APP for Opponent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 06\/10\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tThe<br \/>\npresent appellant has preferred this appeal under sec. 374(2) of the<br \/>\nCode of Criminal Procedure, against the judgment and order of<br \/>\nconviction and sentence  dated 21.11.2006 passed by the learned Addl.<br \/>\nSessions Judge, FTC No. 7, camp at Modasa in Sessions Case No.<br \/>\n63\/2006 whereby, the learned Judge has convicted the appellant under<br \/>\nsec. 363 of IPC and sentenced to undergo R\/I for two years and to pay<br \/>\na fine of Rs. 1000\/-, in default, to undergo S\/I for three months.<br \/>\nThe appellant is also convicted under sec. 366 of IPC and sentenced<br \/>\nto undergo R\/I for a period of 3 years and to pay a fine of Rs<br \/>\n1000\/-, in default, to undergo further S\/I for three months. The<br \/>\nappellant is also convicted under sec. 376 of IPC and sentenced to<br \/>\nundergo R\/I for 7 years, and to pay a fine of Rs. 1000\/-, in default,<br \/>\nto undergo S\/I for three months, which is impugned in this appeal.\n<\/p>\n<p>2.\tThe<br \/>\nbrief facts of the prosecution case is as under:\n<\/p>\n<p>3.\tThat<br \/>\non 28.12.2005, at about 20.00 hours, when the prosecutrix had gone to<br \/>\nanswer nature&#8217;s call, at that time, the appellant and co-accused have<br \/>\ncaught hold of the prosecutrix and after beating and threatening her,<br \/>\nabducted her and committed rape on her.\n<\/p>\n<p>4.\tTherefore<br \/>\na complaint came to be filed by the complainant. The panchnama of the<br \/>\nclothes put on by the victim was prepared in the presence of panch<br \/>\nwitness and statements of prosecutrix and other witnesses were<br \/>\nrecorded and on completion of the investigation, charge-sheet was<br \/>\nfiled in the Court of learned JMFC, Modasa. Thereafter, as the case<br \/>\nwas exclusively triable by the Court of Sessions, the learned<br \/>\nMagistrate has committed the case to the Court of Sessions, which was<br \/>\ngiven number as Sessions Case No. 63\/2006.\n<\/p>\n<p>5.\tThereafter,<br \/>\nthe charge was framed at Ex. 4 against the appellant. The appellant<br \/>\naccused has pleaded not guilty and claimed to be tried.\n<\/p>\n<p>6.\tIn<br \/>\norder to bring the home the charge levelled against the appellant-<br \/>\naccused, the prosecution has examined the witnesses and also produced<br \/>\ndocumentary evidence before the trial Court.\n<\/p>\n<p>7.\tThereafter,<br \/>\nafter examining the witnesses, further statement of the<br \/>\nappellant-accused under sec. 313 of CrPC was recorded in which the<br \/>\nappellant-accused has denied the case of the prosecution.\n<\/p>\n<p>8.\tAfter<br \/>\nconsidering the oral as well as documentary evidence and after<br \/>\nhearing the parties, learned Judge vide impugned judgment and order<br \/>\ndated 21.11.2006 held the appellant   accused guilty to the charge<br \/>\nlevelled against him under sec. 363, 366, 376, 323, 504, 506(2) and<br \/>\n114 of IPC  and convicted and sentenced the appellant accused, as<br \/>\nstated above.\n<\/p>\n<p>9.\tBeing<br \/>\naggrieved by and dissatisfied with the impugned judgment and order of<br \/>\nconviction and sentence passed by the learned Addl. Sessions Judge,<br \/>\nFTC No. 7, camp at Modasa, the present appellant has preferred this<br \/>\nappeal.\n<\/p>\n<p>10.\tHeard<br \/>\nMr. MR Prajapati learned advocate for the appellant and Mr HH Parikh<br \/>\nlearned APP for the respondent-State.\n<\/p>\n<p>11.\tMr<br \/>\nMR Prajapati learned advocate appearing for the appellant has fairly<br \/>\nadmitted that he is only arguing the matter on the point of quantum<br \/>\nof punishment and not arguing the matter on merits. He has also<br \/>\ncontended that no doubt the age of the prosecutrix was only 13 years<br \/>\nat the time of incident and the prosecution has also proved its case<br \/>\nbeyond reasonable doubt, however, he request this Court to reduce the<br \/>\nsentence because the present appellant is suffering from HIV (AIDS)<br \/>\nand TB, so that he can pass last days of his life at home. He has<br \/>\nfurther submitted with folded hands that the wife of the present<br \/>\nappellant is also suffering from HIV (AIDS) and therefore, he is<br \/>\narguing the matter on only the quantum of punishment only on the<br \/>\nground of mercy.\n<\/p>\n<p>12.\tNo<br \/>\ndoubt, the learned APP Mr Parikh has opposed this appeal and produced<br \/>\nthe jail remarks and contended that the appellant had undergone the<br \/>\nsentence of 4 years and two months. Mr Parikh learned APP has further<br \/>\ncontended that looking to the age of the prosecutrix, this appeal<br \/>\nrequires to be dismissed.\n<\/p>\n<p>13.\tI<br \/>\nhave gone through the oral as well as documentary evidence produced<br \/>\non the record. I have read the oral evidence of prosecution<br \/>\nwitness-complainant and also perused the charge framed against the<br \/>\nappellant.  It is true that the present appellant is patient of HIV<br \/>\n(AIDS) and TB and has also taken treatment from the Jail and the<br \/>\npapers of medical treatment are produced through jail. It appears<br \/>\nfrom the oral evidence of prosecution witnesses as well as medical<br \/>\nevidence, it is not necessary to observe that the same are required<br \/>\nto be considered on merits because the learned advocate for the<br \/>\nappellant is not arguing the matter on merits but  simply on the<br \/>\nmercy ground he has prayed this Court to reduce the sentence, which<br \/>\nis required to be considered in the interest of justice. It is to be<br \/>\nnoted that so far as the religious belief is concerned, it is true<br \/>\nthat every sin fastened to the neck of the person.  The present<br \/>\nappellant has committed the offence under sec. 376 of IPC with minor<br \/>\ngirl aged only 13 years, and now the appellant is a patient of HIV<br \/>\nand TB, not only that, his wife is also suffering from HIV. No doubt,<br \/>\nthe present appellant is convicted by the trial court and also by the<br \/>\nnature. In that view of the matter, the sentence requires to be<br \/>\nreduced in the interest of justice.\n<\/p>\n<p>16.\tIn<br \/>\nthe result, this appeal is partly allowed.. The impugned judgment and<br \/>\norder of conviction passed by the learned Addl. Sessions Judge, camp<br \/>\nat Modasa in Sessions Case No. 63\/2006 is hereby confirmed. However,<br \/>\nthe order of sentence sentencing the appellant-accused to undergo R\/I<br \/>\nfor 7 years for the offence under sec. 376 of IPC is hereby reduced<br \/>\nto the extent that instead the appellant-accused is hereby sentenced<br \/>\nto undergo  R\/I for 5 ? years. Rest of the impugned judgment and<br \/>\norder of conviction and sentence is confirmed.
