Pleader for<br \/>\n\trespondent Nos.1,2 and 3 and Mr.Patel for respondent No.4.\n<\/p>\n<p>Upon<br \/>\n\thearing the  learned advocate appearing for both the  sides, it<br \/>\n\tappears that the  grievance on the  part of the  petitioner is that<br \/>\n\tthe after the  inquiry report was submitted in the  year 2002 and<br \/>\n\tthe  recommendation made for initiation of the  action under Section<br \/>\n\t50 of the  Act, no action is taken by the  competent authority after<br \/>\n\tfollowing the  procedure in accordance with law and therefore, the<br \/>\n\tpresent petition.\n<\/p>\n<p>Whereas,<br \/>\n\tMr. Jani, learned Govt. Pleader has not been able to show as to<br \/>\n\twhether any action is taken or not. However, he contended that if<br \/>\n\tthe direction is issued by this Court, the  matter will be examined<br \/>\n\tby the  competent authority.\n<\/p>\n<p>Mr.Patel,<br \/>\n\tlearned counsel appearing for respondent No.4 contended that the<br \/>\n\tpetition is with malafide purpose on account of the  ensuing<br \/>\n\telection, which is scheduled to be held on 25.02.2010, therefore,<br \/>\n\tthere is no bonafide purpose. He submitted that if the  direction is<br \/>\n\tgiven to the  authority to look into the matter, the  respondent<br \/>\n\tNo.4 has no objection, but it should not be made as a basis for<br \/>\n\tdisqualifying the  respondent No.4 to contest the  election. He<br \/>\n\tsubmitted that in certain market committee, based on such report,<br \/>\n\tthe nomination forms have been rejected, therefore, if such an<br \/>\n\taction is taken, the malafide intention of the petitioner would be<br \/>\n\tsatisfied and it would further cause injury to the  respondent No.4,<br \/>\n\twhich may not be compensated, if subsequently as an outcome of the<br \/>\n\tfurther action, the  Director decides not to take any action under<br \/>\n\tSection 50 of the  Act. He therefore, submitted that the  said<br \/>\n\taspects may be considered by the  Court.\n<\/p>\n<p>Mr.Jani,<br \/>\n\tlearned Govt. Pleader as well as the learned counsel for the<br \/>\n\tpetitioner submitted that the  said apprehension is ill-founded<br \/>\n\tinasmuch as even if the  report is to be taken into consideration<br \/>\n\tbefore any action is taken under Section 50 of the  Act, the  notice<br \/>\n\twill be required to be issued and thereafter, the opportunity will<br \/>\n\tbe given and then only the final decision can be taken. They<br \/>\n\tsubmitted that the  contention raised for rejection of the<br \/>\n\tnomination paper by way of apprehension is on hypothesis and uptil<br \/>\n\tnow, no action is taken so far as the  respondent No.4 is concerned,<br \/>\n\ttherefore, they submitted that the  said aspects may be considered<br \/>\n\tby this Court.\n<\/p>\n<p>It<br \/>\n\tdoes appear that the  petition is essentially for activation of the<br \/>\n\tGovernment authority for not taking any action after the  inquiry<br \/>\n\treport which was submitted as back as in the  year 2002. Therefore,<br \/>\n\tit would be required for the Director, respondent No.2 herein to<br \/>\n\texamine the matter in accordance with law and thereafter, to take<br \/>\n\taction by taking decision in either way as to whether the<br \/>\n\tproceedings under section 50 of the  Act should be initiated or not.<br \/>\n\tIt is hardly required to be stated that while exercising such power<br \/>\n\tunder section 50, the procedure in accordance with law would be<br \/>\n\trequired to be followed by him. Such should be completed within<br \/>\n\treasonable time and keeping in view the  aspect that the  report was<br \/>\n\tsubmitted as back as in the  year 2002, and the  petitioner has also<br \/>\n\tnot made grievance against the  same uptil now, it would be just and<br \/>\n\tproper to issue directions to the  respondent No.2 to take<br \/>\n\tappropriate decision for taking action preferably within a period of<br \/>\n\t3 months from the  receipt of the  order of this Court. Ordered<br \/>\n\taccordingly.\n<\/p>\n<p>So<br \/>\n\tfar as the  apprehension voiced by the  learned counsel for the<br \/>\n\trespondent No.4 is concerned, for rejection of the  nomination form,<br \/>\n\tuptil now, no such contingency has arisen, therefore, the  same can<br \/>\n\tonly be said as on apprehension and hypothesis. Hence, no view<br \/>\n\tdeserves to be expressed on the  said aspects. Suffice it to observe<br \/>\n\tthat if such action is taken, the  rights and contentions of both<br \/>\n\tthe  sides shall remain open.\n<\/p>\n<p>Disposed<br \/>\n\tof accordingly.
