Rule.\n<\/p>\n<p>2. With the consent of the learned Counsel for the<br \/>\nparties, the petition is taken up for final disposal.\n<\/p>\n<p>3. The land owned by the petitioner was acquired in<br \/>\n1978-80 and on an application for alternative plot in<br \/>\nlieu of the acquisition, the case of the petitioner was<br \/>\nrecommended on 27\/11\/1987 for said allotment of<br \/>\nalternative plot in village Bhorgarh, Delhi of 250 sq.<br \/>\nyds. The allotment letter was issued by the DDA on<br \/>\n14\/1\/1993 allotting plot No. 11, Sector B-4, Pocket-4,<br \/>\nmeasuring 209 sq. metres in Narela Residential Scheme.<br \/>\nSince the petitioner failed to deposit the amount<br \/>\nwithin time, this allotment was cancelled but on<br \/>\nrepresentation of the petitioner, allotment was<br \/>\nrestored on 12\/3\/1997. The petitioner deposited the<br \/>\nfull amount on 8\/8\/1997 and submitted the requisite<br \/>\ndocuments on 11\/6\/1997. The possession was yet to be<br \/>\nhanded-over.\n<\/p>\n<p>4. A letter was received by the respondent on<br \/>\n11\/7\/1997 from one Dr. K.S. Solanki, stating that the<br \/>\nproperty had been sold by the petitioner on Power of<br \/>\nAttorney basis to him and requested that the property<br \/>\nshould be expeditiously transferred in favor of the<br \/>\npetitioner so that Dr. Solanki could enjoy the property.<br \/>\nThe respondent, taking cognizance of the said letter,<br \/>\nissued a show cause notice to the petitioner dated<br \/>\n1\/10\/1997, alleging that the petitioner had violated<br \/>\nClause 4(v) of the allotment letter while seeking<br \/>\nrestoration. The said clause is as under:-\n<\/p>\n<p>&#8220;If it is discovered at any stage that you<br \/>\nhave secured allotment by suppression of any<br \/>\nfact or any mis-statement, misrepresentation,<br \/>\nfraud or incorrect information the allotment<br \/>\nwill be considered to be void ab initio and<br \/>\nyou shall not be entitled to any compensation<br \/>\nwhatsoever, nor to the return of an premium<br \/>\npaid by you.&#8221;\n<\/p>\n<p>5. Simultaneously, the respondent also called upon<br \/>\nDr. Solanki to appear before the DDA. The petitioner<br \/>\nfiled reply dated 21\/10\/1997, refuting the allegations.<br \/>\nHowever, the petitioner did not appear personally<br \/>\nbefore the respondent, as stated by the respondent. It<br \/>\nmay be noted that the said Dr. Solanki never appeared<br \/>\nbefore the respondent despite repeated reminders.\n<\/p>\n<p>6. A final show cause notice dated 31\/7\/1998 was<br \/>\nsent to the petitioner, calling upon the petitioner to<br \/>\nattend the office of the respondent, failing which<br \/>\naction for cancellation of plot would be initiated. On<br \/>\n28\/9\/1998, the said Dr. Solanki stated that his disputes<br \/>\nwith the petitioner had been resolved and that he would<br \/>\nlike to withdraw the letter dated 11\/7\/1997. The<br \/>\nallotment in favor of the petitioner was cancelled on<br \/>\n7\/10\/1998.\n<\/p>\n<p>7. I have considered the submissions advanced by<br \/>\nlearned Counsel for the parties.\n<\/p>\n<p>8. It is not in dispute that after the restoration<br \/>\nof allotment of the petitioner, the petitioner<br \/>\ndeposited he amount and completed the necessary<br \/>\nformalities. The only reason why the plot of the<br \/>\npetitioner has been cancelled is the complaint sent by<br \/>\none Dr. Solanki. No documents have been filed along<br \/>\nwith the counter affidavit submitted by Dr. Solanki. It<br \/>\nappears that only letter dated 11\/7\/1997 has been acted<br \/>\nupon. In view of the subsequent letter dated 28\/8\/1998<br \/>\nDr. Solanki stated that disputes had been resolved but a<br \/>\nview has been taken that there is violation of the<br \/>\nterms of the compromise by the respondent.\n<\/p>\n<p>9. The clause sought to be relied in the terms of<br \/>\nallotment only requires that the allotment should not<br \/>\nbe procured by any mis-statement, mis-representation,<br \/>\nfraud or incorrect information. In my considered view,<br \/>\nno allotment has been sought by violation of any terms<br \/>\nof the allotment letter. In fact, the allotment was<br \/>\nmade in 1993 and was only restored in 1997. Further,<br \/>\nthe said Dr. Solanki never even came forthwith before<br \/>\nthe respondent to substantiate his allegations but on<br \/>\nthe other hand, withdrew even the said letter. In my<br \/>\nconsidered view, it would not be open to the respondent<br \/>\nto act merely on such a letter when the same has been<br \/>\nrefuted by the petitioner in writing and the complaint<br \/>\nhas also been subsequently withdrawn by Dr. Solanki.\n<\/p>\n<p>10. Interestingly, the complaint was only of alleged<br \/>\nsale of the plot on Power of Attorney basis and the<br \/>\nrespondent itself has recognised such sales and has<br \/>\nbeen converting properties into freehold at request of<br \/>\nsuch attorney holders.\n<\/p>\n<p>11. A writ of Mandamus is issued, quashing the order<br \/>\nof cancellation dated 7\/1\/1998. The respondent is<br \/>\ndirected to hand-over possession of the plot allotted<\/p>\n<p>to the petitioner within a period of three weeks from<br \/>\ntoday.\n<\/p>\n<p>12.
