No. 3427 OF 2007 C\n              ````````````````````````````````````````````````````\n            Dated this the 20th day of November, 2007\n\n                                O R D E R\n<\/pre>\n<p>           In this revision filed by the 1st accused in<\/p>\n<p>C.C.No.1058\/99 on the file of JFCM, Changanacherry for<\/p>\n<p>offences punishable under sections 420 and 120B read with<\/p>\n<p>section 34 IPC, challenges the conviction entered and the<\/p>\n<p>sentence    passed       against        him      by     the      courts below<\/p>\n<p>concurrently for the offence punishable under section 420<\/p>\n<p>IPC.\n<\/p>\n<p>     2.    Pending this revision, the revision petitioner has<\/p>\n<p>compounded the offence with the persons who have been<\/p>\n<p>cheated including the de facto complainant totalling to seven.<\/p>\n<p>Those persons are<\/p>\n<p>     (i)   C.B.Sreekumar;\n<\/p>\n<p>     (ii)  James Mathew;\n<\/p>\n<p>     (iii) A.S.Subair;\n<\/p>\n<p>     (iv) A.S.Gopi;\n<\/p>\n<p>     (v)   V.S.Jacob;\n<\/p>\n<p>Crl.R.P.No.3427\/07<br \/>\n<span class=\"hidden_text\">                              : 2 :<\/span><\/p>\n<p>      (vi) Binu K. Mathew and<\/p>\n<p>      (vii) Santhosh Philip.\n<\/p>\n<p>      Crl.M.A.No.12194\/07 is a petition filed by the revision<\/p>\n<p>petitioner and signed by C.B.Sreekumar, James Mathew,<\/p>\n<p>A.S.Subair, A.S.Gopi and V.S.Jacob mentioned above<\/p>\n<p>requesting to accept the composition and acquit the accused<\/p>\n<p>as against those five persons. Crl.M.A.12195\/07 is a similar<\/p>\n<p>petition filed by the revision petitioner and Binu K. Mathew,<\/p>\n<p>the    de    facto complainant,    requesting   to record   the<\/p>\n<p>composition as against the de facto complainant(Binu K.<\/p>\n<p>Mathew)        and  to    acquit    the    revision  petitioner.<\/p>\n<p>Crl.M.A.12196\/07 is a petition filed by the revision petitioner<\/p>\n<p>and Santhosh Philip referred to above seeking to record the<\/p>\n<p>composition and acquit the revision petitioner as against the<\/p>\n<p>said person. Crl.M.A.12201\/07 is an application filed by the<\/p>\n<p>revision petitioner for permission to compound the offence.<\/p>\n<p>The above applications are allowed and the composition<\/p>\n<p>entered into between the revision petitioner and the aforesaid<\/p>\n<p>seven persons is recorded. This will have the effect of an<\/p>\n<p>Crl.R.P.No.3427\/07<br \/>\n<span class=\"hidden_text\">                            : 3 :<\/span><\/p>\n<p>acquittal of the revision petitioner under section 320(8)<\/p>\n<p>Cr.P.C. of the offence punishable under section 420 IPC.<\/p>\n<p>Crl.M.A.12197\/07 filed for impleading the aforementioned<\/p>\n<p>seven persons, who were cheated, is dismissed as<\/p>\n<p>unnecessary.\n<\/p>\n<p>      This Crl.R.P. is disposed of as above recording the<\/p>\n<p>composition.\n<\/p>\n<\/p>\n<p>                                    (V.
