No.4743\/1995. The said<br \/>\nmatter came to be disposed of vide judgment and order dated<br \/>\n01.03.2005, which reads as under;\n<\/p>\n<p>1.\t       This   petition,   under<br \/>\nArticle   226  of  the<br \/>\n       Constitution of India, seeks mandamus  to  be  issued  to<br \/>\n      respondent authorities for appropriate direction that the<br \/>\n      post of English Lecturer in the institute viz.  Shri M.H.<br \/>\n      Patel Gramseva Mahavidyalaya, Samoda Ganwada to be filled<br \/>\n      by  the  reserved  category for Baxi Panch candidates and<br \/>\n      further to call for the petitioner for interview  of  the<br \/>\n      said post.    The  petitioner has further prayed that the<br \/>\n      respondents  be  restrained  from  filling  up  the  said<br \/>\n      vacancy  for  the post of English Lecturer from any other<br \/>\n      category then Baxi Panch.\n<\/p>\n<p>      2.\tIt is the  case  of  the  petitioner  that  after<br \/>\n      having  acquired  qualifications  of  Master of Arts with<br \/>\n      English as a main subject and bachelor in education B.Ed.<br \/>\n      examination, the petitioner had applied for the  post  of<br \/>\n      English  Lecturer pursuant to the advertisement issued by<br \/>\n      the institution  and  he  was  called  for  interview  on<br \/>\n      28-08-1992,  where the petitioner was declared successful<br \/>\n      and was given appointment on probation for a period of 01<br \/>\n      (one) year.  That thereafter the said period of probation<br \/>\n      was extended for a  further  period  of  01  (one)  year.<br \/>\n      However,  the  service  of  the  petitioner was not found<br \/>\n      satisfactory and, therefore, it was put to an end by  the<br \/>\n      institution vide order dated 15-10-1994.\n<\/p>\n<p>      3.\tSince the service of the petitioner was put to an<br \/>\n      end in view of  the  unsatisfactory  performance  of  the<br \/>\n      petitioner as a probationer, a sanction was sought by the<br \/>\n      institution  from  the  concerned  competent authority to<br \/>\n      fill up the said post of English Lecturer  and  by  order<br \/>\n      dated    12-05-1995   Director   of   Higher   Education,<br \/>\n      Gandhinagar had given permission to  the  institution  to<br \/>\n      fill  up  the vacancy for the post of English Lecturer in<br \/>\n      view of the Roster Point No.7 as provided  by  Government<br \/>\n      Resolution  of  General  Administration  Department dated<br \/>\n      30-09-1994 and Schedule-III annexed therewith.  According<br \/>\n      to the said letter of sanction, issued by the Director of<br \/>\n      Higher Education dated 12-05-1995, the  post  of  English<br \/>\n      Lecturer  was to be filled in as per Roster Point No.7 by<br \/>\n      unreserved category   candidate.        The    petitioner<br \/>\n      apprehended  that  pursuant to the said sanction given by<br \/>\n      the  Director  of  Higher  Education  vide  letter  dated<br \/>\n      12-05-1995,  the  necessary exercise for selection of the<br \/>\n      candidate will be undertaken by the institute  and  since<br \/>\n      the   said   post   was  reserved  for  general  category<br \/>\n      candidate, the case of the petitioner for the  said  post<br \/>\n      being a Baxi Panch candidate would be sidelined.\n<\/p>\n<p>      4.\tPursuant to the Notice and subsequent Rule issued<br \/>\n      by  this  Court,  respondent authorities have filed their<br \/>\n      affidavit-in-reply  and  submitted  that  the   post   in<br \/>\n      question viz.    Lecturer  for  the subject of English is<br \/>\n      rightly earmarked for the unreserved candidate as per the<br \/>\n      provision of the Government Resolution  dated  30-09-1994<br \/>\n      and Schedule-III  attached  therewith.   The Roster Point<br \/>\n      Nos.6  and  7  are  applicable  to  unreserved   category<br \/>\n      candidate  only and once the petitioner who was appointed<br \/>\n      earlier  on  probation  and  whose  service  came  to  be<br \/>\n      terminated  on  the  ground of unsatisfactory performance<br \/>\n      could  hot  have   agitated   his   claim   further   and<br \/>\n      alternatively  it  was  open to the petitioner to contest<br \/>\n      and  applied  for  the  post  earmarked  for   unreserved<br \/>\n      candidate.\n<\/p>\n<p>      5.\tShri L.B.Dabhi, learned A.G.P.  appearing for the<br \/>\n      respondent  &#8211;  State,  has relied upon affidavit-in-reply<br \/>\n      filed  by  Shri  K.L.Tabiyad,  Senior  Superintendent  of<br \/>\n      Higher Education, Gandhinagar and submitted that the case<br \/>\n      of   the   petitioner  is  premature  and  the  selection<br \/>\n      procedure undertaken by the institution on the  basis  of<br \/>\n      sanction  by the Director of Higher Education vide letter<br \/>\n      dated 12-05-1995 cannot be said  to  be  unreasonable  or<br \/>\n      arbitrary   or   discriminatory  in  any  manner  and  no<br \/>\n      fundamental right of the petitioner is violated  qua  the<br \/>\n      appointment  for  the  post of lecturer in the subject of<br \/>\n      English.   He  has  further  submitted  that  as  far  as<br \/>\n      probation of the petitioner is concerned, it was a matter<br \/>\n      between the  institute  viz.   Shree Saraswati Gram Vidya<br \/>\n      Peeth, Samoda Ganwada and the  petitioner  in  accordance<br \/>\n      with  law  when  work  of  the  petitioner  was not found<br \/>\n      satisfactory,  his  probation  period  put  to  an   end.<br \/>\n      Therefore,   according  to  Mr.Dabhi,  learned  AGP,  the<br \/>\n      petition deserves to be rejected.\n<\/p>\n<p>      6.\tSo far  as  Shree  Saraswati  Gram  Vidya  Peeth,<br \/>\n      Samoda  Ganwada,  the  respondent  No.1  &#8211;  Institute  is<br \/>\n      concerned, an affidavit-in-reply is  filed.    They  have<br \/>\n      also  averred  that  they  were  given  sanction  by  the<br \/>\n      competent authority vide letter dated 12-05-1995 and  the<br \/>\n      said  post is required to be filled up by considering the<br \/>\n      Roster Point No.7 which belongs  to  unreserved  category<br \/>\n      and, therefore, the selection procedure undertaken by the<br \/>\n      authority  cannot be said to be in any manner illegal and<br \/>\n      no fundamental right of the petitioner is violated.  More<br \/>\n      particularly when the service  of  the  petitioner  as  a<br \/>\n      probationer  in  the  very  same institute on the post of<br \/>\n      English Lecturer for the subject of English was not found<br \/>\n      satisfactory.  It was  submitted  that  the  petition  is<br \/>\n      premature  and does not deserves any interference by this<br \/>\n      Hon&#8217;ble Court.\n<\/p>\n<p>      7.\tHaving   heard  the  learned  advocates  for  the<br \/>\n      parties.  The case of the petitioner is not  well-founded<br \/>\n      on  the ground that the respondent No.1 &#8211; Institution has<br \/>\n      in fact made  an  attempt  and  when  the  said  post  of<br \/>\n      lecturer  for  the subject of English, which was reserved<br \/>\n      for Baxi Panch Community as per Roster Point  No.5  which<br \/>\n      was  prevailed  at that point of time, the petitioner was<br \/>\n      appointed by order dated 13-11-1992.   Even  subsequently<br \/>\n      also  the petitioner was sounded to prove his performance<br \/>\n      but it did not yield any result  and  on  the  ground  of<br \/>\n      unsatisfactory performance, service of the petitioner was<br \/>\n      terminated by an order dated 15-10-1994, which is not the<br \/>\n      subject matter of challenge in this petition.\n<\/p>\n<p>      8.\tThat the sanction letter issued by  the  Director<br \/>\n      of  Higher  Education dated 12-05-1995 and the Government<br \/>\n      Resolution  dated  13-09-1994  along  with   Schedule-III<br \/>\n      annexed  by  the deponent with affidavit-in-reply clearly<br \/>\n      mention  that  the  post  was  earmarked  for  unreserved<br \/>\n      candidate  of  applicability  of  Roster  Point No.7 and,<br \/>\n      therefore, no legal right accrued to  the  petitioner  to<br \/>\n      seek  mandamus from this Court in exercise of power under<br \/>\n      Article 226 of the Constitution of India.  Therefore,  no<br \/>\n      illegalities appears to have been committed on perusal of<br \/>\n      the  records,  it  cannot  be  said  that  the respondent<br \/>\n      authorities  have  acted   unreasonably,   arbitrary   or<br \/>\n      violative  of  provisions  of  Articles  14 and 16 of the<br \/>\n      Constitution of India.\n<\/p>\n<p>      9.\tNo case is made  out  for  interference  by  this<br \/>\n      Court  in  view  of  the  fact  that the post for English<br \/>\n      Lecturer is rightly  earmarked  for  unreserved  category<br \/>\n      viz.   general  category  candidate  on  applicability of<br \/>\n      Roster Point No.7 as provided by Government Resolution of<br \/>\n      General Administration Department  dated  30-09-1994  and<br \/>\n      Schedule-III  and  no  fundamental  right,  much less any<br \/>\n      other legal rights of the petitioner is  infringed,  and,<br \/>\n      therefore, this is not a fit case where this Court should<br \/>\n      exercise its extraordinary jurisdiction under Article 226<br \/>\n      of the Constitution of India.\n<\/p>\n<p>      10.\tThe petition is  failed.  Rule discharged.  There<br \/>\n      shall be no order as to costs.\n<\/p>\n<p>2.\tHence, this petition also stands disposed of in terms of the aforesaid order. Rule is discharged.
