M. SAHAI)<\/a><\/p>\n<p>1.\t\tWe<br \/>\nhave heard  Mr R.C. Kakkad, learned  counsel  for the appellants and<br \/>\nMr T R Mishra, learned counsel appearing for the respondent.\n<\/p>\n<p>2.\t\tWith<br \/>\nthe consent of the counsel for the parties, we have taken this appeal<br \/>\nfor final disposal.\n<\/p>\n<p>3.\t\tThis<br \/>\nappeal has been filed by the appellant challenging the order dated<br \/>\n28.07.2010 passed by the learned Single Judge in Civil Application<br \/>\nNo. 6589 of 2010 by which the learned Single Judge has directed that<br \/>\nduring the pendency of the appeal, the respondent be paid regular<br \/>\nwages with effect from 1.8.2010 and arrears of wages as prayed by him<br \/>\nin prayer clause  3(B) and allowed the application in terms of para<br \/>\n3 (A) and 3 (B).\n<\/p>\n<p>4.\t\tIt<br \/>\nis not  disputed that the Special Civil Application is still pending<br \/>\nchallenging the award.  During the pendency of the petition, by the<br \/>\nimpugned order, the learned Single Judge has granted interim relief<br \/>\nto the petitioner which could have been granted only as a final<br \/>\nrelief.  Further, the respondents have complied with the provisions<br \/>\nof 17(B) of the Industrial Disputes Act, 1947 and had reinstated the<br \/>\nrespondent and are paying him last pay drawn by him.  In this view<br \/>\nof the matter, since by way of interim relief,  final relief has been<br \/>\ngranted, the impugned order cannot be maintained.\n<\/p>\n<p>5.\t\tIn<br \/>\nthe result,  this appeal succeeds and is allowed.  The order dated<br \/>\n28.7.2010 passed by the learned Single Judge  is quashed and set<br \/>\naside.  We request the learned Single Judge to decide the Special<br \/>\nCivil Application No. 11288 of 2008 at the earliest subject to His<br \/>\nLordship&#8217;s convenience.\n<\/p>\n<p>\t\t\t\t\t\t\t[V.\n<\/p>\n<p>M.
