Respondents.\n\n\n\n\tFor Petitioners\t: Mr.N.K.Elango (ACGSC)\n\n\tFor Respondents\t: Mr.Vijay Narayan (Senior Counsel) for\n\t\t\t\t  Mr.Karthick Rajan (R2)\n\nPRAYER: Petition filed seeking for a Writ of Certiorari, calling for the records, relating to the order, dated 11.10.2004, made in O.A.No.979 of 2003, on the file of the Hon'ble Central Administrative Tribunal, Chennai and quash the same. \n\nO R D E R\n<\/pre>\n<p>(Order of the Court was made by P.K.MISRA,J.)<br \/>\n\tHeard Mr.N.K.Elango, the learned Additional Central Government Standing Counsel appearing for the petitioners and Mr.Vijay Narayan, the senior counsel appearing for the second respondent.\n<\/p>\n<p>\t2. The second respondent on account of an alleged involvement in a criminal case was placed under suspension, on 18.9.91. Subsequently, the trial Court rendered a judgment of conviction and therefore, on the basis of the said judgement, the respondent No.2 was dismissed from service, with effect from 26.11.91. Subsequently, however the criminal appeal filed by respondent No.2 was allowed and the order of conviction was set aside. Thereafter, the respondent No.2 filed a representation to reinstate him in service with all the attendant benefits. However, since no action was taken the respondent No.2 filed an original application in O.A.No.979 of 2003 before the Tribunal.\n<\/p>\n<p>\t3. The Tribunal by its order, dated 11.10.2004, made in O.A.No.979 of 2003, has directed that respondent No.2 shall be deemed to have been reinstated in service and has further directed the payment of backwages for the entire period. Such order is being questioned in the present writ petition by the Union of India.\n<\/p>\n<p>\t4. The counsel for the petitioners has submitted that since the Appellate Court in its judgment has given the benefit of doubt to the accused\/appellant, it cannot be said that the concerned appellant had been fully exonerated and therefore, the authority was justified in considering the period during which the accused\/appellant was under deemed suspension and therefore, the appellant employee was entitled to 50% of the allowance. However, such submission was not accepted by the Tribunal.\n<\/p>\n<p>\t5. In the course of hearing, it was brought to our notice that the High Court while entertaining the writ petition had given a direction to pay the second respondent the backwages for the period from 26.12.2000 i.e. to say the date of representation, to 27.6.2002, the date of reinstatement. The respondent No.2 has filed an affidavit in the Court to today, wherein it is indicated as follows:\n<\/p>\n<p>\t&#8220;The 2nd respondent now agrees to receive 50% of the wages including allowances payable to him for the period of suspension from 18.9.1991 to 25.11.1991 and period of non employment from 26.11.1991 to 25.12.2000, provided the period of suspension (i.e) 6.7.1990 to 23.10.1990, 18.9.1991 to 25.11.1991 and period of non employment (i.e.) 26.11.1991 to 26.6.2002 is treated as periods spent on duty for al purposes and the same shall count for the purpose of determining seniority, qualifying service for promotion, pay, increments, qualifying service for pension and other terminal benefits&#8221;\n<\/p>\n<p>\t6. Having heard the counsel for both parties at length we feel that the submission contended in Paragraph-4 of the affidavit is in the interest of justice inasmuch as though technically the respondent No.2 may be entitled to full salary for the entire period, since he had admittedly not worked during the said period, it may be appropriate to give him 50% of arrears as backwages. Accordingly, we allow the writ petition in part and modify the order passed by the Tribunal and direct that the entire period of suspension shall be treated as on duty for all purposes including seniority, promotion, pension, etc. However, for the period prior to 26.12.2000, the 50% of the backwages would be payable to the respondent No.2. If any, amount is already paid towards suspension allowance for any of the period such amount shall be taken into account and the balance amount shall be calculated and be paid. This may be done within a period of three months from the date of receipt of a copy of this order.
