Application No.10800\/2009 dated 22.09.2009, which reads as<br \/>\n\tunder :-\n<\/p>\n<p>&#8220;(g)\tsurrender<br \/>\ntheir passport, if any, to the lower Court, within a week.&#8221;\n<\/p>\n<p>\tLearned<br \/>\n\tcounsel for the applicant submitted that the applicant desires to<br \/>\n\tvisit Mecca-Madina and thereafter for Umra for pilgrimage and,<br \/>\n\ttherefore, the passport may be released subject to any condition. He<br \/>\n\tfurther submitted that the applicant has not flouted any condition<br \/>\n\tand he is businessman and, hence, he is not like to flee away.\n<\/p>\n<p>\tLearned<br \/>\n\tA.P.P., Mr.Jani resisted the present application. However, he fairly<br \/>\n\tsubmitted that no conditions have been violated.\n<\/p>\n<p>\tIn<br \/>\n\tview of the rival submissions and having perused the papers, the<br \/>\n\tpresent application deserves to be allowed.\n<\/p>\n<p>Accordingly,<br \/>\n\tthis application stands allowed. The Condition nos.6(g) imposed<br \/>\n\twhile releasing the applicant on bail as per the order passed in<br \/>\n\tCriminal Misc. Application No.10800\/2009 dated 22.09.2009 is<br \/>\n\tsuspended in order to enable him to visit Mecca-Madina and Umar for<br \/>\n\tpilgrimage. The trial court shall hand over the passport of the<br \/>\n\tapplicant on proper identification and on his submitting itinerary<br \/>\n\tand xerox copy of his passport, which shall be kept with the record.<br \/>\n\tThe applicant shall surrender his passport before the trial court on<br \/>\n\tor before 08th November, 2011. All other conditions will<br \/>\n\tremain unaltered.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.
