Justice P.R.RAMACHANDRA MENON\n\n Dated :16\/02\/2009\n\n O R D E R\n             P.R.RAMACHANDRA MENON, J.\n            ======================\n                  W.P.(C) No.29827 of 2005\n            ======================\n         Dated, this the 16th day of February, 2009\n                       J U D G M E N T\n<\/pre>\n<p>          This writ petition was filed by the petitioner for a<\/p>\n<p>direction declaring that he is entitled to join duty in the<\/p>\n<p>Cochin Port Trust as Fireman pursuant to Exhibit P1 order<\/p>\n<p>of appointment and for consequential relief.<\/p>\n<p>     2.   The learned counsel for the additional fifth<\/p>\n<p>respondent points out that the appointment of the petitioner<\/p>\n<p>was subjected to challenge stating that the petitioner was<\/p>\n<p>not actually entitled to be considered for the selection and<\/p>\n<p>appointment and that an industrial dispute had already<\/p>\n<p>been raised. It is further stated that the proceedings were<\/p>\n<p>initiated but on its failure, the matter was left there and was<\/p>\n<p>not subjected to challenge.\n<\/p>\n<\/p>\n<p>     3.   During the pendency of the writ petition, an<\/p>\n<p>interim order was passed by this Court, whereby the<\/p>\n<p>second and third respondents were directed to permit the<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.29827\/2005        -:2:-<\/span><\/p>\n<p>petitioner to join duty as Fireman provisionally. It is<\/p>\n<p>submitted that the petitioner promptly reported for duty on<\/p>\n<p>19-12-2005 and is continuing as such. The learned counsel<\/p>\n<p>appearing on either side have stated that the matter has<\/p>\n<p>become final and nothing survives in this writ petition to be<\/p>\n<p>adjudicated by this Court, but for making the interim order<\/p>\n<p>absolute.\n<\/p>\n<\/p>\n<p>            In the above circumstances, the direction given<\/p>\n<p>vide the interim order dated 16-12-2005 is made absolute<\/p>\n<p>and the writ petition is treated as closed.
