Whether the judgment should be reported in the Digest ?\n<\/p>\n<p>                                ***<\/p>\n<p>AJAY TEWARI, J<\/p>\n<p>             This order may be read in consequence to the order dated<\/p>\n<p>2.2.2009.\n<\/p>\n<p>             The only argument raised by counsel for the respondents is that<\/p>\n<p>the State of Haryana has enacted the Haryana Civil Services (Executive<\/p>\n<p>Branch) and Allied Services and other Services Common\/Combined<\/p>\n<p>Examination Act, 2002. Section 4 thereof is as follows :-<\/p>\n<blockquote><p>                   &#8220;4. (1)     No appointment shall be made to any post or<\/p>\n<p>                   service to which this Act applies beyond the number of<\/p>\n<p>                   posts advertised.<\/p>\n<pre> C.W.P No. 17257 of 1999                                   ::2::\n\n               (2)      Notwithstanding     anything       to     the    contrary\n\n<\/pre>\n<blockquote><p>               contained in any judgment, order, decree or decision of a<\/p>\n<p>               court of law, Act, rule, regulation or executive<\/p>\n<p>               instructions,     no    candidate,       from      the   date   of<\/p>\n<p>               commencement of this Act, shall, on the basis of his<\/p>\n<p>               merit,     or    placement     in    a     Common\/Combined<\/p>\n<p>               Examination, have right to seek appointment to Haryana<\/p>\n<p>               Civil Services (Executive Branch) and Allied Services or<\/p>\n<p>               Other Services beyond the number of advertised posts.<\/p>\n<p>               (3)      The State Government shall not be competent to<\/p>\n<p>               offer appointment to a candidate, who is placed in the<\/p>\n<p>               waiting list or who claims himself to be in the waiting list<\/p>\n<p>               on the basis of Common\/Combined Examination, for a<\/p>\n<p>               post for which his name was not recommended by the<\/p>\n<p>               Commission :\n<\/p><\/blockquote>\n<blockquote><p>                        Provided that if a candidate has been appointed or<\/p>\n<p>                        offered appointment over and above advertised<\/p>\n<p>                        posts for any reason, the services of such candidate<\/p>\n<p>                        shall be dispensed with.        However, he shall be<\/p>\n<p>                        entitled to be appointed to the service\/post, if any,<\/p>\n<p>                        for which his name was originally recommended<\/p>\n<p>                        by the Commission :<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                        Provided further that no recovery of higher salary,<\/p>\n<p>                        emoluments or any other financial benefits drawn<\/p>\n<p>                        by such candidate as a result of his appointment in<\/p>\n<p>                        excess of the advertised posts, shall be made from<br \/>\n C.W.P No. 17257 of 1999                                 ::3::\n<\/p><\/blockquote>\n<blockquote><p>                          him but his pay shall be fixed in the scale of the<\/p>\n<p>                          post to which he is found entitled for appointment<\/p>\n<p>                          under this Act.\n<\/p><\/blockquote>\n<blockquote><p>                  (4)     The State Government may offer appointment to<\/p>\n<p>                  the candidates to Haryana Civil Services (Executive<\/p>\n<p>                  Branch) and Allied Services or Other Services, as the<\/p>\n<p>                  case may be, to the extent of number of advertised posts<\/p>\n<p>                  only.      However, no candidate shall be offered<\/p>\n<p>                  appointment even to the extent of number of advertised<\/p>\n<p>                  posts, if his name is not recommended by the<\/p>\n<p>                  Commission or if he does not fulfill the eligibility<\/p>\n<p>                  condition laid down by the State Government for<\/p>\n<p>                  appointment to that service\/post by way of service rules,<\/p>\n<p>                  regulations or executive instructions, as the case may<\/p>\n<p>                  be.&#8221;<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>            To counter this, learned counsel for the petitioner has argued<\/p>\n<p>that the said Act was considered by the Hon&#8217;ble Supreme Court in the case<\/p>\n<p>reported as <a href=\"\/doc\/397098\/\">Virender Singh Hooda and others vs State of Haryana and<\/a><\/p>\n<p>another, 2005(1) SLR 10, wherein it was held as follows :-<\/p>\n<\/blockquote>\n<blockquote><p>                  &#8220;72. On the aforesaid analogy, I.A No.4 of 2004 in writ<\/p>\n<p>                  petition no.215 of 2002 filed by Jagadish Sharma and<\/p>\n<p>                  Mahavir Singh is allowed since the applicants are higher<\/p>\n<p>                  in merit than Lalit Kumar and Virender Lather<\/p>\n<p>                  aforenoted and also satisfy condition placed in Sandeep<\/p>\n<p>                  Singh&#8217;s case by this Court. They are thus entitled to be<\/p>\n<p>                  given similar treatment as Ajay Malik and Arvind<br \/>\n C.W.P No. 17257 of 1999                                 ::4::\n<\/p><\/blockquote>\n<blockquote><p>                    Malhan in view of peculiar facts of their case. In this<\/p>\n<p>                    view, the direction of the High Court in judgment dated<\/p>\n<p>                    3rd July, 2004 in CWP No.7281 of 2000 also does not call<\/p>\n<p>                    for any interference.&#8221;<\/p><\/blockquote>\n<\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>             In the circumstances, this writ petition is allowed, in view of<\/p>\n<p>the judgments of the Hon&#8217;ble Supreme Court in Virender Singh Hooda and<\/p>\n<p>others&#8217; case (supra) and Sandeep Singh&#8217;s case (supra). The respondents are<\/p>\n<p>directed to give similar treatment to the petitioner as was granted to Ajay<\/p>\n<p>Malik and Arvind Malhan, within three months from the receipt of a<\/p>\n<p>certified copy of this order.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<pre>                                             ( AJAY TEWARI      )\nFebruary     19, 2009.
