>the road.\n<\/p>\n<p>       On behalf of the Panchayat a statement has been filed,<\/p>\n<p>wherein Panchayat is accepting that the condition of the road is not<\/p>\n<p>good. However, they state that during the current financial year the<\/p>\n<p>entire funds have been alloted for other projects and therefore they<\/p>\n<p>are not in a position to undertake any work immediately. It is stated<\/p>\n<p>that in the next financial year commencing                  from 1.4.2010,<\/p>\n<p>Panchayat will raise sufficient funds and improve the condition of<\/p>\n<p>the road.
