Jet Airways (I) Ltd   Respondent no. 2 has awarded a contract<br \/>\n\tto M\/s. Philipson Corporation   respondent no. 3.\n<\/p>\n<p>2.\tI<br \/>\n\tsay that by a letter dated 5\/4\/2010 Airport Authority of India has<br \/>\n\tconveyed to the respondent no. 2 that Bureau of Civil Aviation<br \/>\n\tSecurity has intimated to the Airports Authority of India that the<br \/>\n\tapplication for the security clearance of M\/s Philipson Corporation<br \/>\n\t  respondent no. 3 has been rejected by the competent authority.<br \/>\n\tI further say that the present respondent no. 2 has been directed to<br \/>\n\tmake necessary alternative arrangement on or before 9\/4\/2010.<br \/>\n\tMarked Annexure A collectively are the copies of communication<br \/>\n\tissued by Airports Authority of India and the communication issued<br \/>\n\tby Bureau of Civil Aviation Security.\n<\/p>\n<p>3.\tIn<br \/>\n\tview of aforesaid development the respondent no. 3 ceases to be the<br \/>\n\tcontractor of respondent no. 2 and therefore the Ad interim stay qua<br \/>\n\tservice condition of the workmen granted by this Hon&#8217;ble Court by an<br \/>\n\torder dated 25\/2\/2010 and continued till today may kindly be<br \/>\n\tvacated.\n<\/p>\n<p>Against<br \/>\n\tthis affidavit, today, further affidavit has been filed on behalf of<br \/>\n\tpetitioner.  Copy thereof is served to learned advocate Mr. Thakkar<br \/>\n\tat 11.40 am. Learned advocate Mr. Mishra brought to notice of this<br \/>\n\tCourt in respect to earlier petition SCA  16523\/2007 filed by<br \/>\n\tpresent respondent no. 3 M\/s Philipson Corporation, where Union of<br \/>\n\tIndia, Secretary Bureau of Civil Aviation Security, Airport<br \/>\n\tDirector, Airport Authority of India and Assistant Commissioner of<br \/>\n\tBureau of Civil Aviation Security and Bureau of Civil Aviation<br \/>\n\tSecurity are join as a party. Therefore, in light of aforesaid back<br \/>\n\tground as Bureau of Civil Aviation Security was party, this Court<br \/>\n\thas passed an order on 7\/7\/2008 which is quoted as under:\n<\/p>\n<p> 1.\tThe<br \/>\n\tpetitioner of this petition has prayed for appropriate writ to<br \/>\n\tdirect the respondent authority to issue Security Clearance<br \/>\n\tCertificate to the petitioner.\n<\/p>\n<p>2.\tHeard<br \/>\n\tMr.Kinnariwala, learned counsel appearing for the petitioner,<br \/>\n\tMr.Manav Mehta for respondent No.1, Central Government Standing<br \/>\n\tCounsel, Mr. Chetan Pandya for Mr.S.V. Raju for respondents Nos. 2,<br \/>\n\t3 &amp; 4.\n<\/p>\n<p>3.\tUpon<br \/>\n\thearing the learned advocate appearing for both the sides and the<br \/>\n\tperusal of the order dated 13.06.2007 shows that there is only<br \/>\n\tcommunication for not granting the Security Clearance Certificate<br \/>\n\tand no reason whatsoever is mentioned.  Apart from the above, during<br \/>\n\tthe course of the hearing, Mr. Pandya, learned counsel appearing for<br \/>\n\tBureau of Civil Aviation Security has placed on record the copy of<br \/>\n\tthe communication dated 30.03.2007 addressed by the Deputy<br \/>\n\tCommissioner of Security (Civil Aviation), CSI, intimating that the<br \/>\n\tsecurity clearance is not granted because it has come to the notice<br \/>\n\tthat the said Company, i.e. the petitioner herein is infringing the<br \/>\n\tlabour laws and exploitating the labourers and misusing the labour<br \/>\n\tlicense.\n<\/p>\n<p>4.\tSuch<br \/>\n\ta ground on the part of the Deputy Commissioner of Security is also<br \/>\n\twithout any material produced on the record of this Court nor any<br \/>\n\topportunity of hearing was given to the petitioner.\n<\/p>\n<p>5.\tUnder<br \/>\n\tthese circumstances, neither the order of Bureau of Civil Aviation<br \/>\n\tSecurity nor the order dated 13.06.2007 (Annexure-D) can be<br \/>\n\tsustained in view of the non-compliance of the principles of natural<br \/>\n\tjustice of no opportunity given to the petitioner nor<br \/>\n\tany reasons mentioned therein so far as the communication of the<br \/>\n\torder dated 13.06.2007 is concerned.\n<\/p>\n<p>6.\tAt<br \/>\n\tthis stage, Mr.Pandya, learned counsel appearing for the respondent<br \/>\n\tNos.2 to 4 states that if this Court directs, the opportunity of<br \/>\n\thearing shall be given, but the petitioner may be directed to<br \/>\n\tcooperate with the same.\n<\/p>\n<p>7.\tMr.Mehta,<br \/>\n\tfor respondent No.1 submitted that it is only after the opinion on<br \/>\n\tthe security clearance granted or not granted, the Civil Aviation<br \/>\n\tDepartment may be required to take further action.\n<\/p>\n<p>8.\tUnder<br \/>\n\tthese circumstances, the following directions:\n<\/p>\n<p>The<br \/>\n\tpetitioner shall be given opportunity of hearing by the Deputy<br \/>\n\tCommissioner of Security (Civil Application) of the Bureau of Civil<br \/>\n\tAviation Security, Government of India, New Delhi.  The petitioner<br \/>\n\tshall cooperate in the hearing of the matter.\n<\/p>\n<p>The<br \/>\n\tsaid authority shall take appropriate decision within a period of<br \/>\n\tone month from the receipt of the order of this Court.\n<\/p>\n<p>In<br \/>\n\tview of the above, the matter shall be decided afresh by the<br \/>\n\taforesaid authority in accordance with law.\n<\/p>\n<p>Until<br \/>\n\tthe decision is taken and the same is communicated to the petitioner<br \/>\n\tby Regd. A.D.Post, ad interim relief granted earlier shall continue<br \/>\n\tto remain in operation with the clarification that in the event the<br \/>\n\tlicense of the petitioner expires by afflux of time and not renewed,<br \/>\n\tno further rights shall accrue to the petitioner for continuing with<br \/>\n\tthe same activity.\n<\/p>\n<p>It<br \/>\n\tis hardly required to be stated that if any untoward incident<br \/>\n\thappens pending the consideration and the petitioner continues<br \/>\n\tpursuant to the interim order, the petitioner will be responsible in<br \/>\n\tall respects for any act of himself or his agents or servants.\n<\/p>\n<p>9.\tPetition<br \/>\n\tis disposed of in terms of the aforesaid direction.  D.S.\n<\/p>\n<p>This<br \/>\n\tCourt has passed an order as referred above, where almost identical<br \/>\n\tsituation was occurred at relevant time because in aforesaid<br \/>\n\tpetition, petitioner contractor, present respondent no. 3 has<br \/>\n\treceived communication dated 30\/3\/2007 from Bureau of Civil Aviation<br \/>\n\tSecurity addressed by Deputy Commissioner of Security (Civil<br \/>\n\tAviation), CSI, intimating that security clearance is not granted<br \/>\n\tbecause it has come to the notice that said petitioner Company is<br \/>\n\tinfringing labour laws and exploiting labourers and misusing labour<br \/>\n\tlicense.\n<\/p>\n<p>The<br \/>\n\taffidavit has been filed by respondent no. 2 on the basis of<br \/>\n\tcommunication dated 5\/4\/2010 received from Airport Authority of<br \/>\n\tIndia and Airport Authority of India has received communication from<br \/>\n\tBureau of Civil Aviation Security (Western region) vide letter dated<br \/>\n\t11-12\/3\/2010 as intimated that application for security clearance of<br \/>\n\tpresent respondent no. 3 M\/s Philipson Corporation has been rejected<br \/>\n\tby competent authority.  Therefore, request to make necessary<br \/>\n\talternate arrangement on or before 9\/4\/2010.  Why request has been<br \/>\n\trejected made by M\/s Philipson for security clearance, for that,<br \/>\n\tcompetent authority has not disclosed any reason.\n<\/p>\n<p>Therefore,<br \/>\n\tlearned advocate Mr. Mishra appearing on behalf of petitioner<br \/>\n\trequest to permit petitioner to join Union of India notice to be<br \/>\n\tserved through Security Bureau of Civil Aviation Security (Ministry<br \/>\n\tof Civil Aviation)  A  Wing, Janpat Bhavan, Janpat, New Delhi,<br \/>\n\tBureau of Civil Aviation Security, Ground Floor AAI (NAD), Building<br \/>\n\tCSI Airport Mumbai 400 099, Bureau of Civil Aviation, Security,<br \/>\n\tGround floor AAI (NAD), Building CSI Airport Mumbai 400 099 and<br \/>\n\tAirport Director and Airport Authority of India, Ahmedabad is to be<br \/>\n\tjoin as party in present proceeding, otherwise, petitioner is not<br \/>\n\table to get prayer which has been made in present petition.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Mr. Thakkar submitted that he has to implement direction<br \/>\n\tissued by Airport authority of India dated 5\/4\/2010.  However,<br \/>\n\tlearned advocate Mr. Joshi also submitted that once principal<br \/>\n\temployer has received communication from Airport authority of India<br \/>\n\tthen respondent no. 3 Contractor must have to comply with such<br \/>\n\tdirection.\n<\/p>\n<p>In<br \/>\n\tlight of this back ground, according to my opinion request which has<br \/>\n\tbeen made by learned advocate Mr. Mishra must have to be granted in<br \/>\n\tinterest of justice, otherwise, matter will not be decided by this<br \/>\n\tCourt effectively in absence of aforesaid parties as mentioned by<br \/>\n\tlearned advocate Mr. Mishra. It is a question of livelihood of more<br \/>\n\tthan 43 employees those who are working at present with respondent<br \/>\n\tno. 3.\n<\/p>\n<p>In<br \/>\n\tlight of this, petitioner is directed to join Union of India<br \/>\n\tSecurity Bureau of Civil Aviation Security (Ministry of Civil<br \/>\n\tAviation)  A  Wing, Janpat Bhavan, Janpat, New Delhi, Bureau of<br \/>\n\tCivil Aviation Security, Ground Floor AAI (NAD), Building CSI<br \/>\n\tAirport Mumbai 400 099, Bureau of Civil Aviation, Security, Ground<br \/>\n\tfloor AAI (NAD), Building CSI Airport Mumbai 400 099 and Airport<br \/>\n\tDirector and Airport Authority of India, Ahmedabad as party<br \/>\n\trespondent no. 4, 5, 6 and 7.  Accordingly, cause title of present<br \/>\n\tpetition is to be amended today.\n<\/p>\n<p>Therefore,<br \/>\n\tissue notice to newly added respondent no. 4 to 7 returnable on<br \/>\n\t16\/4\/2010.   Meanwhile, earlier interim order granted by this Court<br \/>\n\ton 25\/2\/2010 shall remain continue till then.  Meaning thereby that<br \/>\n\tcommunication received by respondent no. 2 from Airport authority of<br \/>\n\tIndia dated 5\/4\/2010 is not required to be implemented because of<br \/>\n\tinterim order is extended by this Court.
