Justice S.S.SATHEESACHANDRAN\n\n Dated :24\/11\/2009\n\n O R D E R\n             S.S.SATHEESACHANDRAN, J.\n                  -------------------------------\n             W.P.(C).NO.33726 OF 2009 (O)\n                -----------------------------------\n      Dated this the 24th day of November, 2009\n\n                      J U D G M E N T\n<\/pre>\n<p>     Petitioners are the judgment debtors 2, 3 and 4 in<\/p>\n<p>E.P.No.290 of 2007 in O.S.No.202 of 2004 on the file of the<\/p>\n<p>IInd Additional Munsiff Court, Neyyattinkara.        The decree<\/p>\n<p>executed is one passed in a suit for injunction, both mandatory<\/p>\n<p>and prohibitory, and the respondent is the decree holder. The<\/p>\n<p>decree granted to the plaintiff enables her to restore a<\/p>\n<p>compound wall as noted in the plan prepared by the<\/p>\n<p>Commissioner and also a prohibitory injunction against the<\/p>\n<p>defendants\/judgment debtors from trespassing upon the plaint<\/p>\n<p>property or constructing any pathway through that property.<\/p>\n<p>Execution of the decree for putting up the compound wall was<\/p>\n<p>resisted by the petitioners\/judgment debtors, in which, among<\/p>\n<p>other contentions, it was also canvassed that no construction<\/p>\n<p>of the compound wall can be proceeded with without<\/p>\n<p>obtaining a licence from the Panchayath.          To substantiate<\/p>\n<p><span class=\"hidden_text\">WPC.33726\/09                   2<\/span><\/p>\n<p>their objections, the Secretary of the Panchayath was also<\/p>\n<p>examined in the execution proceedings. The court below after<\/p>\n<p>considering the decree and also hearing the counsel on both<\/p>\n<p>sides,  passed    Ext.P6   order    appointing   an   Advocate<\/p>\n<p>Commissioner to supervise the putting up of the boundary in<\/p>\n<p>tune with the decree. A Surveyor was also appointed to assist<\/p>\n<p>the Advocate Commissioner. Ext.P6 is that order. Propriety<\/p>\n<p>and correctness of that order is challenged in the writ petition<\/p>\n<p>invoking the supervisory jurisdiction vested with this Court<\/p>\n<p>under Article 227 of the constitution of India.<\/p>\n<p>     2.    I heard the counsel for the petitioners.     Having<\/p>\n<p>regard to the submissions made and taking note of the facts<\/p>\n<p>and circumstances presented, I find no notice to the<\/p>\n<p>respondent\/decree holder is necessary, and hence, it is<\/p>\n<p>dispensed with. In Ext.P1 judgment rendered in the suit, the<\/p>\n<p>court has held that the restoration of the compound wall can<\/p>\n<p>be done with the consent of the Panchayath, if required, as per<\/p>\n<p>the provisions of the Kerala Panchayath Raj Act and Rules, is<\/p>\n<p>highlighted by the counsel contending that without getting<\/p>\n<p><span class=\"hidden_text\">WPC.33726\/09                   3<\/span><\/p>\n<p>consent or licence from the Panchayath, the decree holder<\/p>\n<p>cannot put up the compound wall.        The evidence of the<\/p>\n<p>Secretary of the Panchayath, who was examined as a witness<\/p>\n<p>in the execution proceedings, a copy of whose deposition is<\/p>\n<p>produced as Ext.P5, is also banked upon by the counsel that<\/p>\n<p>the court below went wrong in passing Ext.P6 order. The<\/p>\n<p>court has turned down what is stipulated under the decree<\/p>\n<p>and thus transgressed beyond the decree, is the submission of<\/p>\n<p>the counsel to impeach Ext.P6 order. I do not find any merit<\/p>\n<p>in the submissions made by the counsel. A decree has been<\/p>\n<p>granted by the court enabling the plaintiff to restore and put<\/p>\n<p>up a compound wall which had been demolished allegedly by<\/p>\n<p>the defendants, as noted by the Advocate Commissioner in his<\/p>\n<p>plan which forms part of the decree. Such construction can be<\/p>\n<p>done only with the licence of the Panchayath cannot be raised<\/p>\n<p>as an objection by the petitioners\/judgment debtors, who are<\/p>\n<p>bound by the decree.     If the construction is done without<\/p>\n<p>obtaining licence from the Panchayath, if so required, the<\/p>\n<p>local authority can take appropriate steps, and no doubt, the<\/p>\n<p>decree holder\/plaintiff has to answer such proceedings. That,<\/p>\n<p><span class=\"hidden_text\">WPC.33726\/09                   4<\/span><\/p>\n<p>however, cannot be canvassed as a ground by the present<\/p>\n<p>petitioners\/judgment debtors who are bound by the decree<\/p>\n<p>passed by the court.
