Justice K.M.JOSEPH\n\n Dated :08\/07\/2008\n\n O R D E R\n                                   K.M.JOSEPH, J.\n                        - - - - - - - - - - - - - - - - - - - - - - - - -\n                            WP.(C) No.20447 of 2008\n                        - - - - - - - - - - - - - - - - - - - - - - - - -\n                        Dated this the 8th day of July, 2008\n\n                                      JUDGMENT\n<\/pre>\n<p>             The issue raised in this writ petition is whether in respect of an<\/p>\n<p>educational institution bus, demand can be made for contribution under the<\/p>\n<p>Motor Transport Workers&#8217; Welfare Fund Act.\n<\/p>\n<p>             2. I heard learned Government Pleader and learned counsel for<\/p>\n<p>the fourth respondent also.          Learned counsel for the fourth respondent<\/p>\n<p>submits that a Division Bench of this court has dismissed the appeal filed by<\/p>\n<p>the Board and taken the view that an educational institution is not a motor<\/p>\n<p>transport undertaking.      He also points out that the petitioner has not<\/p>\n<p>produced the registration certificates to                     show that the vehicles are<\/p>\n<p>educational institution buses.\n<\/p>\n<p>             The writ petition is allowed as follows:\n<\/p>\n<p>             It is declared that the educational institution buses are not<\/p>\n<p>coming under the Motor Transport Workers Welfare Fund Act. There will<\/p>\n<p>be a direction to the third respondent to receive the motor vehicle tax in<\/p>\n<p>respect of the school vehicles of the petitioner without insisting for evidence<\/p>\n<p>regarding payment of contribution to the Welfare Fund on condition that the<\/p>\n<p>petitioner produces the registration certificates to show that the buses are<\/p>\n<p>educational institution buses.\n<\/p>\n<p>                                                                    (K.M.
