He read the order passed by the<br \/>\ntrial Court and prayed to release the applicant on regular bail.\n<\/p>\n<p>5.\tAs<br \/>\nagainst this, learned APP Mr. Nanavati has strongly opposed this<br \/>\napplication and read the order passed by the trial Court.\n<\/p>\n<p>6.\tI<br \/>\nhave gone through the order passed by the trial Court as well as the<br \/>\npapers produced on record of the case. Looking to the allegations<br \/>\nlevelled against the applicant, I am inclined to release him on<br \/>\nregular bail.\n<\/p>\n<p>7.\tLearned<br \/>\nadvocates for the parties do not press for reasoned order.\n<\/p>\n<p>8.\tConsidering<br \/>\nthe submissions made on behalf of the parties and having regard to<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be released on bail in connection<br \/>\nwith CR No.I-156 of 2008 registered at Bhavnagar City ?SD??<br \/>\nDivision Police Station for the offences alleged against him in this<br \/>\napplication on his executing a bond in sum of Rs.10,000\/- (Rupees Ten<br \/>\nthousand only) with one solvent surety of the like amount to the<br \/>\nsatisfaction of the lower Court and subject to the conditions that he<br \/>\nshall,<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>(b)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>(c)\tnot<br \/>\nleave the local limits of State of Gujarat without the prior<br \/>\npermission of the concerned Sessions Judge;\n<\/p>\n<p>(d)\tmark<br \/>\npresence before the concerned police station on the last day of every<br \/>\nmonth between 11.00 a.m. and 5.00 p.m. <\/p>\n<p>(e)\tfurnish<br \/>\nthe address of his residence to the I.O. and also to the Court at the<br \/>\ntime of execution of the bond and shall not change the residence<br \/>\nwithout prior permission of this Court;\n<\/p>\n<p>(f)\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week.\n<\/p>\n<p>9.\tThe<br \/>\nauthorities will release the applicant only if he is not required in<br \/>\nconnection  with any other offence for the time being.\n<\/p>\n<p>10.\tIf<br \/>\nbreach of any of the above conditions is committed, the concerned<br \/>\nSessions Judge will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>11.\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>12.\tAt<br \/>\nthe trial, the trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>13.\tRule<br \/>\nis made absolute to the aforesaid extent.
