that on 11.10.2002 at about 8.30 p.m. Kempannag<\/p>\n
was crossing the road near Doddapyiag\ufb01rky*;0.<\/p>\n
gate, when the respondentfcorporation. baa<\/p>\n
bearing No.AP 10 Z 9762 was driven in”a rash I<\/p>\n
and negligent manner and dashed against ni\u00a7;
\nas a result he sustained griewous ihjtries and
\ndied in the   legal
\nrepresentatives filed eia\ufb01m Qetitioh seeking
\ncompensation~on1\u00a7arie\ufb01%’head\ufb011hrwJ<\/p>\n

\nTribunai, ;’thed1:respondeht appeared and
\ncontested the m3t\u00a3\u00e9\u00a7;k\u00a7d0<\/p>\n

iciaimants examined PW1 and got marked Ex.P1 to<\/p>\n
V P10.\ufb01hi1e the respondent let in the evidence
\nifpvo\ufb01 RW1 and got marked Ex.R1. On the basis of
\np\ufb02then’S\u00a7id evidence, the Tribunal awarded
\n47;\ufb02eo\ufb01pensation of Rs.3,59,400\/– with interest at<\/p>\n

6. We have heard the learned s\u00e9\ufb01aseifs\u00e9r<\/p>\n
the appellants and the learned counsel \u00a30; the.l*<\/p>\n
respondentwcorporation.\n<\/p>\n
7. It is contended ton” be;\u00a2\u00a7’1g..,.V,9\u00a33 the<\/p>\n
appellants that\ufb01 the pdecga\u00a7eqw.gas pan Arrack
\nvendor and that’he_Qas earning an income of
\nRs.500\/* per dayg””\u00e9ut the frihnnal has failed
\nto appreciaaggthersaidlguidence and instead
\ntoo\ufb01 the inccpe of the \u00e9g\u00e9eased at Rs.80\/* per
\nday} which is verf much on the lower side and
\nhence the a\ufb01ard has to be enhanced on the head<\/p>\n
of loss of dependency as well as on the other<\/p>\n
H8?E_@Per contra, counsel for the<\/p>\n
Corporation submits that in the instant case,<\/p>\n
iv, multiplier applied was 17, whereas as per the
\nailatest decision of the Apex Court, multiplier<\/p>\n
“of 16 has to be applied and that the Tribunal<\/p>\n
was justified in taking Rs.80\/- per day as the<\/p>\n
income of the deceased and hence the Judgment<\/p>\n
\u00a3<\/p>\n

and award does not call for any interference<\/p>\n

\nevident that though the appellants contended
\nthat the deceased   sum of
\nRs.500\/– per\u00bbdap:as*anrhrrachhnendor, in the
\nabsence cor Vtherel being _g\u00a7\u00a7 corroborative<\/p>\n
