{"id":91124,"date":"2003-04-10T00:00:00","date_gmt":"2003-04-09T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/state-of-punjab-vs-harbans-singh-anr-on-10-april-2003"},"modified":"2017-04-03T19:10:40","modified_gmt":"2017-04-03T13:40:40","slug":"state-of-punjab-vs-harbans-singh-anr-on-10-april-2003","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/state-of-punjab-vs-harbans-singh-anr-on-10-april-2003","title":{"rendered":"State Of Punjab vs Harbans Singh &amp; Anr on 10 April, 2003"},"content":{"rendered":"<div class=\"docsource_main\">Supreme Court of India<\/div>\n<div class=\"doc_title\">State Of Punjab vs Harbans Singh &amp; Anr on 10 April, 2003<\/div>\n<div class=\"doc_author\">Author: S Hegde<\/div>\n<div class=\"doc_bench\">Bench: N.Santosh Hegde, B.P.Singh.<\/div>\n<pre>           CASE NO.:\nAppeal (crl.)  181-182 of 1996\n\nPETITIONER:\nState of Punjab\n\nRESPONDENT:\nHarbans Singh &amp; Anr.\n\nDATE OF JUDGMENT: 10\/04\/2003\n\nBENCH:\nN.Santosh Hegde &amp; B.P.Singh.\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t\t\tJ U D G M E N T<\/p>\n<p>SANTOSH HEGDE,J.\n<\/p>\n<p>State of Punjab has preferred these appeals against the<br \/>\njudgment of the High Court of Punjab and Haryana at Chandigarh<br \/>\ndated 13th July, 1994 made in Criminal Appeal No.206-DB of 1992<br \/>\nwhereby the High Court allowed the appeal filed by the<br \/>\nrespondents herein and set aside the judgment and conviction<br \/>\nimposed on the respondents by the Learned Sessions Judge,<br \/>\nBhatinda.\n<\/p>\n<p>The brief facts necessary for the disposal of these appeals<br \/>\nare as follows :\n<\/p>\n<p>The respondent Jit Singh in these cases was son of Chanan<br \/>\nSingh the deceased and the brother of Bhol Singh the other<br \/>\ndeceased who is also known as Gurbachan Singh. It is the<br \/>\nprosecution case that in view of certain misunderstanding arising<br \/>\nout of financial transaction respondent Jit Singh along with his<br \/>\nbrother-in-law Harbans Singh who is also respondent in these<br \/>\nappeals had decided to eliminate Chanan Singh and Bhol Singh.<br \/>\nWith this view in mind, it is stated that on 26th of September, 1990<br \/>\nthe respondents were in search of these two persons. Having come<br \/>\nto know of the motives of the respondents herein in searching for<br \/>\nthem, the said Chanan Singh and Bhol Singh went to the house of<br \/>\nPW-4 Natha Singh who happened to be the Lambardar of the<br \/>\nvillage and complained to him that the respondents herein were<br \/>\nsearching for them in the village with the intention of eliminating<br \/>\nthem, therefore, sought his help. The said PW-4 Natha Singh took<br \/>\nChanan Singh and Bhol Singh to the house of Gurnam Singh (PW-\n<\/p>\n<p>11) who was the Sarpanch of the village around 6.30 p.m. The said<br \/>\nSarpanch Gurnam Singh told these people that he will look into the<br \/>\nmatter and bring about a settlement the next day morning. Then<br \/>\nwhile coming out of the house of PW-4, Chanan Singh was<br \/>\nwalking ahead of Bhol Singh and immediately behind them were<br \/>\nPWs.4 and 11 who were following them near the gate of the house<br \/>\nof Gurnam Singh (PW-11). At that time it is stated that the<br \/>\nrespondents herein confronted them. The prosecution further<br \/>\nalleges that at that time respondent Jit Singh was carrying a DBBL<br \/>\ngun while respondent Harbans Singh was carrying Kassia. On<br \/>\nseeing, Chanan Singh the respondents herein raised lalkara that<br \/>\nthey would teach a lesson for making a demand for return of<br \/>\nmoney so saying the respondent Jit Singh aimed his DBBL gun at<br \/>\nChanan Singh and fired a shot which hit Chanan Singh on the right<br \/>\nside of his chest and he fell down. The respondent Jit Singh then<br \/>\nallegedly aimed at Bhol Singh who was standing behind Chanan<br \/>\nSingh but noticing the said attempt of Jit Singh, Bhol Singh laid<br \/>\ndown on the ground because of which the shot aimed at Bhol<br \/>\nSingh hit the wall of the house of PW-11. The further case of the<br \/>\nprosecution is that at the point of time, respondent Harbans Singh<br \/>\ncarrying the Kassia attacked Bhol Singh on the right back side of<br \/>\nhis head and continued to assault said Bhol Singh on the other<br \/>\nparts of the body like his chin, right ankle, left eye brow. After the<br \/>\nsaid attack, the prosecution alleges that both the accused persons<br \/>\nran away from the place.\n<\/p>\n<p>The prosecution also alleges that the incident in question<br \/>\nwas noticed by one Darshan Singh the other neighbour and after<br \/>\nthe accused ran away from the place of incident PWs. 4 and 11<br \/>\nalongwith Darshan Singh arranged for private vehicle and took the<br \/>\ninjured persons for Primary Health Centre which is about 1<br \/>\nKms. away from the place of incident and on the way it is stated<br \/>\nthat Chanan Singh succumbed to the injuries. At the Primary<br \/>\nHealth Centre, the doctor Randhir Singh (PW-1) attended to the<br \/>\ninjured Bhol Singh and sent a message to the Police Outpost which<br \/>\nis hardly one furlong away from the place of incident. He referred<br \/>\nBhol Singh to C.M.C Hospital, Ludhiana. But on the way, it is<br \/>\nstated that even Bhol Singh succumbed to his injuries.<br \/>\nIt is the prosecution case that after the completion of the<br \/>\ninvestigation, the respondents herein were put up for trial before<br \/>\nthe learned Sessions Judge, Bhatinda who accepting the evidence<br \/>\nof PWs. 4 and 11 as eye-witnesses and other supporting evidences<br \/>\nproduced by the prosecution convicted the appellants for offences<br \/>\npunishable under Section 302 as also under Section 302 read with<br \/>\nSection 34 IPC and sentenced them to undergo imprisonment for<br \/>\nlife. The respondent Jit Singh was also sentenced under Section 27<br \/>\nof the Arms Act to undergo RI for one year and a fine of Rs.1000\/-<br \/>\nwas imposed on each of the appellants for the murder of Chanan<br \/>\nSingh and Bhol Singh in default of payment to undergo RI for a<br \/>\nfurther period of one year.\n<\/p>\n<p>As stated above, the High Court has reversed the judgment<br \/>\nof the learned Sessions Judge and disagreed with the learned<br \/>\nSessions Judge that a conviction could be based on the evidence of<br \/>\nPWs.4 and 11 which the High Court thought was not safe to do so.<br \/>\nWhile doing so, the High Court came to the conclusion that the<br \/>\nevidence of PWs 4 and 11 cannot be believed primarily because of<br \/>\nthe fact that they are stock witnesses who on their own admission<br \/>\nhad been appearing for the prosecution in large number of cases<br \/>\nand against them there were criminal cases also. The High Court<br \/>\nalso came to the conclusion that these witnesses were closely<br \/>\nconnected with the deceased persons and belonged to the same<br \/>\npolitical faction while the respondents herein belonged to the<br \/>\nopposite faction. It also found discrepancies between the medical<br \/>\nevidence and the oral evidence and also held that the motive<br \/>\nprojected by the prosecution was very weak and from the narration<br \/>\nof the evidence of PWs.4  and 11 it is doubtful the incident had<br \/>\nactually taken place in the manner projected by the prosecution. It<br \/>\nis on this basis the High Court allowed the appeal.<br \/>\nShri Bimal Roy Jad, learned counsel appearing for the<br \/>\nappellant-State very strenuously contended that the High Court has<br \/>\nseriously erred in rejecting the evidence of PWs.4 and 11 on very<br \/>\nflimsy grounds. He contended that the fact that these witnesses<br \/>\nhave appeared for the prosecution in earlier cases is not so relevant<br \/>\nas to reject their evidence because they being holders of village<br \/>\noffice will, in the normal course, be called upon to be witnesses in<br \/>\ncriminal cases which is nothing unnatural. His further contention is<br \/>\nthat the High Court erroneously came to the conclusion that there<br \/>\nwas delay in sending certain special report to the Jurisdictional<br \/>\nMagistrate because the complaint in question was lodged only<br \/>\nabout 11.30 p.m. by PW-4 which reached the Jurisdictional<br \/>\nMagistrate at 7 a.m. next day and the distance between the Police<br \/>\nStation where FIR was lodged and the place of residence of<br \/>\nJurisdictional Magistrate was about 27 kms. and taking into<br \/>\nconsideration the law and order situation prevailing in Punjab at<br \/>\nthe relevant point of time there is nothing unusual in the time taken<br \/>\nby the police to send the special report. He also contended that the<br \/>\nHigh Court ought not to have interfered with the considered<br \/>\njudgment of the trial court merely because another view was<br \/>\npossible.\n<\/p>\n<p>Shri R.K.Talwar learned counsel appearing for the<br \/>\nrespondents per contra contended that the evidence of PWs.4 and<br \/>\n11 is so artificial that it cannot be accepted by any reasonable<br \/>\nperson. He contended that in view of the positioning of these two<br \/>\nwitnesses they could not have escaped the bullet injuries if they<br \/>\nwere really present at the time of incident. He contended even<br \/>\nthough there were independent witnesses like Darshan Singh and<br \/>\nother neighbours the prosecution for no good reasons has chosen<br \/>\nnot to examine them which also throws suspicion on the<br \/>\nprosecution case.\n<\/p>\n<p>We have heard learned counsel for the parties and perused<br \/>\nthe records. It is an admitted fact that PWs.4 and 11 and the<br \/>\nrespondents belonged to different political factions, therefore, they<br \/>\nwere not on friendly terms. There is also evidence to show that<br \/>\nPW-4 was closely connected with the deceased and he was also an<br \/>\nattestor to the pronote which, according to the prosecution, was the<br \/>\ncause of fight which led to the death of two persons. Though the<br \/>\nHigh Court has found the fact that PWs.4 and 11 have been<br \/>\nprosecution witnesses in many cases is ground to reject their<br \/>\nevidence, we do not think merely because some of the prosecution<br \/>\nwitnesses have appeared in large number of cases earlier for<br \/>\nprosecution, ipso facto their evidence becomes liable to be<br \/>\nrejected, but we think certainly such evidence will have to be<br \/>\nconsidered with great caution. If in this background, we examine<br \/>\nthe evidence of PWs.4 and 11, we notice that there is evidence to<br \/>\nshow PWs.4 and 11 are partisan witnesses with an antecedent of<br \/>\nappearing as frequent prosecution witnesses coupled with the fact<br \/>\nthat independent witnesses were not examined, this certainly<br \/>\nthrows considerable doubt on the veracity of their evidence.<br \/>\nIt is the prosecution case itself that Darshan Singh who was<br \/>\none of the witnesses to the incident who also helped PWs.4 and 11<br \/>\nto carry the injured to the hospital and remained with them almost<br \/>\nright through has not been examined by the prosecution. The<br \/>\nexplanation given is that he has been won over by the accused. But<br \/>\nthen it is also to be noted that there were many neighbours also<br \/>\nwho came to the place of incident but none of them have been<br \/>\nexamined as witnesses leaving only PWs 4 and 11 as the sole eye-<br \/>\nwitnesses in this case. Further it is to be noticed that these two<br \/>\nwitnesses along with Darshan Singh carried both the injured<br \/>\npersons in the vehicle and thereafter helped in carrying the injured<br \/>\npersons to the Primary Health Centre but no blood stained clothes<br \/>\nwere recovered from the possession of these witnesses which also<br \/>\nthrows considerable doubt about the presence of these witnesses at<br \/>\nthe time of incident. PW-11 though says that there was a little<br \/>\nblood stain on his cloth, he washed the same in the hospital which<br \/>\nexplanation, in our opinion, is highly artificial.<br \/>\nAs contended by the respondents, if the topography of the<br \/>\nplace of incident is examined in conjunction with the oral evidence<br \/>\nthen it shows that Chanan Singh, Bhol Singh and PWs 4 and 5<br \/>\nwere standing behind each other and even though Bhol Singh<br \/>\nescaped from the firing range of the DBBL gun of Jit singh by<br \/>\nfalling on the ground. PW-4 and 11 did not do any such thing to<br \/>\nevade the bullets, still they were not injured. This also causes<br \/>\ndoubt in our mind as to the presence of these witnesses at the place<br \/>\nof incident. There is also discrepancy between the oral evidence<br \/>\nand the medical evidence inasmuch as the injury on Chanan Singh<br \/>\nindicates that the bullets were discharged from very close range<br \/>\nfrom his body, while the prosecution evidence in this regard shows<br \/>\nthat the assailants were standing at a considerable distance away<br \/>\nfrom the deceased Chanan Singh. For all these reasons, we agree<br \/>\nwith the finding of the High Court.
