PATTANAIK (J)\n\nCITATION:\n JT 1996 (5)   367\t  1996 SCALE  (4)167\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t    And<br \/>\n\t      Civil Appeal Nos.7518-20 of 1996<br \/>\n\t(Arising out of SLP(C) Nos. 8215-17 of 1996)<br \/>\n\t\t\t O R D E R<br \/>\n     Delay condoned.\n<\/p>\n<p>     Leave granted.\n<\/p>\n<p>     We have heard learned counsel on both sides.<br \/>\n     The writ  petitioners in  the High Court as well as the<br \/>\nState have come up in these appeals. It is not necessary for<br \/>\nus  to\telaborate  all\tthe  material  facts  and  also\t the<br \/>\ncontentions advanced  in the High Court. Suffice it to state<br \/>\nthat the  High Court  of Patna\tin the\timpugned order dated<br \/>\nNovember 21,  1995 in CWJC Nos. 2093\/89 and 3072\/90 directed<br \/>\nthe Government\tto identify  the vacancies  existing  as  on<br \/>\nDecember 31,1987  and available\t for appointment  from among<br \/>\nthe candidates\tin the\twaiting list  as recommended  by the<br \/>\nPublic\tService\t  Commission  to   the\tAssistant  Engineers<br \/>\n(Civil). The  High Court  also\tfound  that  the  200  posts<br \/>\nearmarked by  the Government  in their resolution dated June<br \/>\n16, 1987  were intended\t for Engineers\tin Rural Engineering<br \/>\nOrganization but  the writ  petitioners have  no right to be<br \/>\nappointed up to those posts from the wait listed candidates.\n<\/p>\n<p>     Shri  Gopal   Subramaniam,\t  learned   senior   counsel<br \/>\nappearing for  the writ petitioners contended that since the<br \/>\nPublic Service\tCommission had\trejected the  request of the<br \/>\nState Government  to regularize\t the employees holding these<br \/>\n200 posts  in the Government Resolution dated June 16, 1987,<br \/>\nthose posts  should be] made available to the candidates who<br \/>\nare wait  listed. We  find no force in the contention. It is<br \/>\nseen that those 200 posts are meant to the Rural Engineering<br \/>\nOrganization and  not  for  Road\/Building  Construction\t and<br \/>\nPublic Works  Department.  Under  those\t circumstances,\t the<br \/>\nnecessary consequence  would be\t that those 200 posts should<br \/>\nbe made\t available for direct recruitment through the Public<br \/>\nService Commission  and the  eligible candidates would apply<br \/>\nfor and get the selection according to rules for appointment<br \/>\nto those  posts. It  would be  open to the employees also to<br \/>\napply for direct recruitment and seek selection according to<br \/>\nrules.\n<\/p>\n<p>     With regard to the direction given by the High Court to<br \/>\nidentify the  existing vacancies  as on\t December 31 1987 as<br \/>\nper the\t Resolution of the Government for being filled up by<br \/>\nthe wait  listed candidates,  we find  no exception  to\t the<br \/>\ndirection given\t by the High Court, on the peculiar facts in<br \/>\nthis case.  It is  true that the court cannot give direction<br \/>\nto fill\t up vacancies  from the waiting list after the lapse<br \/>\nof one\tyear. But  in this  case, the  High Court  had given<br \/>\nexception to  the  principle.  An  interim  direction  given<br \/>\nearlier to keep the waiting list alive was in operation till<br \/>\nthe disposal  of the  writ petition. The High Court has also<br \/>\nfound that  on the  basis of  the material on record, it was<br \/>\nnot possible  for the  court to record any finding as to the<br \/>\nnumber of  vacancies existing  as on December 31, 1987 so as<br \/>\nto give direction to fill up those posts from the candidates<br \/>\navailable in the waiting list.\n<\/p>\n<p>     It is  then contended  for the  State that\t a  positive<br \/>\nstand taken  and the  material placed  before the High Court<br \/>\nwas that the vacancies meant for the general candidates have<br \/>\nalready been  filled up\t and that  there were  no  vacancies<br \/>\nexisting as  on that  date. It\tis true\t that the  State has<br \/>\ntaken that  stand. But the High Court did not feel satisfied<br \/>\nto accept  the Government&#8217;s  contention that  no posts\twere<br \/>\navailable for  appointment. Under  those  circumstances,  it<br \/>\nwould be  for the  Government to  make\tafresh\texercise  to<br \/>\nidentify whether  there exist  vacancies  meant\t either\t for<br \/>\ngeneral candidates  or for  the reserved  candidates and, if<br \/>\nso, how\t many of  them\tdo  exist  so  as  to  fill  up\t the<br \/>\nvacancies, if  so identified, from among the candidates from<br \/>\nwaiting list  If the  Government finds\tthat  there  are  no<br \/>\nvacancies existing,  the Government  would place a report in<br \/>\nthis behalf before the High Court accordingly.\n<\/p>\n<p>     The appeals  are dismissed with the above observations.<br \/>\nNo costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Bihar State Unemployed &#8230; vs The State Of Bihar And Others on 8 April, 1996 Equivalent citations: JT 1996 (5), 367 1996 SCALE (4)167 Author: K Ramaswamy Bench: Ramaswamy, K.
