BASANT, J.\n\n           ````````````````````````````````````````````````````\n                   B.A. No. 1822 OF 2008 C\n           ````````````````````````````````````````````````````\n           Dated this the 24th day of March, 2008\n\n                             O R D E R\n<\/pre>\n<p>           Application for regular bail.               Petitioners are<\/p>\n<p>accused Nos.1, 2, 5 and 6. They are the only accused now<\/p>\n<p>facing allegations all others having been dropped from the<\/p>\n<p>array of accused. They face allegations in a crime alleging<\/p>\n<p>offences punishable, inter alia, under sections 326 and 308<\/p>\n<p>IPC.    The alleged incident took place on 20.1.08.               The<\/p>\n<p>petitioners surrendered on 1.2.08. The petitioners allegedly<\/p>\n<p>belong to the CPI(M). The victim allegedly belongs to the<\/p>\n<p>BJP. The petitioners remain in custody from 1.2.08.<\/p>\n<p>      2.   The learned counsel for the petitioners prays the<\/p>\n<p>learned Public Prosecutor does not oppose the said prayer on<\/p>\n<p>condition that appropriate safeguards are insisted in the<\/p>\n<p>interests of the law and order situation in the locality and I am<\/p>\n<p>satisfied that the petitioners, who have remained in custody<\/p>\n<p>from 1.2.08, can now be directed to be released on bail<\/p>\n<p>subject to appropriate conditions.\n<\/p>\n<p>BA.1822\/08<br \/>\n<span class=\"hidden_text\">                                 : 2 :<\/span><\/p>\n<p>      3.   In the result, this petition is allowed.          The<\/p>\n<p>petitioners shall be enlarged on bail on the following terms<\/p>\n<p>and conditions:-\n<\/p>\n<p>      i)   The     petitioners     shall  execute    bonds    for<\/p>\n<p>Rs.1,00,000\/- (Rupees one lakh only) each with two solvent<\/p>\n<p>sureties each for the like sum to the satisfaction of the learned<\/p>\n<p>Magistrate.\n<\/p>\n<p>      ii)  The petitioners shall not, except for the purpose of<\/p>\n<p>complying with condition No.(iii) below, for a period of three<\/p>\n<p>months, enter the Sessions Division of Thalassery, without<\/p>\n<p>the prior permission of the learned Magistrate.<\/p>\n<p>      iii) During the said period of three months, the<\/p>\n<p>petitioners shall make themselves available for interrogation<\/p>\n<p>before the investigating officer between 10 a.m and 12 noon<\/p>\n<p>on all Mondays and thereafter as and when directed by the<\/p>\n<p>investigating officer in writing to do so.<\/p>\n<p>                                            (R.BASANT, JUDGE)<br \/>\naks<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Sudheepan vs State Of Kerala To Be Rep.
