LTD. - Petitioner\n \n\nVersus\n \n\nGURUKRUPA\nCOLD STORAGE &amp; 4 - Respondents\n \n\n=================================== \nAppearance\n: \nMS\nLILU K BHAYA for Petitioner. \nMR SN THAKKAR for Respondent No. 1.\n \nRULE SERVED for Respondent Nos.2, 2.1 &amp; 2.2 &amp; 4. \nDELETED\nfor Respondent Nos.3, 5. \n===================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE K.A.PUJ\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 03\/03\/2010 \nORAL JUDGMENT<\/pre>\n<p>The<br \/>\n\tpetitioner   Electricity Company has filed this petition under<br \/>\n\tArticle 226 &amp; 227 of the Constitution of India challenging the<br \/>\n\torder passed by the learned Joint Civil Judge (S.D.), Nadiad dated<br \/>\n\t02.12.2000 below an application Exh.99 in Special Civil Suit No.145<br \/>\n\tof 1994.\n<\/p>\n<p>This<br \/>\n\tCourt has issued rule on 08.09.2004 and interim relief was granted<br \/>\n\twhereby the impugned order of the learned Civil Judge was stayed.\n<\/p>\n<p>It<br \/>\n\tis the case of the petitioner that the petitioner filed Special<br \/>\n\tCivil Suit No.145 of 1994 in the Court of learned Civil Judge (S.D.)<br \/>\n\tat Anand against the respondents for recovery of Rs.6,10,427.48 on<br \/>\n\tthe ground that the respondents had committed theft of electrical<br \/>\n\tenergy.  The respondents resisted the suit of the petitioner.  The<br \/>\n\trespondents with a view to prolong the matter gave application<br \/>\n\tExh.99 in the said suit and prayed that the matter be referred to<br \/>\n\tthe Appellate Committee in as much as the respondents wanted to<br \/>\n\tapproach the Appellate Committee.  The learned Civil Judge passed<br \/>\n\tthe order dated 02.12.2000 below application Exh.99 in Special Civil<br \/>\n\tSuit No.145 of 1994 to the effect that the respondents should put up<br \/>\n\ttheir case before the Appellate Committee within 20 days from the<br \/>\n\tdate of the said order.\n<\/p>\n<p>It<br \/>\n\tis this order which is under challenge in the present petition.\n<\/p>\n<p>Ms.\n<\/p>\n<p>\tLilu K. Bhaya, learned advocate appearing for the petitioner has<br \/>\n\tsubmitted that earlier, the respondent has filed Civil Suit No.181<br \/>\n\tof 1992 wherein order was obtained for approaching the Appellate<br \/>\n\tCommittee way back on 22.05.1992. Though the appellant had paid 30%<br \/>\n\tof the bill amount, the appellant did not approach the Appellate<br \/>\n\tCommittee.  Despite an injunction order obtained from the trial<br \/>\n\tCourt, the respondents had not approached the Appellate Committee<br \/>\n\tand when the petitioner has filed the suit, in that suit, an<br \/>\n\tapplication was given seeking permission to approach the Appellate<br \/>\n\tCommittee which was granted.  She has, therefore, submitted that the<br \/>\n\timpugned order is absolutely unjust, improper and is not tenable in<br \/>\n\tthe eye of law.  The respondents had made similar request in the<br \/>\n\tearlier suit and the permission granted by the Court was not acted<br \/>\n\tupon by the respondents.  Hence, there is no question of granting<br \/>\n\tagain permission in the pending suit filed by the respondents.  She<br \/>\n\thas, therefore, submitted that the impugned order is required to be<br \/>\n\tquashed and set aside.\n<\/p>\n<p>Though<br \/>\n\tthe petition was admitted way back in 2004, no affidavit-in-reply is<br \/>\n\tfiled on behalf of the respondents.\n<\/p>\n<p>The<br \/>\n\tfact regarding the order passed by the Court in the earlier suit<br \/>\n\tgranting permission to the respondents to approach the Appellate<br \/>\n\tCommittee and the respondents had not approached the Appellate<br \/>\n\tCommittee has not been disputed.  The Trial Court is, therefore, not<br \/>\n\tjustified in passing the order in the pending suit filed by the<br \/>\n\tpetitioner especially when the respondent has failed to avail the<br \/>\n\topportunity which was given to him earlier.\n<\/p>\n<p>In<br \/>\n\tthe above view of the matter, the impugned order passed by the Trial<br \/>\n\tCourt is not just and proper.  It cannot stand in the eye of law.<br \/>\n\tHence, the impugned order is quashed and set aside and the petition<br \/>\n\tis accordingly allowed.
