Justice V.GIRI\n\n Dated :15\/07\/2008\n\n O R D E R\n                         V.GIRI, J\n                       -------------------\n                    W.P.(C).21310\/2008\n                       --------------------\n           Dated this the 15th day of July, 2008\n\n                       JUDGMENT\n<\/pre>\n<p>     Petitioner while working as Special Tahsildar, Land<\/p>\n<p>Acquisition-I, Kollam, was called upon to take a decision<\/p>\n<p>on an option exercised by a land owner, under Section 49<\/p>\n<p>(2) of the Land Acquisition Act for acquiring the entire<\/p>\n<p>building, in circumstances where a portion of the building<\/p>\n<p>was the subject matter of          acquisition. The direction<\/p>\n<p>issued by this Court under Ext.P7 judgment was taken<\/p>\n<p>note of and apparently, the Special Tahsildar decided that<\/p>\n<p>the action    taken by the land owner will have to be<\/p>\n<p>accepted and prepared a detailed valuation statement,<\/p>\n<p>which was accepted by the District Collector. Building<\/p>\n<p>was tenanted. The tenants of the building alleged that<\/p>\n<p>the acquisition of the building as a whole was pursuant to<\/p>\n<p>a criminal conspiracy between the official and the owner<\/p>\n<p>of the building. Ext.P1 crime was registered and this is<\/p>\n<p>pending investigation. Taking note of the registration of<\/p>\n<p>crime, petitioner was placed under suspension as per<\/p>\n<p>Ext.P2 order dated 28.12.2007. Petitioner sought for a<\/p>\n<p>W.P.(C).21310\/2008<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>revocation of suspension as per Ext.P10 and the same is<\/p>\n<p>pending. Hence the writ petition.\n<\/p>\n<\/p>\n<p>2.    I heard learned counsel for the petitioner and<\/p>\n<p>learned Government Pleader.\n<\/p>\n<\/p>\n<p>3.    Certain aspects highlighted in Ext.P10 will merit<\/p>\n<p>consideration by the Government.       Firstly, since the<\/p>\n<p>acquisition proceedings have been proceeded with, the<\/p>\n<p>impact on the petitioner being reinstated in service, will<\/p>\n<p>have to be looked into by the Government. Secondly,<\/p>\n<p>petitioner could be given a posting elsewhere where he<\/p>\n<p>would not be in a position to interfere with the enquiry.<\/p>\n<p>Thirdly, the detailed valuation statement prepared by<\/p>\n<p>the petitioner was ultimately approved by the District<\/p>\n<p>Collector also.\n<\/p>\n<\/p>\n<p>4.
