HARI RANI,JJ\n\n         ==============================\n\n                  W.P.(C)NO. 20378 OF 2008\n\n           ============================\n\n           DATED THIS THE 31st DAY OF JULY 2008\n\n                           JUDGMENT\n<\/pre>\n<p>Balakrishnan Nair,J.\n<\/p>\n<p>      The petitioners 1 and 2 are husband and wife. The third<\/p>\n<p>petitioner is their son.     The first petitioner is a retired<\/p>\n<p>Headmaster and they were leading a peaceful life. The third<\/p>\n<p>petitioner owns five cents of land comprised in Survey No.917\/1<\/p>\n<p>of K.D.H.Village in Devikulam Taluk.   He has constructed     a<\/p>\n<p>building there. The first respondent owns an adjacent plot of<\/p>\n<p>land having an extent of five cents in the very same survey<\/p>\n<p>number. He was residing there in the building constructed by<\/p>\n<p>him. Recently he started construction of a separate building in<\/p>\n<p>his remaining land at the eastern side between the buildings<\/p>\n<p>belonging to him and the third petitioner. It is submitted that<\/p>\n<p>the construction   is made abutting the boundary of the third<\/p>\n<p>petitioner.   To prevent any legal action from the part of the<\/p>\n<p><span class=\"hidden_text\">WPC. 20378\/2008                  -2-<\/span><\/p>\n<p>petitioners against construction, the first respondent moved the<\/p>\n<p>civil court and obtained an ex parte order of status quo. On the<\/p>\n<p>strength of the status quo order, the first respondent proceeded<\/p>\n<p>with the construction.       On    the motion made by the third<\/p>\n<p>petitioner, the civil court in the suit filed by the first respondent<\/p>\n<p>appointed a commissioner to inspect the property and file a<\/p>\n<p>report. When the commissioner visited the property, the party<\/p>\n<p>respondents herein caused obstruction and manhandled             the<\/p>\n<p>petitioners. They have filed a complaint before the police. The<\/p>\n<p>police, strangely,    have registered a crime on the basis of the<\/p>\n<p>information lodged by the party respondents against the<\/p>\n<p>petitioners. The complaint filed by the petitioners has been taken<\/p>\n<p>as the basis for registering a counter case against the party<\/p>\n<p>respondents.\n<\/p>\n<p>       2. The petitioners apprehend threat to their life from the<\/p>\n<p>part of the party respondents. So, they have filed a petition<\/p>\n<p>before the police. Alleging that the police did not take any<\/p>\n<p>effective action, this writ petition is filed seeking appropriate<\/p>\n<p>reliefs.   The petitioners also have a case that there was<\/p>\n<p><span class=\"hidden_text\">WPC. 20378\/2008                  -3-<\/span><\/p>\n<p>subsequent attack on them by the party respondents. The party<\/p>\n<p>respondents have also come to the shop run by the petitioners<\/p>\n<p>and created problem there. The girl working in that shop was<\/p>\n<p>also threatened, it is alleged.\n<\/p>\n<p>     3. Respondents 1 to 6 have filed a counter affidavit denying<\/p>\n<p>the allegations against them. They pointed out that based on<\/p>\n<p>the information lodged by them, a crime has been registered<\/p>\n<p>against the petitioners.\n<\/p>\n<p>     4. The police have filed a statement as directed by this<\/p>\n<p>Court in which it is stated that the petitioners have closed a<\/p>\n<p>pathway, which was being used by the general public. The same<\/p>\n<p>is the root cause of the problem.      The petitioners, in answer,<\/p>\n<p>would submit that the allegations        made against them are<\/p>\n<p>unfounded and the crime registered against them is also based<\/p>\n<p>on false information. This will be evident from the statement in<\/p>\n<p>the crime registered against them. As per the F.I. statement it<\/p>\n<p>was the petitioners who attacked the party respondents. But in<\/p>\n<p>the counter affidavit it is stated that musclemen were employed<\/p>\n<p>by the petitioners to attack the party respondents.<\/p>\n<p><span class=\"hidden_text\">WPC. 20378\/2008                  -4-<\/span><\/p>\n<p>        We heard the learned counsel on both sides. Having<\/p>\n<p>regard to the nature of the allegations and counter allegations,<\/p>\n<p>we feel that the petitioners have to move the competent civil<\/p>\n<p>court or    the criminal court to redress their grievance.      But<\/p>\n<p>needless to say, if any information regarding cognizable offence<\/p>\n<p>is reported, the police shall take appropriate action in accordance<\/p>\n<p>with law.
