SANKARAN, J.\n                    ---------------------------\n                     B.A. No. 3275 of 2009\n                ------------------------------------\n              Dated this the 18th day of June, 2009\n\n                            O R D E R\n<\/pre>\n<p>       This is an application for bail under Section 439 of the<\/p>\n<p>Code of Criminal procedure. The petitioner is accused No.2 in<\/p>\n<p>Crime No. 13\/2009 of Vaikom Excise Range.<\/p>\n<p>       2. The offences alleged against the petitioner are under<\/p>\n<p>Sections 55(b),(g) and 58 of the Abkari Act.<\/p>\n<p>       3. The prosecution case is that on 30\/5\/2009, the accused<\/p>\n<p>persons were found in possession of 2 litres of arrack and<\/p>\n<p>equipments for the manufacture of arrack. The petitioner was<\/p>\n<p>arrested on 30\/5\/2009.\n<\/p>\n<p>       4. Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioner, the nature of the offence and the present stage of<\/p>\n<p>investigation, I am of the view that bail can be granted to the<\/p>\n<p>petitioner.\n<\/p>\n<p>       5. The petitioner shall be released on bail on his executing<\/p>\n<p>bond for Rs.25,000\/- with two solvent sureties each for the like<\/p>\n<p>amount to the satisfaction of the Judicial Magistrate of the First<\/p>\n<p>B.A. No. 3275 \/2009<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>Class, Vaikom subject to the following conditions:-<\/p>\n<blockquote><p>               A)   The petitioner shall report before the<br \/>\n                   Investigating Officer between 9 A.M. and<br \/>\n                   11 A.M. on all Mondays, till the final report<br \/>\n                   is filed or until further orders.\n<\/p><\/blockquote>\n<blockquote><p>               B)  The petitioner shall      appear before the<br \/>\n                   Investigating Officer for interrogation as<br \/>\n                   and when required.\n<\/p><\/blockquote>\n<blockquote><p>               C) The petitioner shall not try to influence the<br \/>\n                   prosecution witnesses or tamper with the<br \/>\n                   evidence.\n<\/p><\/blockquote>\n<blockquote><p>               D) The petitioner shall not commit any offence<br \/>\n                   or indulge in any prejudicial activity while<br \/>\n                   on bail.\n<\/p><\/blockquote>\n<blockquote><p>               E)  In case of breach of any of the conditions<br \/>\n                   mentioned above, the bail shall be liable<br \/>\n                   to be cancelled.\n<\/p><\/blockquote>\n<blockquote><p>        The Bail Application is allowed as above.<\/p><\/blockquote>\n<p>                                      K.T.
