Rule stands discharged qua applicant No.1.\n<\/p>\n<p>\tSo<br \/>\nfar as applicants Nos.2 and 3 are concerned, they pray for regular<br \/>\nbail in connection with the offences registered with Unjha Police<br \/>\nStation vide C.R.No.I 33 of 2011 for the offences punishable under<br \/>\nSections 306, 498A and 114 of the IPC read with Sections 3 and 7 of<br \/>\nthe Dowry Prohibition Act, 1961.\n<\/p>\n<p>\tI<br \/>\nhave heard learned advocate Mr D.B.Patel for the applicants and Mr<br \/>\nAshish J Desai, learned Additional Public Prosecutor for the<br \/>\nrespondent &#8211; State.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case, I am persuaded to exercise<br \/>\nmy discretion in favour of the accused &#8211; applicants Nos.2 and 3<br \/>\ntaking into consideration the following aspects:-\n<\/p>\n<p>\tAccused<br \/>\nNos.2 and 3 are the brothers-in-law of the deceased.  They are no way<br \/>\nconcerned directly with the allegations levelled in the FIR.  Prima<br \/>\nfacie, from the cause title of the complaint itself it is evident<br \/>\nthat accused &#8211; applicant No.2 and accused applicant No.3 are<br \/>\nresiding separately whereas deceased and her husband &#8211;<br \/>\napplicant No.1, for whom the application has not been pressed, were<br \/>\nresiding at village Sunok.  In that view of the matter, I order<br \/>\nrelease of the accused applicants Nos.2 and 3 &#8211; Patel<br \/>\nSatishkumar Somabhai and Patel Bharatkumar Somabhai respectively on<br \/>\nregular bail in<br \/>\nconnection with  offence registered with Unjha Police Station, being<br \/>\nCrime Register No.I-33 of 2011 on each of them executing a bond in<br \/>\nthe sum of Rs.10,000\/- (Rupees ten thousand only) with  one surety of<br \/>\n the  like  amount  to  the  satisfaction  of  the  lower  Court  and<br \/>\n subject  to the  conditions that they shall,<\/p>\n<p> [a]\tnot take undue advantage of or misuse liberty;\n<\/p>\n<p>[b]\tmaintain<br \/>\nlaw and order and should co-operate with the investigating officer;\n<\/p>\n<p>[c]\tnot<br \/>\nact in a manner injurious to the interest of the \tprosecution;\n<\/p>\n<p>[d]\tsurrender<br \/>\nhis passport, if any, to the lower court<br \/>\nwithin a \tweek;\n<\/p>\n<p>[e]\tnot leave<br \/>\nthe local limits of the State of Gujarat without prior permission of<br \/>\nthe Sessions Judge concerned;\n<\/p>\n<p>[f]\tfurnish the<br \/>\naddress of his residence at the time of execution of the bond and<br \/>\nshall not change the residence without prior permission of this<br \/>\nCourt.\n<\/p>\n<p>\tThe<br \/>\nauthorities will release the applicants only if they are not required<br \/>\nin connection with any other offence for the time being.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant<br \/>\nor take appropriate action in the matter.\n<\/p>\n<p>\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case. This  application is allowed.\n<\/p>\n<p>\tRule<br \/>\nis made absolute qua applicants Nos.2 and 3. D.S.
