Justice S.S.SATHEESACHANDRAN\n\n Dated :16\/10\/2009\n\n O R D E R\n              S.S.SATHEESACHANDRAN, J.\n                  -------------------------------\n             W.P.(C).NO.29117 OF 2009 (O)\n                -----------------------------------\n        Dated this the 16th day of October, 2009\n\n                      J U D G M E N T\n<\/pre>\n<p>      The writ petition is filed seeking mainly the following<\/p>\n<p>reliefs:\n<\/p>\n<\/p>\n<blockquote><p>          i. to issue a writ of certiorari or other<br \/>\n          appropriate writ, order or direction,<br \/>\n          calling for the records leading to Ext.P4<br \/>\n          and to set aside the same.\n<\/p><\/blockquote>\n<blockquote><p>          ii. to issue a writ of mandamus or other<br \/>\n          appropriate writ, order or direction,<br \/>\n          directing the court below to dispose<br \/>\n          A.S.No.125 of 2007 pending before it and<br \/>\n          in the meanwhile stay the execution of the<br \/>\n          decree in O.S.No.293 of 1990 on the file<br \/>\n          of the Munsiff&#8217;s Court, Neyyattinkara.<\/p><\/blockquote>\n<p>      2. Petitioner had filed an obstruction petition against the<\/p>\n<p>execution of a decree passed in a suit for partition, namely<\/p>\n<p>O.S.No.293 of 1990 on the file of the Ist Additional Munsiff<\/p>\n<p><span class=\"hidden_text\">WPC.29117\/09                   2<\/span><\/p>\n<p>Court, Neyyattinkara.     That petition, after enquiry, was<\/p>\n<p>dismissed by the learned Munsiff. An appeal was preferred as<\/p>\n<p>A.S.No.125 of 2007 before the Sub Court, Neyyattinkara<\/p>\n<p>against the dismissal of his petition.      In the appeal, an<\/p>\n<p>application for stay was applied for, but, declined by the<\/p>\n<p>appellate court.     Ext.P4 is that order.      Propriety and<\/p>\n<p>correctness of Ext.P4 order is challenged in the writ petition<\/p>\n<p>invoking the supervisory jurisdiction vested with this Court<\/p>\n<p>under Article 227 of the Constitution of India.<\/p>\n<p>     2. I heard the learned counsel for the petitioner. Having<\/p>\n<p>regard to the submissions made and taking note of the facts<\/p>\n<p>and circumstances presented, I find no notice to the<\/p>\n<p>respondents is necessary, and, hence, it is dispensed with.<\/p>\n<p>The learned counsel for the petitioner submitted after passing<\/p>\n<p>of the decree in O.S.No.293 of 1990, without impleading all<\/p>\n<p>the sharers having right over the property, another suit had<\/p>\n<p>been filed as O.S.No.453 of 1997, in which, the decree holders<\/p>\n<p>in the previous suit were also parties, and a decree had been<\/p>\n<p>passed binding on them as well. In view of the decree passed<\/p>\n<p>in the second suit, superseding the previous decree passed in<\/p>\n<p><span class=\"hidden_text\">WPC.29117\/09                   3<\/span><\/p>\n<p>favour of the respondents, his claim over the property was<\/p>\n<p>raised by filing an obstruction petition. Without adverting to<\/p>\n<p>the claim canvassed with reference to the decree passed in the<\/p>\n<p>second suit the learned Munsiff dismissed that petition.<\/p>\n<p>Though the appeal preferred has been admitted, in view of the<\/p>\n<p>dismissal of the stay petition, the appeal will become<\/p>\n<p>infructuous and the valuable rights of the petitioner over the<\/p>\n<p>property would be seriously affected, is the submission of the<\/p>\n<p>counsel. Having regard to the submissions made and perusing<\/p>\n<p>the exhibits produced in the writ petition, I find even in the<\/p>\n<p>judgment relied by the petitioner and passed in the second<\/p>\n<p>suit, it is made clear that the decree had been granted with<\/p>\n<p>direction not to disturb the decree granted in favour of the<\/p>\n<p>respondents\/plaintiffs in O.S.No.293 of 1990.         Operative<\/p>\n<p>portion of the judgment in Ext.P2 disclose that the shares of<\/p>\n<p>the plaintiff and other defendants in that suit, O.S.No.453 of<\/p>\n<p>1997 are directed to be allotted, from the other portions of the<\/p>\n<p>property, which are not set apart to D1 to D3 as per Exts.B1<\/p>\n<p>and B2, the commission report and plan prepared in their suit<\/p>\n<p>O.S.No.293 of 1990.     When that be so, prima facie, there<\/p>\n<p>appears to be no merit in the case canvassed by the petitioner<\/p>\n<p><span class=\"hidden_text\">WPC.29117\/09                    4<\/span><\/p>\n<p>by virtue of the decree passed in the second suit the decree<\/p>\n<p>granted to respondents\/plaintiffs in the previous suit is<\/p>\n<p>prejudicially affected.   Granting of stay in an appeal falls<\/p>\n<p>within the preview of the judicial discretion of the appellate<\/p>\n<p>court. I find no impropriety in Ext.P4 order passed by the<\/p>\n<p>court below in declining the stay sought for by the<\/p>\n<p>petitioner\/appellant in the given facts of the case. However, I<\/p>\n<p>make it clear that none of the observations made by this Court<\/p>\n<p>shall have any influence or bearing in disposing the appeal on<\/p>\n<p>its merits. Views expressed by this Court are formed only on a<\/p>\n<p>prima facie evaluation of the materials, and submissions made,<\/p>\n<p>but, not on the appreciation of the evidence in the case, and so<\/p>\n<p>much so, it should not affect the substantive rights of the<\/p>\n<p>parties involved in the proceedings.
