\nZ fell dmzm and at that time, the villagers i.e., Puttaswamy<\/p>\n

under Section 504 and 341 IPC. Aggrieved byjhei<\/p>\n
and sentence, the accused approached the  Cgisuif in <\/p>\n

2 .. jzxetiigioner that the injury is not grieveus and that MO. 1 is net :31<\/p>\n
\ufb01iji\ufb01erous weapon and therefore he submits that the Courts<\/p>\n
ii  ‘below committed an illegality in convicnlng the petitioner for the<\/p>\n
above said o\ufb01ence. He therefore submits that at the mast, the<\/p>\n
effence would fall under Section 323 [PC and as the pe\ufb01\ufb01oner<\/p>\n

\nconcerned, a question mark has been put in. ?W.1 though<\/p>\n
states that it is a grievous injury, he does not say as to how it
\nwould be called a grievous injury. The pemsai of E:-<.P.2 does
\nnot reveal any such material so that the injuries. ..1t1e;otione\u20aci '<\/p>\n
therein fall within the categoxy of the injuries <\/p>\n
Section 326 IPC. So also, the evidettoe of P'}'e';1.:\u00a3ioes~T\u00a7aot xeiieal<\/p>\n

 ” v.VthcE”‘<:3\u00a7ocfu1*\u00a73:ents  none of the wimesses have stated as<\/p>\n
A  re\u00abga1f\u00a3i3V4i\u00a7te I\ufb01eesurement of the club. In the circumstances, it<\/p>\n
o:Aa:1m,otV_'be  that MO. I is a dangerous weapon. In that View<\/p>\n
 of the  in the absence of the Weapon used being not a<\/p>\n
 \u00e9axtgemus weapon, it cannot be said that the o\ufb01enoe falls<\/p>\n
 the category of Section 326 IPC. In the absence of<\/p>\n
positive evidence, it has to be held that PW.2 suffered a simple<\/p>\n
injuiy and particularly, when a weapon uses is not a<\/p>\n
ciangemus Weapon. Thexeby, the o\ufb01ence falls under Section<\/p>\n
323 IPC.\n<\/p>\n
8. The evidence of the prosecution iL=S..\\’V.t’.i}.c<\/p>\n
