Justice M.SASIDHARAN NAMBIAR\n\n Dated :30\/09\/2009\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n              Crl.M.C.No.3112 of 2009\n            --------------------------\n\n                       ORDER\n<\/pre>\n<p>    Petitioners   are   the   accused   and   first<\/p>\n<p>respondent,  the  defacto  complainant  in  C.C.No.<\/p>\n<p>418\/2008  on  the  file  of  Judicial  First  Class<\/p>\n<p>Magistrate&#8217;s Court, Thiruvalla, taken cognizance<\/p>\n<p>for the offences under Sections 498A, 323 and 294<\/p>\n<p>(b) read with Section 34 of Indian Penal Code.<\/p>\n<p>First  petitioner  is  the  husband  of  the  first<\/p>\n<p>respondent. This petition is filed under Section<\/p>\n<p>482 of Code of Criminal Procedure to quash the<\/p>\n<p>proceedings  contending  that   entire  matrimonial<\/p>\n<p>disputes between the parties were amicably settled<\/p>\n<p>and therefore, it is not in the interest of justice<\/p>\n<p>to continue with the prosecution.\n<\/p>\n<p>    2. First respondent appeared through a counsel.<\/p>\n<p>Petitioners, along with the first respondent filed<\/p>\n<p>Crl.M.Appl.No.5335\/2009 for permission to compound<\/p>\n<p>the offences stating that entire disputes were<\/p>\n<p><span class=\"hidden_text\">CRMC 3112\/2009             2<\/span><\/p>\n<p>amicably settled between the parties and first<\/p>\n<p>respondent has filed the complaint before National<\/p>\n<p>Women&#8217;s Commission due to mistake of facts, which<\/p>\n<p>was repeated in the statement submitted before the<\/p>\n<p>police    and   first  respondent  has  no  complaint<\/p>\n<p>against the petitioners and in such circumstances,<\/p>\n<p>the offences alleged are to be compounded.<\/p>\n<p>    3. Learned counsel appearing for the petitioners,<\/p>\n<p>first respondent and learned Public Prosecutor were<\/p>\n<p>heard.\n<\/p>\n<p>    4. Offences under Sections 498A and 294(b) of<\/p>\n<p>Indian    Penal   Code  are  not  compoundable  under<\/p>\n<p>Section     320   of  Code  of   Criminal  Procedure.<\/p>\n<p>Therefore,     permission to  compound  the  offences<\/p>\n<p>cannot be granted.     But, as held by the Apex Court<\/p>\n<p>in B.S.Joshi v. State of Haryana ((2003) 4 SCC<\/p>\n<p>675), when the matrimonial disputes were amicably<\/p>\n<p>settled between the parties, it is not in the<\/p>\n<p>interest      of  justice   to  continue   with   the<\/p>\n<p>prosecution. When there was an amicable settlement<\/p>\n<p><span class=\"hidden_text\">CRMC 3112\/2009            3<\/span><\/p>\n<p>of the disputes between the parties, chance of a<\/p>\n<p>successful prosecution is very bleak and it would<\/p>\n<p>result only in unnecessary waste of valuable time<\/p>\n<p>of the court. In such circumstances, it is not in<\/p>\n<p>the  interest   of  justice to  continue  with  the<\/p>\n<p>prosecution.\n<\/p>\n<p>     Petition is allowed.
