P.C. against the Judgment and order of acquittal dated<br \/>\n\t13.02.1998 passed by learned Chief Judicial Magistrate, Halol, in<br \/>\n\tCriminal Case No. 67 of 1984, whereby the respondents   accused<br \/>\n\thave been acquitted from the charges levelled against them.\n<\/p>\n<p>The<br \/>\n\tbrief facts of the prosecution case are that on 28.4.1981 the<br \/>\n\taccused   respondents with the help of each other have not paid<br \/>\n\tamount of Rs.5000\/- to the hutments which have been granted by the<br \/>\n\tGovernment for their benefit by preparing bogus record and<br \/>\n\tmisappropriate the amount and committed the breach of trust and<br \/>\n\tthereby they have committed the offence. Therefore, complaint for<br \/>\n\tthe offences under Sections 409, 468, 114 of I.P. Code has been<br \/>\n\tfiled against the accused   respondents.\n<\/p>\n<p>Thereafter,<br \/>\n\tthe trial was proceeded against the respondent   accused in the<br \/>\n\tCourt of learned Magistrate. To prove the case against the<br \/>\n\trespondent   accused, the prosecution has examined the witnesses<br \/>\n\tand also produced documentary evidence. And at the end of trial,<br \/>\n\tafter recording the statement of accused under Section 313 Cr.P.C.<br \/>\n\tand after hearing the parties, the learned Magistrate has acquitted<br \/>\n\tthe respondents   accused from the charges levelled against them,<br \/>\n\tvide judgment under challenge.\n<\/p>\n<p>Being<br \/>\n\taggrieved by and dissatisfied with the said Judgment and order<br \/>\n\tpassed by the learned Magistrate, the appellant   State has filed<br \/>\n\tpresent Appeal.\n<\/p>\n<p>Learned<br \/>\n\tAPP, appearing on behalf of the appellant, has contended that the<br \/>\n\tJudgment and order of trial Court is against the provisions of law.<br \/>\n\tThe trial Court has not properly appreciated the facts and evidence<br \/>\n\tled by the prosecution and looking to the provisions of law itself<br \/>\n\tit is clearly established that the prosecution has proved the whole<br \/>\n\tingredients of offence against the respondent. The learned APP has<br \/>\n\tcontended that the money was given for the purpose of utilisation<br \/>\n\tfor poor people which was utilized by the accused for their personal<br \/>\n\tbenefit and the confessional statement was made before the T.D.O.<br \/>\n\tLearned APP has also taken this Court through the oral as well as<br \/>\n\tdocumentary evidence.\n<\/p>\n<p>I<br \/>\n\thave perused the oral as well as documentary evidence. I have also<br \/>\n\tconsidered the submissions made by the learned Public Prosecutor as<br \/>\n\twell as the learned Advocate, appearing for the respondent<br \/>\n\taccused. Looking to the evidence of complainant it appears that the<br \/>\n\tcomplainant has no personal knowledge and from the inquiry report<br \/>\n\tcomplaint has been filed.\n<\/p>\n<p>I<br \/>\n\thave also gone through the Judgment and order passed by the trial<br \/>\n\tCourt and have also perused the oral as well as documentary evidence<br \/>\n\tproduced before me and also considered the submissions made by the<br \/>\n\tlearned Advocates. The trial Court has found that most of the<br \/>\n\twitnesses have not supported the case of prosecution. The trial<br \/>\n\tCourt has also observed that none of the witnesses have deposed that<br \/>\n\tpresent accused was entrusted and dominion over the property. The<br \/>\n\ttrial Corut has also found that there is not a single iota of<br \/>\n\tevidence to connect the accused with the alleged crime. On going<br \/>\n\tthrough the Judgment and order passed by the trial Court and the<br \/>\n\tpapers placed before me, I am of the opinion that the trial Court<br \/>\n\thas not committed any error in not believing the case of the<br \/>\n\tprosecution. I find that the findings recorded by the trial Court<br \/>\n\tare absolutely just and proper and in recording the said findings no<br \/>\n\tillegality or infirmity has been committed by it. The learned Judge<br \/>\n\thas rightly come to the conclusion that the prosecution has<br \/>\n\tmiserably failed to prove the case against the respondents<br \/>\n\taccused.\n<\/p>\n<p>Thus,<br \/>\n\tin my opinion, looking to the evidence on record, from the evidence<br \/>\n\titself it is it clearly established that the prosecution has not<br \/>\n\tproved its case beyond reasonable doubt.\n<\/p>\n<p>At<br \/>\n\tthe out-set it is required to be noted that the principles which<br \/>\n\twould govern and regulate the hearing of appeal by this Court<br \/>\n\tagainst an order of acquittal passed by the trial Court have been<br \/>\n\tvery succinctly explained by the Hon&#8217;ble Apex Court in catena of<br \/>\n\tdecisions. Thus, the powers which this Court may exercise against an<br \/>\n\torder of acquittal are well settled. Thus, in case the appellate<br \/>\n\tCourt agrees with the reasons and the findings given by the lower<br \/>\n\tCourt, then the discussion of evidence is not necessary.\n<\/p>\n<p>I<br \/>\n\tam, therefore, in complete agreement with the findings, ultimate<br \/>\n\tconclusion and the resultant order of acquittal recorded by the<br \/>\n\tCourt below and hence find no reason to interfere with the same.<br \/>\n\tHence, the Appeal is hereby dismissed.\n<\/p>\n<p>In<br \/>\n\tview of above the Appeal is dismissed. The Judgment and order dated<br \/>\n\t13.2.1998 passed by the learned Magistrate in Criminal Case No. 67<br \/>\n\tof 1984 is hereby confirmed.
