1.\tThis
\napplication is filed under Section 438 of the Code of Criminal
\nProcedure in connection with first information report registered at
\nCR No.I-22 of 2011 with Tankara Police Station for the offences
\npunishable under Sections 406, 420, 465, 467, 468, 471, 472 and 120B
\nof the Indian Penal Code.\n<\/p>\n
2.\tLearned
\ncounsel for the applicant submits that the applicant is an advocate
\nand a notary and it is alleged that an agreement which was drafted on
\na stamp paper of Rs.100\/- by one Chadrapal G.Khuman, Advocate, who
\nhad also identified the parties at the time of execution of the
\ndocuments in question and Civil Suit No.96 of 2010 is filed along
\nwith injunction application and considering the role attributed to
\nthe applicant along with the agreement affidavit dated 26.5.2010,
\nprima facie, reveal payment of Rs.27 lacs out of total consideration
\nof Rs.40.20,000\/- to the father of the complainant and the applicant
\nis a permanent resident, having root in the society and will be
\navailable for further investigation, by imposing suitable conditions
\nthe applicant may be granted anticipatory bail.\n<\/p>\n

\nLearned APP for the respondent – State.\n<\/p>\n
4.\tHaving
\nheard learned counsel for the parties and perusing the record of the
\ncase and taking into consideration the facts of the case,
\n   I am inclined to grant anticipatory bail to the applicant.  This
\nCourt has also taken into consideration the law laid down by the Apex
\nCourt in the case of Siddharam Satlingappa Mhetre v. State of
\nMaharashtra & Ors. Reported in [2011]1 SCC 694, wherein
\nthe Apex Court reiterated the law laid down by the Constitutional
\nBench in the case of Shri Gurubaksh Singh Sibbia & Ors.
\nReported in [1980]2 SCC 565.\n<\/p>\n
5.\tLearned
\ncounsel for the parties do not press for further reasoned order.\n<\/p>\n
6.\tIn
\nthe result, this application is allowed by directing that in the
\nevent of the applicant herein being arrested pursuant to FIR being CR
\nNo.I-22 of 2011 with Tankara Police Station,  the applicant shall be
\nreleased on bail on furnishing a bond of Rs.10,000\/- (Rupees Ten
\nThousand only) with one surety of like amount on following conditions
\n:-\n<\/p>\n
[a]\tshall
\ncooperate with the investigation and make himself available for
\ninterrogation whenever required.\n<\/p>\n
[b]\tshall
\nremain present at concerned Police Station on  25.4.2011
\nbetween 11:00 am to 2:00 pm:\n<\/p>\n
[c]\tshall
\nnot hamper the investigation in any manner nor shall directly or
\nindirectly make any inducement, threat or promise to any witness so
\nas to dissuade them from disclosing such facts to the Court or to any
\nPolice Officer;\n<\/p>\n
[d]\tshall
\nat the time of execution of bond, furnish the address to the
\nInvestigating Officer and the Court concerned and shall not change
\nthe residence till the final disposal of the case or till further
\norders;\n<\/p>\n
[e]
\n\twill not leave India without the permission of the Court and, if is
\nholding a Passport, shall surrender the same before the trial Court
\nimmediately<\/p>\n
[f]\tIt
\nwould be open to the Investigating Officer to file an application for
\nremand, if he considers it just and proper and the concerned
\nMagistrate would decide it on merits.\n<\/p>\n
[g]\tdespite
\nthis order, it would be open for the Investigating Agency to apply to
\nthe competent Magistrate, for police remand of the applicant. The
\napplicant shall remain present before the learned Magistrate on the
\nfirst date of hearing of such application and on all subsequent
\noccasions, as may be directed by the learned Magistrate. This would
\nbe sufficient to treat the accused in the judicial custody for the
\npurpose of entertaining application of the prosecution for police
\nremand. This is, however, without prejudice to the right of the
\naccused to seek stay against an order of remand, if ultimately
\ngranted, and the power of the learned Magistrate to consider such a
\nrequest in accordance with law. It is clarified that the applicant,
\neven if, remanded to the police custody, upon completion of such
\nperiod of police remand, shall be set free immediately, subject to
\nother conditions of this anticipatory bail order.\n<\/p>\n
7.\tRule
\nmade absolute. Application is disposed of accordingly.\n<\/p>\n
8.\tDirect
\nservice is permitted.\n<\/p>\n
