The\tauthorities,<br \/>\nresponsible   for    pollution\t control   and\t environment<br \/>\nprotection, have  not been able to provide clean and healthy<br \/>\nenvironment to the residents of Delhi. The ambient air is so<br \/>\nmuch polluted that it is difficult to breathe. More and more<br \/>\nDelhi-ites  are\t  suffering  from  respiratory-diseases\t and<br \/>\nthroat-infections.  River   Yamuna  &#8211;  the  main  source  of<br \/>\ndrinking-water\tsupply\t&#8211;  is  the  free  dumping-place\t for<br \/>\nuntreated sewage  and industrial  waste. Apart\tfrom Air and<br \/>\nWater pollution,  the city  is virtually  an open  dust-bin.<br \/>\nGarbage\t strewnall   over  Delhi  is  a\t common\t sight.\t The<br \/>\nMunicipal Corporation  of Delhi\t (the MCD) constituted under<br \/>\nthe Delhi  Municipal Corporation  Act, 1957  (Delhi Act) and<br \/>\nthe New Delhi Municipal Council (the NDMC) constituted under<br \/>\nthe New\t Delhi Municipal  Council Act,\t1994 (New Delhi Act)<br \/>\nare wholly  re-miss in\tthe discharge  of their duties under<br \/>\nlaw.  It   is  no   doubt  correct   that  rapid  industrial<br \/>\ndevelopment, urbanization  and regular\tflow of persons from<br \/>\nrural to  urban areas  have made  major contribution towards<br \/>\nenvironmental  degradation   but  at   the  same   time\t the<br \/>\nAuthorities &#8211; entrusted with the work of pollution control &#8211;<br \/>\ncannot be  permitted to\t sit back  with folded\thands on the<br \/>\npretext that  they have\t no  financial\tor  other  means  to<br \/>\ncontrol pollution  and protect\tthe environment.  Apart from<br \/>\nArticle 21  of the  Constitution of  India, which guarantees<br \/>\n&#8216;right to life&#8217;, Articles 48A and 51A(g) of the Constitution<br \/>\nare as under:-.lsl<br \/>\n     &#8220;48A. Protection and improvement of<br \/>\n     environment  and\tsafeguarding  of<br \/>\n     forests and  wild\tlife.-The  State<br \/>\n     shall  endeavor   to  protect   and<br \/>\n     improve  the   environment\t and  to<br \/>\n     safeguard the forests and wild life<br \/>\n     of the country.\n<\/p>\n<p>     51(g)-to protect  and  improve  the<br \/>\n     natural\tenvironment    including<br \/>\n     forests,  lakes,  rivers  and  wild<br \/>\n     life, and\tto have\t compassion  for<br \/>\n     living creatures.&#8221;\n<\/p>\n<p>     In this  petition under  Article 32 of the Constitution<br \/>\nof India,  the petitioner  &#8211; an advocate of this Court &#8211; has<br \/>\nsought directions  to the  MCD and the NDMC to perform their<br \/>\nstatutory duties  in particular\t the collection, removal and<br \/>\ndisposal of garbage and other waste.\n<\/p>\n<p>     This Court\t on December  16, 1994\tpassed the following<br \/>\norder in the writ petition :-\n<\/p>\n<pre>     \"We    direct     the     Municipal\n     Corporation   of\t Delhi,\t   Delhi\n     Administration\t and\t   Delhi\n<\/pre>\n<p>     Development Authority  to place  on<br \/>\n     record  the  list\tof  all\t garbage<br \/>\n     dumping  places  and  city\t garbage<br \/>\n     collection centers within six weeks<br \/>\n     from today. It shall also be stated<br \/>\n     as to what steps are being taken by<br \/>\n     these  Authorities\t to  keep  these<br \/>\n     places  clean   and   tidy.   These<br \/>\n     Authorities shall also consider the<br \/>\n     possibility of  making it mandatory<br \/>\n     that the  garbage\tetc.  should  be<br \/>\n     dumped   at    these   places    in<br \/>\n     plastic\/jute bags to be supplied by<br \/>\n     the   Corporation\t at   subsidized<br \/>\n     rates.&#8221;\n<\/p>\n<p>     Mr. H.K.  Handa, Executive\t Engineer MCD  filed a short<br \/>\naffidavit dated\t January  30,  1995  indicating\t that  three<br \/>\nstatutory   bodies    function\t within\t  their\t  respective<br \/>\nterritories  in\t the  Union  Territory\tof  Delhi,  covering<br \/>\nfollowing areas :-\n<\/p>\n<blockquote><p>     &#8220;(1) Municipal Corporation of Delhi\n<\/p><\/blockquote>\n<blockquote><p>\t\t       &#8211;  1399.26 Sq.Km.\n<\/p><\/blockquote>\n<blockquote><p>     (2) New  Delhi Municipal  Committee\n<\/p><\/blockquote>\n<blockquote><p>\t\t       &#8211;    42.40 Sq.Km.\n<\/p><\/blockquote>\n<pre>     (3)    Delhi    Cantonment\t   Board\n\t\t       -    42.80 Sq.Km.\n\t\t\t----------------\n\t\t\t 1484.46 Sq.Km.\"\n\t\t\t----------------\n<\/pre>\n<blockquote><p>     At present\t about 4000  metric tons  (MT) of garbage is<br \/>\ncollected daily\t by the\t MCD. The disposal of the garbage is<br \/>\ndone mainly  by &#8216;Land  Fill Method&#8217;.  It is  stated  in\t the<br \/>\naffidavit that\tat  present  the  total\t number\t of  garbage<br \/>\ncollection centers are 1804 (337 dhalaos, 1284 dustbins, 176<br \/>\nopen sites  and 7 steel bins). The garbage collection trucks<br \/>\ncollect the  garbage from the collection centers and take it<br \/>\nto the\tnearest Sanitary  Land Fill  (SLF) 19 Hospitals, 156<br \/>\nDispensaries, 160  Maternity and  Child Welfare\t Centers,  5<br \/>\nPrimary Health Centers, and 14 clinics are functioning under<br \/>\nthe control  of MCD. Except RBTB hospital, no other hospital<br \/>\netc, has  installed incinerator\t to burn the hospital-waste.\n<\/p><\/blockquote>\n<p>It is  highlighted in  the affidavit  that about  45% of the<br \/>\ntotal population  of Delhi  is living in slums, unauthorised<br \/>\ncolonies and  clusters. There are about 4,80,000 Jhuggies in<br \/>\nDelhi. According to a rough estimate about 6 persons stay in<br \/>\neach jhuggi.  They throw their garbage on the road or nearby<br \/>\ndustbins.\n<\/p>\n<p>     Mr. S.C.  Kumar, Executive\t Engineer has  filed further<br \/>\naffidavit dated\t July 13,  1995 on  behalf of  the MCD.\t The<br \/>\ncollection and disposal of the garbage is done by the &#8216;Solid<br \/>\nWaste Department&#8217;  of the MCD. The sanitation staff employed<br \/>\nfor this  purpose has  been indicated  in the  affidavit  as<br \/>\nunder :-\n<\/p>\n<blockquote><p>     &#8220;Municipal Corporation of Delhi has<br \/>\n     divided the  entire area  under its<br \/>\n     jurisdiction  into\t 12  zones.  The<br \/>\n     Solid Waste Department is headed by<br \/>\n     Sanitary Suptd.(SS)  in every zone,<br \/>\n     who inter\talia, is responsible for<br \/>\n     over  all\t sanitation  within  his<br \/>\n     zone. On  the supervisory level the<br \/>\n     SS is  assisted by\t Chief\tSanitary<br \/>\n     Inspector\t    (CSI),\tSanitary<br \/>\n     Inspector(SI),   Asstt.\tSanitary<br \/>\n     Inspector (ASI)  and Sanitary Guide<br \/>\n     (SG).\n<\/p><\/blockquote>\n<blockquote><p>\t  For containing the solid waste<br \/>\n     in Dhalaos\t and  cleanliness  safai<br \/>\n     karamchari s  (SK) are  deployed on<br \/>\n     each dhalao  and dustbin.\tThe list<br \/>\n     of existing dustbins and dhalaos is<br \/>\n     already  on  the  records\tof  this<br \/>\n     Hon&#8217;ble Court filed with additional<br \/>\n     affidavit.\n<\/p><\/blockquote>\n<blockquote><p>\t  The total number of sanitation<br \/>\n     staff of  solid waste management is<br \/>\n     as follows :\n<\/p><\/blockquote>\n<blockquote><p>     1. Sanitary Superintendent : 21 Nos\n<\/p><\/blockquote>\n<blockquote><p>     2. Chief Sanitary Inspector: 30 Nos\n<\/p><\/blockquote>\n<blockquote><p>     3. Sanitary Inspector\t:212 Nos\n<\/p><\/blockquote>\n<blockquote><p>     4. Asstt.Sanitary Inspector:556 Nos\n<\/p><\/blockquote>\n<blockquote><p>     5. Sanitary Guide\t\t:603 Nos\n<\/p><\/blockquote>\n<blockquote><p>     6. Safai Karamchari s   :38311 Nos&#8221;\n<\/p><\/blockquote>\n<p>Regarding construction of additional dhalaos it is<br \/>\nstated as under :-\n<\/p>\n<blockquote><p>     &#8220;The zonewise  list  of  1252  Nos.\n<\/p><\/blockquote>\n<blockquote><p>     (approx)\tnew    dhalaos\t to   be<br \/>\n     constructed and  708 nos.\texisting<br \/>\n     dustbins\/dhalaos\t    to\t      be<br \/>\n     repaired\/renovated is  attached  at<br \/>\n     Annexure &#8216;A&#8217;<br \/>\n\t  The completion  of work  will,<br \/>\n     however,\t depend\t    upon     the<br \/>\n     availability of  funds  by\t Central<br \/>\n     Govt. &amp; Delhi Govt. in anticipation<br \/>\n     of\t receipt   of  additional  funds<br \/>\n     short notice tenders in most of the<br \/>\n     zones have\t been floated. A request<br \/>\n     for releasing  funds to the tune of<br \/>\n     Rs.75.76 crores  has  already  been<br \/>\n     sent to  Principal\t Secy.\t(UD)  by<br \/>\n     Commissioner, MCD\tvide letter  no.<br \/>\n     486 dt.  5.6.95. This estimate will<br \/>\n     also require  revision in\tview  of<br \/>\n     the drawing  prepared by  the Chief<br \/>\n     Architect,\t  MCD\t for\tproposed<br \/>\n     construction of dhalaos.&#8221;<\/p><\/blockquote>\n<p>     Mr. Kumar\thas further  stated in\this  affidavit\tthat<br \/>\ncomposting is  one of  the solution  for disposal of garbage<br \/>\nand getting  soil conditioner through the process. According<br \/>\nto him\tthe MCD\t compost plant at okhla had to be closed few<br \/>\nyears back  since its  running was  not financially  viable.<br \/>\nThere is  a  proposal  to  revive  the\tsame.  The  Jagmohan<br \/>\nCommittee has  recommended for\tinstallation of 4 additional<br \/>\ncompost plants\tin Delhi.  Regarding  privatization,  it  is<br \/>\nstated as under:-\n<\/p>\n<blockquote><p>     &#8220;As  an   effort  to   explore  the<br \/>\n     alternative  method,  privatization<br \/>\n     of sanitation  work is  also  being<br \/>\n     considered to  be adopted\ton trial<br \/>\n     basis. However  final  decision  in<br \/>\n     this regard is yet to be taken.&#8221;<\/p><\/blockquote>\n<p>     It is  stated in the affidavit that orders for purchase<br \/>\nof 200\ttrucks have  been placed  with M\/s. Ordnance Factory<br \/>\nJabalpur. Tenders  for purchase\t of 35\tsuction machines, 50<br \/>\nfront-end-loaders have\tbeen received and are under process.<br \/>\nIt is  stated that  11 more  bulldozers are  required. It is<br \/>\nfurther stated\tthat 4 compactors of different capacities, 4<br \/>\nNos. of\t poclain on  chain\/tyre and  some more tipper trucks<br \/>\nare required.\n<\/p>\n<p>     Medical Officer of Health has filed affidavit dated May<br \/>\n12, 1995  on behalf of NDMC. Regarding &#8220;door to door garbage<br \/>\ncollection&#8221; the affidavit indicates as under :-\n<\/p>\n<blockquote><p>     &#8220;NDMC has\tintroduced a  scheme  of<br \/>\n     door to  door collection of garbage<br \/>\n     on\t experimental\tbasis\tin   few<br \/>\n     colonies.\t Under\t  this\t scheme,<br \/>\n     introduced on  Ist may,  1994, NDMC<br \/>\n     is supplying  25 polythene\t garbage<br \/>\n     bags  of\t19&#8243;  X\t25&#8221;  capable  of<br \/>\n     holding about  10-12 kg.  per month<br \/>\n     at the  subsidized price of Rs.15\/-<br \/>\n     per  house\t  per\tmonth\tin   the<br \/>\n     following areas.\n<\/p><\/blockquote>\n<blockquote><p>     1. North Avenue\n<\/p><\/blockquote>\n<blockquote><p>     2. South Avenue\n<\/p><\/blockquote>\n<blockquote><p>     3. D-I and D-II flats, Vinay Marg\n<\/p><\/blockquote>\n<blockquote><p>     4. C-I and C-II flats, Tilak Marg\n<\/p><\/blockquote>\n<blockquote><p>     5. Delhi Administration flats.\n<\/p><\/blockquote>\n<p>\tBhagwan Das Road\n<\/p>\n<p>     6. Pandara Road and Pandara Park\n<\/p>\n<p>     7. Ravinder Nagar and Bharti Nagar<br \/>\n\t  The  said   garbage  bags  are<br \/>\n     connected on  daily  basis\t by  our<br \/>\n     staff deployed  and then  deposited<br \/>\n     in the  nearby  dust-bins\tfor  the<br \/>\n     purpose  for  further  transporting<br \/>\n     them by  our staff\t to the\t dumping<br \/>\n     ground  maintained\t  by   Municipal<br \/>\n     Corporation of  Delhi. It is stated<br \/>\n     that  not\tmore  than  40%\t of  the<br \/>\n     residents under  the scheme  avails<br \/>\n     the benefit  of the  scheme  It  is<br \/>\n     specifically stated  that NDMC does<br \/>\n     not have  any dumping ground within<br \/>\n     its jurisdiction.&#8221;\n<\/p>\n<p>     It is  stated in  the affidavit that average of 300-350<br \/>\ntons of\t garbage is generated everyday in the NDMC area. For<br \/>\nthe purpose  of collection  and disposal of garbage the area<br \/>\nis divided  into 13  parts (circles).  There are 49 Jhuggi &#8211;<br \/>\nJhompri clusters  having 12500\tjhuggies in  the NDMC  area.<br \/>\nThere are  944 garbage\tcollecting places  (550 Trollies and<br \/>\n394 dustbins).\tThe task  is undertaken\t by a  fleet of 1423<br \/>\npermanent Safai\t Karamcharies, 600  Muster roll\t workers and<br \/>\n149 part time Safai Karamcharies.\n<\/p>\n<p>     This Court\t on September  15, 1995 passed the following<br \/>\norder :-\n<\/p>\n<blockquote><p>     &#8220;We have  heard the  petitioner and<br \/>\n     the learned  counsel assisting  us.<br \/>\n     Mr.  Tusharia,   Deputy   Director,<br \/>\n     Municipal Corporation  of Delhi  is<br \/>\n     personally present in Court. He has<br \/>\n     also assisted  us. Mr.H.K.Handa and<br \/>\n     Mr.S.C.Kumar, Executive  Engineers,<br \/>\n     Municipal Corporation of Delhi have<br \/>\n     filed   an\t  affidavit   in   these<br \/>\n     proceedings.   According\tto   the<br \/>\n     affidavit, Municipal Corporation of<br \/>\n     Delhi has\tdivided the  area  under<br \/>\n     its charge\t into 12  zones for  the<br \/>\n     purposes of  collection of garbage.<br \/>\n     It is further stated that there are<br \/>\n     1804 garbage  collection points  in<br \/>\n     the   said\t   area.   The\t garbage<br \/>\n     collection\t  points    consist   of<br \/>\n     dhalaos, open sights and steelbins.<br \/>\n     Similarly,\t the   area  under   the<br \/>\n     control of\t NDMC has  been\t divided<br \/>\n     into 13  zones where  there are 944<br \/>\n     collection Points\t394 arr\t masonry<br \/>\n     dustbins and  500 are  trolies.  It<br \/>\n     cannot   be   disputed   that   the<br \/>\n     collection and  disposal of garbage<br \/>\n     in the  city of  Delhi  is\t causing<br \/>\n     serious\t problem.      Statutory<br \/>\n     authorities like  MCD and NDMC have<br \/>\n     been  created   to\t  control   this<br \/>\n     problem. It  is not  for this Court<br \/>\n     to\t  keep\t on   monitoring   these<br \/>\n     problems.\tThe   officers\twho  arc<br \/>\n     manning  these   institutions  must<br \/>\n     realize their  responsibilities and<br \/>\n     show the  end result.  Keeping that<br \/>\n     in view,  we  issue  the  following<br \/>\n     directions :\n<\/p><\/blockquote>\n<blockquote><p>     (1) We  adjourn the hearing of this<br \/>\n     petition to  October 12,  1995.  On<br \/>\n     that day,\tthe petitioner and other<br \/>\n     learned counsel  shall assist  this<br \/>\n     Court   regarding\t the   statutory<br \/>\n     duties  and  functions  of\t various<br \/>\n     authorities  in   regard\tto   the<br \/>\n     sanitation in the city of Delhi.<br \/>\n     (2)   During   this   period,   the<br \/>\n     officers  who  are\t concerned  with<br \/>\n     this  problem  shall  consider  the<br \/>\n     various  issues   arising\tin  this<br \/>\n     petition, at  their own  level  and<br \/>\n     shall    give     the     following<br \/>\n     information to  this Court\t on  the<br \/>\n     next date of hearing :\n<\/p><\/blockquote>\n<blockquote><p>\t  (a) final  date by which there<br \/>\n     officers\/authorities shall sort out<br \/>\n     the  problem   of\tcollection   and<br \/>\n     disposal of the garbage in the city<br \/>\n     of Delhi.\tIn that respect, we make<br \/>\n     it clear  that from  the date which<br \/>\n     may be  given by these authorities.<br \/>\n     not a drop of garbage is to be seen<br \/>\n     anywhere in  the city  of Delhi  on<br \/>\n     early morning  each day.  The whole<br \/>\n     of the  work of  garbage collection<br \/>\n     must be  completed\t over-night  and<br \/>\n     the city  is to  be left absolutely<br \/>\n     clean for\tthe residents  for their<br \/>\n     use;\n<\/p><\/blockquote>\n<blockquote><p>\t  (b) the  authorities\tmay,  if<br \/>\n     they so  wish,  place  before  this<br \/>\n     Court the\tdifficulties  which  are<br \/>\n     likely to\tcome up\t in  their  way.<br \/>\n     This Court\t with the  assistance of<br \/>\n     authorities concerned- shall try to<br \/>\n     solve the same.\n<\/p><\/blockquote>\n<blockquote><p>\t  We  make  it\tclear  that  any<br \/>\n     direction\tfinally\t given\tby  this<br \/>\n     Court  after  hearing  the\t parties<br \/>\n     shall be  binding and  violation of<br \/>\n     any part  of it  shall attract  the<br \/>\n     provisions\t of   the  Contempt   of<br \/>\n     Courts Act.\n<\/p><\/blockquote>\n<blockquote><p>\t  Issues notice to the Secretary<br \/>\n     (Health),\t Delhi\t Administration,<br \/>\n     specially\tfor   the  purposes   of<br \/>\n     seeking\tassistance     regarding<br \/>\n     nursing homes  and hospitals  under<br \/>\n     the      control\t   of\t   Delhi<br \/>\n     Administration.  To  be  listed  on<br \/>\n     October 12, 1995.&#8221;<\/p><\/blockquote>\n<p>     Pursuant to  the above  quoted order  Commander  Mukesh<br \/>\nPaul, Medical  Officer of  Health, NDMC\t has filed affidavit<br \/>\ndated October  10, 1995.  It is stated in the affidavit that<br \/>\nlack of civic sense, lack of dustbins, absenteeism among the<br \/>\nstaff,\tlogistic   problems,  multiplicity  of\tauthorities,<br \/>\ndisposal of  house hold garbage by the servants, problems of<br \/>\nJhuggi Jhompri Clusters, floating population and for various<br \/>\nother reasons,\tit is not possible to give the time schedule<br \/>\nregarding the  cleaning of  Delhi as directed by this Court.<br \/>\nVarious\t  steps\t   taken   by\t the   NDMC    to    improve<br \/>\nsanitation\/garbage disposal  have also\tbeen  indicated.  An<br \/>\nadditional affidavit  filed by\tShri Anshu Prakash on behalf<br \/>\nof NDNC\t indicates that\t the following\tmeasures for  speedy<br \/>\nremoval\t of   garbage  and   for  maintenance  of  effective<br \/>\nsanitation have been undertaken:- .1s1<br \/>\n     a. Strengthening of Safaikaramchari<br \/>\n     workforce.\n<\/p>\n<p>     b Lifting and removal of garbage.\n<\/p>\n<p>     c.\t Regular   inspection  by  Nodal<br \/>\n     Officers.\n<\/p>\n<p>     d. Manning of Dhalaos.\n<\/p>\n<p>     e. Door  to door collection and NGO<br \/>\n     participation.\n<\/p>\n<p>     Mr. C.P. Gupta filed affidavit dated October 17,1995 on<br \/>\nbehalf of MCD wherein he stated as under :-\n<\/p>\n<blockquote><p>     &#8220;It is,  therefore, submitted  that<br \/>\n     no specific  date for  making Delhi<br \/>\n     &#8216;absolutely  garbage   free&#8217;  every<br \/>\n     morning can be given at this stage.<br \/>\n     Nevertheless,  the\t  endeavors   of<br \/>\n     M.C.D.  would  be\tto  achieve  the<br \/>\n     spirit of the orders passed by this<br \/>\n     Hon&#8217;ble Court.&#8221;<\/p><\/blockquote>\n<p>     Under Secretary,  Ministry\t of  Health,  Government  of<br \/>\nIndia in  his affidavit has stated that Safdarjung hospital,<br \/>\nRam Manohar  Lohia hospital and Lady Harding Medical college<br \/>\ncomprising Kalavati  hospital and  Sucheta Kriplani Hospital<br \/>\nare under  the control\tand supervision\t of the\t Ministry of<br \/>\nHealth,\t Government   of  India.   Safdarjung  hospital\t has<br \/>\ninstalled incinerator  with waste  disposal capacity  of 230<br \/>\nkgs per\t hour. The  said hospital  generates about 2000-2500<br \/>\nkgs of\twaste everyday.\t It is\tstated that  the incinerator<br \/>\nfunctions in  two shifts  for 10 hours for 7 days a week. It<br \/>\nis not\tclear from  the affidavit whether the incinerator is<br \/>\nin working  condition or  out of order. The affidavit states<br \/>\nthat  three   vertical\ttype  incinerators  have  also\tbeen<br \/>\ninstalled by  the Safdarjung hospital. Incinerators have not<br \/>\nbeen installed\tin the\tother hospitals.  It is\t stated that<br \/>\nproposal to  install incinerators  in RML  hospital and Lady<br \/>\nHarding Medical College is under consideration.\n<\/p>\n<p>     According to  the affidavit filed by Mrs. Satbir Silas,<br \/>\nJoint Secretary\t (Medical and  Public Health)  Government to<br \/>\nNational Capital  Territory of Delhi, there are 13 hospitals<br \/>\nwhich  are   functioning  under\t the  control  of  the\tsaid<br \/>\nGovernment. Lok\t Nayak Jai  Parkash Narain  Hospital has  no<br \/>\nincinerator of\tits own. It is using the incinerator located<br \/>\nin G.B.\t Pant hospital.\t There is an incinerator in Guru Teg<br \/>\nBahadur Hospital  with capacity\t of 125\t kg  per  hour.\t The<br \/>\nincinerator is not enough to burn the entire hospital waste.<br \/>\nIt is  stated that  second incinerator\tat the cost of Rs.44<br \/>\nlakhs  is  likely  to  be  installed.  Deen  Dayal  Upadhyay<br \/>\nHospital has  installed\t an  incinerator  with\tcapacity  of<br \/>\nburning 85  kg of  waste per  hour. It\tis stated  that\t the<br \/>\nincinerator is\tmeeting the  need of the hospital. G.B. Pant<br \/>\nHospital has  two incinerators\twith capacity of 60 kg each.<br \/>\nThere are  no incinerators in Civil Hospital, Nehru Memorial<br \/>\nMedical College,  Guru Nanak Eye Centre, Lal Bahadur Shastri<br \/>\nHospital Rao  Tulla Ram Memorial Hospital and Dr. N.C. Joshi<br \/>\nMemorial Hospital.  The three  remaining hospitals,  namely,<br \/>\nBabu Jagjivan  Ram Memorial Hospital, Sanjay Gandhi Memorial<br \/>\nhospital and  Maulana Azad  Medical College  have  installed<br \/>\nincinerators.\n<\/p>\n<p>     Mr. C.B.  Gupta has  filed further\t affidavit  (second)<br \/>\ndated November 6, 1995 on behalf of MCD wherein it is stated<br \/>\nthat  on  experimental\tbasis,\tinitially  MCD\tproposes  to<br \/>\nintroduce the  scheme  of  supplying  plastic  bags  to\t the<br \/>\nresidents of  Janakpuri, Shalimar  Bagh, Jangpura Extension,<br \/>\nPreet Vihar, Sarita Vihar, Derawal Nagar and Jain Colony. It<br \/>\nis stated  by the learned counsel appearing for the MCD that<br \/>\nthe administration  is more  than willing  to  take  up\t the<br \/>\nchallenge of cleaning the city in the right earnest.\n<\/p>\n<p>     The NDMC  has also\t filed a proposed scheme which is in<br \/>\nthe following terms:\n<\/p>\n<blockquote><p>     &#8220;That   the   NDMC\t  as   per   the<br \/>\n     directions of  this  Hon&#8217;ble  Court<br \/>\n     intends to\t improve sanitation in a<br \/>\n     step-wise\tmanner.\t  Step\tI  shall<br \/>\n     comprise\t of\tsweeping     the<br \/>\n     roads\/streets,    collection     of<br \/>\n     garbage   and    its   storage   at<br \/>\n     designated and  identified\t places.<br \/>\n     Step II  shall comprise  of lifting<br \/>\n     of\t   the\t   garbage    and    its<br \/>\n     transportation   to    the\t  M.C.D.<br \/>\n     dumping site  at Gazipur.\tNDMC  is<br \/>\n     also utilising  part of its garbage<br \/>\n     and    horticulture    waste    for<br \/>\n     conversion into  manure at\t Compost<br \/>\n     at Okhla.\n<\/p><\/blockquote>\n<blockquote><p>\t  Regarding Step  I, as directed<br \/>\n     by the  Hon&#8217;ble Court, the NDMC has<br \/>\n     selected for  intensive  sanitation<br \/>\n     the    following\t compact    area<br \/>\n     consisting\t of   the  area\t  around<br \/>\n     Parliament\/Supreme\t Court,\t Central<br \/>\n     Vista   lawns   and   Circle   No.6<br \/>\n     starting from  the\t entire\t Rajpath<br \/>\n     upto  National  Stadium,  C-Hexagan<br \/>\n     Road, Sher\t Shah Road  cutting  the<br \/>\n     mathura   Road   upto   Subramaniam<br \/>\n     Bharati Marg  upto\t Southend  Road,<br \/>\n     Aurangzeb Road, Moti Lal Nehru Marg<br \/>\n     including\t Maulana    Azad   Road,<br \/>\n     Sunehri Masjid.  On the other hand,<br \/>\n     site from\tNational Stadium to part<br \/>\n     of C-Hexagan,  Central  Vista  Lawn<br \/>\n     and  also\t two  important\t markets<br \/>\n     i.e., Connaught  Place and Sarojini<br \/>\n     Nagar Located in NDMC area. Besides<br \/>\n     the    important\t buildings    as<br \/>\n     mentioned\tabove,\tthere  are  1076<br \/>\n     houses in\tPandara Road and Pandara<br \/>\n     Park including M.S. flats. Ravinder<br \/>\n     Nagar has got 124 flats. Bapa Nagar<br \/>\n     has  got\t102  flats.   Rest   big<br \/>\n     bungalows\tare  there.  The  Circle<br \/>\n     No.6 also\tincludes the JJ clusters<br \/>\n     at Humayun\t Road and Darbanga House<br \/>\n     and also the Khan Market, Lok Nayak<br \/>\n     Bhawan,   Pandara\t  Road\t Market,<br \/>\n     Prithvi Raj  Market. The  following<br \/>\n     number of\tmajor restaurants\/hotels<br \/>\n     are existing in this circle:\n<\/p><\/blockquote>\n<blockquote><p>     (i)   Five Star Hotel\t  1\n<\/p><\/blockquote>\n<blockquote><p>     (ii)  Three Star Hotel\t  1\n<\/p><\/blockquote>\n<blockquote><p>     (iii) Restaurants\t\t 20<br \/>\n     It is  proposed to\t deploy the work<br \/>\n     force  in\t night\tshift  also  for<br \/>\n     effective garbage\tremoval\t in  the<br \/>\n     area. Each and every household will<br \/>\n     be given  polythene bag for garbage<br \/>\n     collection and  each household will<br \/>\n     be\t expected   to\tplace  the  bags<br \/>\n     filled with  garbage at  designated<br \/>\n     collection\t   points.    In    J.J.<br \/>\n     Clusters,\tthe   garbage  will   be<br \/>\n     collected\tat   collection\t  points<br \/>\n     designated for this purpose, it may<br \/>\n     not be feasible give polythene bags<br \/>\n     for   each\t   jhuggi.    Additional<br \/>\n     collection\t points\t  will\tbe  made<br \/>\n     wherever  necessary   to  suit  the<br \/>\n     convenience of  the public. All the<br \/>\n     collection points\tin the aforesaid<br \/>\n     areas    will     be    effectively<br \/>\n     supervised by  NDMC staff to ensure<br \/>\n     that garbage is not littered around<br \/>\n     the collection points.\n<\/p><\/blockquote>\n<blockquote><p>\t  Initially the\t polythene  bags<br \/>\n     will be  given free  of cost to the<br \/>\n     residents of  aforesaid  areas  for<br \/>\n     one month\tby NDMC\t on experimental<br \/>\n     basis.  Thereafter\t the  supply  of<br \/>\n     bags at subsidised cost may also be<br \/>\n     considered by  the NDMC.  NDMC  has<br \/>\n     started door  to door collection of<br \/>\n     garbage in\t polythene bags supplied<br \/>\n     by NDMC  in certain colonies in the<br \/>\n     aforesaid\t areas.\t  It   will   be<br \/>\n     gradually\t extended    to\t   other<br \/>\n     colonies also  in consultation with<br \/>\n     the resident associations. The NDMC<br \/>\n     will also\tmake efforts to find out<br \/>\n     if any  better alternative\t to  the<br \/>\n     polythene bags  could  be\tprovided<br \/>\n     for  this\t purpose.  Other   State<br \/>\n     Governments,      Ministry\t      of<br \/>\n     Environment, etc. will be contacted<br \/>\n     in this regard.&#8221;<\/p><\/blockquote>\n<p>     It would  be useful  to mention that the MCD has a very<br \/>\nlarge force  of Karamcharies working for it. There are 38311<br \/>\nSafai Karamcharis.  The MCD  has  more\tthan  1400  Sanitary<br \/>\nInspectors and\tother officials\t in that category. The total<br \/>\narea which  the MCD  is supposed  to keep  clean and tidy is<br \/>\n1399.26 Sq.Km. The simple arithmetic shows that there are 27<br \/>\nSafai Karamcharis  and one Sanitary Inspector for one Sq.Km.<br \/>\nof area.  We are of the view that with such a large manpower<br \/>\nat its\tdisposal there can be no excuse with the MCD for not<br \/>\ncontrolling the\t disposal of  garbage and  keeping the\tcity<br \/>\nclean. The  NDMC is  still in a better position. It has 2172<br \/>\nSafai Karamcharis  and the  area under\tits control is 42.40<br \/>\nSq.Km. which  means that  it has  50 Karamcharis  to wan one<br \/>\nSq.Km. There  is no  reason whatsoever\twhy with such a huge<br \/>\nmanpower at  their command the MCD and NDMC cannot present a<br \/>\nneat and clean Delhi to its residents.\n<\/p>\n<p>     The MCD  and NDMC\thave already  started door  to\tdoor<br \/>\ncollection of  garbage on   experimental basis. It is stated<br \/>\nthat polythene\tbags  are  also\t being\tdistributed  in\t the<br \/>\nselected areas.\t We make it clear that the modalities in our<br \/>\ninterim orders\tfrom time to time have been in the nature of<br \/>\nsuggestions. We,  however, reiterate  that the\tMCD and\t the<br \/>\nNDMC must  keep the city clean by deploying all the means at<br \/>\ntheir disposal.\t We are\t issuing binding  directions in this<br \/>\nrespect in the operative part of the judgment.\n<\/p>\n<p>     It would  be  useful  at  this  stage  to\texamine\t the<br \/>\nrelevant provisions of the Delhi Act.\n<\/p>\n<blockquote><p>     &#8220;42, Obligatory  functions\t of  the<br \/>\n     Corporation-   [Subject\tto   the<br \/>\n     provisions\t of  this  Act\tand  any<br \/>\n     other law\tfor the\t time  being  it<br \/>\n     shall   be\t   incumbent]\ton   the<br \/>\n     Corporation   to\t make\tadequate<br \/>\n     provision by  any means or measures<br \/>\n     which it  may lawfully use or take,<br \/>\n     for each  of the following matters,<br \/>\n     namely:\n<\/p><\/blockquote>\n<blockquote><p>     (a) the  construction,  maintenance<br \/>\n     and cleaning of drains and drainage<br \/>\n     works  and\t  of  public   latrines,<br \/>\n     urinals and similar conveniences;\n<\/p><\/blockquote>\n<blockquote><p>     (c)  the  scavenging,  removal  and<br \/>\n     disposal  of   filth,  rubbish  and<br \/>\n     other   obnoxious\t  or\tpolluted<br \/>\n     matters;\n<\/p><\/blockquote>\n<blockquote><p>     (e) the  reclamation  of  unhealthy<br \/>\n     localities, the  removal of noxious<br \/>\n     vegetation\t  and\t generally   the<br \/>\n     abatement of all nuisances;\n<\/p><\/blockquote>\n<blockquote><p>     (o)  the\tlighting,  watering  and<br \/>\n     cleaning  of   public  streets  and<br \/>\n     other public places;\n<\/p><\/blockquote>\n<blockquote><p>     (t)   the\t laying\t  out\tor   the<br \/>\n     maintenance   of\t public\t  parks,<br \/>\n     gardens or recreation grounds,<br \/>\n     (wa) the  preparation of  plans for<br \/>\n     economic  development   and  social<br \/>\n     justice.\n<\/p><\/blockquote>\n<blockquote><p>     43. Discretionary\tfunctions of the<br \/>\n     Corporation &#8211;\n<\/p><\/blockquote>\n<blockquote><p>     (b)    the\t    establishment    and<br \/>\n     maintenance   of,\t and   aid,   to<br \/>\n     libraries, museums,  art galleries,<br \/>\n     botanical\t     or\t      zoological<br \/>\n     collections;\n<\/p><\/blockquote>\n<blockquote><p>     (c)    the\t    establishment    and<br \/>\n     maintenance of, and aid, to stadia,<br \/>\n     gymnasia, akharas\tand  places  for<br \/>\n     sports and games;\n<\/p><\/blockquote>\n<blockquote><p>     (d) the  planting and care of trees<br \/>\n     on roadsides and elsewhere;\n<\/p><\/blockquote>\n<blockquote><p>     (i) the providing of music or other<br \/>\n     entertainments in\tpublic places or<br \/>\n     places of\tpublic\tresort\tand  the<br \/>\n     establishment   of\t  theaters   and<br \/>\n     cinemas;\n<\/p><\/blockquote>\n<pre>     (1)    the\t    construction     and\n     maintenance of\n     i) rest - houses,\n     ii) poor-houses,\n     iii) infirmaries,\n     iv) children's homes,\n<\/pre>\n<blockquote><p>     v) houses for the deaf and dumb and<br \/>\n     for   disabled    and   handicapped<br \/>\n     children,\n<\/p><\/blockquote>\n<blockquote><p>     vi)  shelters   for  destitute  and<br \/>\n     disabled persons,\n<\/p><\/blockquote>\n<blockquote><p>     vii) asylums for persons of unsound<br \/>\n     mind;\n<\/p><\/blockquote>\n<blockquote><p>     (q) the  provision\t for  relief  to<br \/>\n     destitute and disabled persons;\n<\/p><\/blockquote>\n<blockquote><p>     (s) the organization, construction,<br \/>\n     maintenance   and\t management   of<br \/>\n     swimming pools, public wash houses,<br \/>\n     bathing\tplaces\t   and\t   other<br \/>\n     institutions   designed   for   the<br \/>\n     improvement of public health;<br \/>\n     (z)  the\tprovisions  of\t housing<br \/>\n     accommodation for\tthe  inhabitants<br \/>\n     of any  area or  for any  class  of<br \/>\n     inhabitants; and<br \/>\n     (za) any  measure not  hereinbefore<br \/>\n     specifically mentioned,  likely  to<br \/>\n     promote  public   safety,\t health,<br \/>\n     convenience or general welfare.<br \/>\n     59 Functions  of the  Commissioner-<br \/>\n     Save as  otherwise provided in this<br \/>\n     Act, the entire executive power for<br \/>\n     the purpose  of  carrying\tout  the<br \/>\n     provisions of  this Act  and of any<br \/>\n     other Act\tfor the\t time  being  in<br \/>\n     force which  confers, any\tpower or<br \/>\n     imposes\tany    duty    on    the<br \/>\n     Corporation,  shall   vest\t in  the<br \/>\n     Commissioner who shall also-<br \/>\n     107A.   Constitution   of\t Finance<br \/>\n     Commission- (1)  The  Administrator<br \/>\n     shall, as\tsoon as\t may be,  within<br \/>\n     one year  from the\t commencement of<br \/>\n     the   Constitution\t  (Seventy-third<br \/>\n     Amendment) Act, 1992 and thereafter<br \/>\n     at the  expiration of  every  fifth<br \/>\n     year    constitute\t    a\t Finance<br \/>\n     Commission to  review the financial<br \/>\n     position of  the Corporation and to<br \/>\n     make   recommendations    to    the<br \/>\n     Administrator as to, &#8211;\n<\/p><\/blockquote>\n<blockquote><p>     (a)  The\tprinciple  which  should<br \/>\n     govern,-\n<\/p><\/blockquote>\n<blockquote><p>\t  (i) the  distribution\t between<br \/>\n     the National  Capital Territory  of<br \/>\n     Delhi and\tthe Corporation\t of  the<br \/>\n     net proceeds  of the taxes, duties,<br \/>\n     tolls  and\t fees  leviable\t by  the<br \/>\n     National Capital Territory of Delhi<br \/>\n     which may be divided between them;\n<\/p><\/blockquote>\n<blockquote><p>\t  (ii) the  determination of the<br \/>\n     taxes, duties  tolls and fees which<br \/>\n     may be  assigned to or appropriated<br \/>\n     by the Corporation;\n<\/p><\/blockquote>\n<blockquote><p>\t  (iii) the grants-in-aid to the<br \/>\n     Corporation from  the  consolidated<br \/>\n     fund  of\tthe   National\t Capital<br \/>\n     Territory of Delhi.\n<\/p><\/blockquote>\n<blockquote><p>     108. Constitution of special funds-\n<\/p><\/blockquote>\n<blockquote><p>     (1)    The\t   Corporation\t  shall,<br \/>\n     constitute\t such  special\tfund  or<br \/>\n     funds  as\t may  be  prescribed  by<br \/>\n     regulations and  such  other  funds<br \/>\n     necessary for  the purposes of this<br \/>\n     Act as may be so prescribed.<br \/>\n     (2) The  constitution and\tdisposal<br \/>\n     of such  funds shall be effected in<br \/>\n     the    manner    laid    down    by<br \/>\n     regulations.\n<\/p><\/blockquote>\n<blockquote><p>     353.Duty of owners and occupiers to<br \/>\n     collect and  deposit rubbish,  etc.<br \/>\n     It shall  be the duty of the owners<br \/>\n     and occupiers of all premises &#8211;\n<\/p><\/blockquote>\n<blockquote><p>\t  (a) to have the premises swept<br \/>\n     and cleaned;\n<\/p><\/blockquote>\n<blockquote><p>\t  (b)  to   cause   all\t  filth,<br \/>\n     rubbish  and   other  polluted  and<br \/>\n     obnoxious matter  to  be  collected<br \/>\n     from their\t respective premises and<br \/>\n     to be  deposited at  such times  as<br \/>\n     the Commissioner,\tby public notice<br \/>\n     prescribes, in  public receptacles,<br \/>\n     depots  or\t  places   provided   or<br \/>\n     appointed under section 352 for the<br \/>\n     temporary deposit or final disposal<br \/>\n     thereof;\n<\/p><\/blockquote>\n<blockquote><p>\t  (c) to  provide receptacles of<br \/>\n     the  type\t and   in   the\t  manner<br \/>\n     prescribed by  the Commissioner for<br \/>\n     the  collection   therein\tof   all<br \/>\n     filth, rubbish  and other\tpolluted<br \/>\n     and  obnoxious   matter  from  such<br \/>\n     premises\tand    to   keep    such<br \/>\n     receptacles in  good condition  and<br \/>\n     repair.\n<\/p><\/blockquote>\n<blockquote><p>     354.  Collection\tand  removal  of<br \/>\n     filth and\tpolluted matter-It shall<br \/>\n     be\t the   duty  of\t the  owner  and<br \/>\n     occupier of  every premises situate<br \/>\n     in any  portion of\t Delhi in  which<br \/>\n     there is  not a  latrine, or urinal<br \/>\n     connected\tby   a\tdrain\twith   a<br \/>\n     municipal drain, to cause all filth<br \/>\n     and polluted  and obnoxious  matter<br \/>\n     accumulation upon\tsuch premises to<br \/>\n     be collected  and\tremoved\t to  the<br \/>\n     nearest   receptacle    or\t   depot<br \/>\n     provided  for  this  purpose  under<br \/>\n     section 352  at such times, in such<br \/>\n     vehicle or vessel by such route and<br \/>\n     with  such\t  precautions\tas   the<br \/>\n     Commissioner may  by public  notice<br \/>\n     prescribe.\n<\/p><\/blockquote>\n<blockquote><p>     356.Removal   of\trubbish,   etc.,<br \/>\n     accumulated  on  premises\tused  as<br \/>\n     factories,\t workshops   etc.   -The<br \/>\n     Commissioner may, if he thinks fit,\n<\/p><\/blockquote>\n<blockquote><p>     (a) by  written notice  require the<br \/>\n     owner or  occupier of  any premises<br \/>\n     used   for\t   carrying    on    any<br \/>\n     manufacture, trade\t or business  or<br \/>\n     used as  factory,\tworkshop,  trade<br \/>\n     premises or market or in any way so<br \/>\n     that  rubbish,   filth  and   other<br \/>\n     polluted and  obnoxious matter  are<br \/>\n     accumulated in large quantities, to<br \/>\n     collect all such rubbish, filth and<br \/>\n     other polluted and obnoxious matter<br \/>\n     accumulating thereon  and to remove<br \/>\n     the same  at such times and in such<br \/>\n     carts or  receptacles and\tby  such<br \/>\n     routes as\tmay be\tspecified in the<br \/>\n     notice to a depot or place provided<br \/>\n     or appointed under section 352, or\n<\/p><\/blockquote>\n<blockquote><p>     (b)  after\t giving\t such  owner  or<br \/>\n     occupier notice  of his  intention,<br \/>\n     cause all\trubbish, filth and other<br \/>\n     polluted\tand   obnoxious\t  matter<br \/>\n     accumulated in  such premises to be<br \/>\n     removed, and  charge the said owner<br \/>\n     or occupier  for such  removal such<br \/>\n     fee as  may, with\tthe sanction  of<br \/>\n     the    Standing\tCommittee,    be<br \/>\n     specified\tin   the  notice  issued<br \/>\n     under clause (a)\n<\/p><\/blockquote>\n<blockquote><p>     357.      Prohibition\t against<br \/>\n     accumulation of  rubbish, etc.-  No<br \/>\n     owner or  occupier of  any premises<br \/>\n     shall keep\t or allow to be kept for<br \/>\n     more  than\t twenty\t four  hours  or<br \/>\n     otherwise\t than\t in   receptacle<br \/>\n     approved by  the Commissioner,  any<br \/>\n     rubbish, filth  and other\tpolluted<br \/>\n     and  obnoxious   matter   on   such<br \/>\n     premises  or  any\tplace  belonging<br \/>\n     thereto or neglect to employ proper<br \/>\n     means to remove such rubbish, filth<br \/>\n     and other\tpolluted  and  obnoxious<br \/>\n     matter  from,  or\tto  clean,  such<br \/>\n     receptacle and  to dispose\t of such<br \/>\n     rubbish, filth  and other\tpolluted<br \/>\n     and obnoxious  matter in the manner<br \/>\n     directed by  the  Commissioner,  or<br \/>\n     fail to comply with any requisition<br \/>\n     of\t the   Commissioner  as\t to  the<br \/>\n     construction,  repair,  payment  or<br \/>\n     cleaning of  any latrine, or urinal<br \/>\n     on or belonging to the premises.\n<\/p><\/blockquote>\n<blockquote><p>     465. General  penalty-  Whoever  in<br \/>\n     any case  in which a penalty is not<br \/>\n     expressly\tprovided  by  this  act,<br \/>\n     fails to  comply with  any\t notice,<br \/>\n     order or  requisition issued  under<br \/>\n     any provision thereof, or otherwise<br \/>\n     contravenes any of the provision of<br \/>\n     this Act  shall be\t punishable with<br \/>\n     fine  which   may\textend\t to  one<br \/>\n     hundred rupees  and in  the case of<br \/>\n     continuing failure or contravention<br \/>\n     with an  additional fine  which may<br \/>\n     extend to\ttwenty rupees  for every<br \/>\n     day after the first during which he<br \/>\n     has persisted  in\tthe  failure  or<br \/>\n     contravention.\n<\/p><\/blockquote>\n<blockquote><p>     469. Municipal magistrates- (1) The<br \/>\n     Government may  appoint one or more<br \/>\n     [Metropolitan Magistrates]\t for the<br \/>\n     trial of  offences against this act<br \/>\n     and against any rule, regulation or<br \/>\n     bye-law  made  thereunder\tand  may<br \/>\n     prescribe the  time  and  place  at<br \/>\n     which    such     magistrate     or<br \/>\n     magistrates  shall\t  sit  for   the<br \/>\n     despatch of business.\n<\/p><\/blockquote>\n<blockquote><p>     486. Inspection   &#8211;   The\t Central<br \/>\n     Government [or  the Government] may<br \/>\n     depute any person in the service of<br \/>\n     government to  inspect  or\t examine<br \/>\n     any municipal  department or office<br \/>\n     or any  service or\t work undertaken<br \/>\n     by the  Corporation or  any of  the<br \/>\n     Municipal\t authorities\tor   any<br \/>\n     property\tbelong\t  in   got   the<br \/>\n     Corporation and  to report\t thereon<br \/>\n     and  the\tCorporation  and   every<br \/>\n     municipal\t authority    and    all<br \/>\n     municipal\t officers    and   other<br \/>\n     municipal employees  shall be bound<br \/>\n     to afford\tthe  person  so\t deputed<br \/>\n     access at\tall reasonable\ttimes to<br \/>\n     the premises  and properties of the<br \/>\n     Corporation  and  to  all\trecords,<br \/>\n     accounts and  other  documents  the<br \/>\n     inspection of which he may consider<br \/>\n     necessary\t to    enable\thim   to<br \/>\n     discharge his duties.\n<\/p><\/blockquote>\n<blockquote><p>     487.    Directions\t   by\t Central<br \/>\n     Government &#8211;  (1)\tIf  [whether  or<br \/>\n     receipt of\t a report  or on receipt<br \/>\n     of]  any\tinformation  or\t  report<br \/>\n     obtained  under   section\t485   of<br \/>\n     section  486   or\totherwise,   the<br \/>\n     Central Government is of opinion &#8211;\n<\/p><\/blockquote>\n<blockquote><p>     (a) that  any duty\t imposed on  the<br \/>\n     Corporation   or\t any   municipal<br \/>\n     authority by  or under this Act has<br \/>\n     not  been\tperformed  or  has  been<br \/>\n     performed\t  in\tan    imperfect,<br \/>\n     insufficient or  unsuitable manner,<br \/>\n     or\n<\/p><\/blockquote>\n<blockquote><p>     (b)   that\t   adequate    financial<br \/>\n     provision has not been made for the<br \/>\n     performance of  any such  duty,  it<br \/>\n     may direct\t the Corporation  or the<br \/>\n     municipal\t authority    concerned,<br \/>\n     within such  period  as  it  thinks<br \/>\n     fit, to  make  arrangements  to  it<br \/>\n     satisfaction   for\t   the\t  proper<br \/>\n     performance of  the duty, or as the<br \/>\n     case  may\tbe,  to\t make  financial<br \/>\n     provision to  its satisfaction  for<br \/>\n     the performance of the duty and the<br \/>\n     Corporation   or\t the   municipal<br \/>\n     authority\tconcerned  shall  comply<br \/>\n     with such direction.\n<\/p><\/blockquote>\n<blockquote><p>\t  Provided that,  unless in  the<br \/>\n     opinion of\t the Central  Government<br \/>\n     the  immediate  execution\tof  such<br \/>\n     order is necessary, it shall before<br \/>\n     making  any  direction  under  this<br \/>\n     section give the Corporation or the<br \/>\n     municipal\tauthority  concerned  an<br \/>\n     opportunity of  showing  cause  why<br \/>\n     such direction should not be made\n<\/p><\/blockquote>\n<blockquote><p>     488.Power\t  to\t provide     for<br \/>\n     enforcement  of   direction   under<br \/>\n     section 487-  If, within the period<br \/>\n     fixed by  a  direction  made  under<br \/>\n     sub-section (1) of section 487, any<br \/>\n     action the taking of which has been<br \/>\n     directed under that sub section has<br \/>\n     not been  duly taken,  the\t Central<br \/>\n     Government\t may  make  arrangements<br \/>\n     for the  taking of\t such action and<br \/>\n     may  direct   that\t  all\texpenses<br \/>\n     connected\t therewith    shall   be<br \/>\n     defrayed  out   of\t the   Municipal<br \/>\n     Fund.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>     Similarly, NDMC  is governed  by  the  New\t Delhi\tAct.\n<\/p><\/blockquote>\n<p>Sections 11,  12, 53, 261, 263, 264, 265, 266, 267 &amp; 375 are<br \/>\nsome of the provisions of the New Delhi Act which are pari<br \/>\nmateria to  the relevant  provisions of the Delhi Act. It is<br \/>\nclear from  various provisions\tof the Delhi Act and the New<br \/>\nDelhi Act that the MCD and the NDMC are under a statutory<br \/>\nobligation to  scavenge and  clean the\tcity of Delhi. It is<br \/>\nmandatory for  these authorities  to collect  and dispose of<br \/>\nthe garbage\/waste  generated from  various  sources  in\t the<br \/>\ncity. We  have no  hesitation in  observing that the MCD and<br \/>\nthe NDMC have been wholly remiss in the performance of their<br \/>\nstatutory duties. Apart from the rights guaranteed under the<br \/>\nConstitution the  residents of\tDelhi have a statutory right<br \/>\nto live\t in a  clean  city.  The  courts  are  justified  in<br \/>\ndirecting the MCD and NDMC to perform their duties under the<br \/>\nlaw. Non  availability of  funds, inadequacy or inefficiency<br \/>\nof the\tstaff, insufficiency  of machinery  etc.  cannot  be<br \/>\npleaded as  grounds for\t non-performance of  their statutory<br \/>\nobligations .\n<\/p>\n<p>     <a href=\"\/doc\/440471\/\">In Ratlam\tMunicipality vs.  Vardhichand  AIR<\/a>  1980  SC<br \/>\n1622, the  question before  this Court was whether the order<br \/>\nof the trial court as upheld by the High Court directing the<br \/>\nRatlam Municipality  to draft  a plan  within six months for<br \/>\nthe removal of nuisance caused by the open drains and public<br \/>\nexcretion by  the nearby  slum dwellers\t could be sustained.<br \/>\nThis Court  speaking through  Krishna Iyer,J.  dismissed the<br \/>\nappeal of the municipality and held as under:\n<\/p>\n<blockquote><p>\t  &#8220;Why drive  common  people  to<br \/>\n     public   interest\t action?   Where<br \/>\n     Directive\tPrinciples   have  found<br \/>\n     statutory expression  in  Do&#8217;s  and<br \/>\n     Dont&#8217;s the\t court will not sit idly<br \/>\n     by and  allow municipal  government<br \/>\n     to become\ta statutory mockery. The<br \/>\n     law will  relentlessly be\tenforced<br \/>\n     and the  plea of  poor finance will<br \/>\n     be poor alibi when people in misery<br \/>\n     cry for  justice. The  dynamics  of<br \/>\n     the  judicial  process  has  a  new<br \/>\n     &#8216;enforcement&#8217; dimension  not merely<br \/>\n     through some  of the  provisions of<br \/>\n     the  Criminal  Procedure  Code  (as<br \/>\n     here), but\t also through  activated<br \/>\n     tort consciousness. The officers in<br \/>\n     charge   and   even   the\t elected<br \/>\n     representatives will  have to  face<br \/>\n     the penalty  of the law if what the<br \/>\n     Constitution     and      follow-up<br \/>\n     legislation direct\t them to  do are<br \/>\n     defied or\tdefied\twrongfully.  The<br \/>\n     wages of  violation is  punishment,<br \/>\n     corporate and personal.&#8221;\n<\/p><\/blockquote>\n<p>Reminding the  State Government\t of  its  duties  under\t the<br \/>\nConstitution of India, Krishna Iyer, J. observed as under:-\n<\/p>\n<blockquote><p>     &#8220;We  are\tsure  that   the   State<br \/>\n     Government will  make available  by<br \/>\n     way of  loans or  grants sufficient<br \/>\n     financial\t aid   to   the\t  Ratlam<br \/>\n     Municipality to enable it to fulfil<br \/>\n     its obligations  under this  order.<br \/>\n     The State will realise that Art. 47<br \/>\n     makes it  a paramount  principle of<br \/>\n     governance\t that  steps  are  taken<br \/>\n     &#8216;for  the\t improvement  of  public<br \/>\n     health  as\t  amongst  its\t primary<br \/>\n     duties&#8217;. The municipality also will<br \/>\n     slim its  budget  on  low\tpriority<br \/>\n     items and\telitist projects  to use<br \/>\n     the  savings   on\tsanitation   and<br \/>\n     public  health.   It  is\tnot  our<br \/>\n     intention that  the ward  which has<br \/>\n     woken up  to its  rights alone need<br \/>\n     be\t  afforded    these   elementary<br \/>\n     facilities. We expect all the wards<br \/>\n     to\t    be\t   benefited\t without<br \/>\n     litigation.&#8221;<\/p><\/blockquote>\n<p>     In the  light of  the facts  and circumstances  noticed<br \/>\nabove and  also keeping\t in view the suggestions made by the<br \/>\nlearned counsel\t assisting us in this petition, we issue the<br \/>\nfollowing directions:-\n<\/p>\n<p>1. We  approve the  experimental schemes  placed before this<br \/>\nCourt by  MCD and  NDMC whereunder  certain localities\thave<br \/>\nbeen selected  for distribution\t of polythene  bags, door to<br \/>\ndoor collection of garbage and its disposal.\n<\/p>\n<p>     We direct\tthe MCD through Commissioner appointed under<br \/>\nSection 54  of the  Delhi Act  and all other officers of the<br \/>\nMCD (particularly  Mr. Narang  and  Mr.\t Tirath\t Raj.  Joint<br \/>\nDirectors) to  have the\t city of Delhi scavenged and cleaned<br \/>\neveryday. The  garbage\/waste shall be lifted from collection<br \/>\ncenters every  day and\ttransported to\tthe designated place<br \/>\nfor disposal.\n<\/p>\n<p>     All recepticals\/collection\t centers shall be kept clean<br \/>\nand tidy  everyday. The\t garbage\/rubbish shall\tnot be found<br \/>\nspread around the collection centers and on the roads.\n<\/p>\n<p>     We issue  similar directions to the NDMC through S\/Shri<br \/>\nBaleshwar Rai,\tAdministrator,\tLal  Chand,  Chief  Sanitary<br \/>\nInspector, Dr.G.S.  Thind, Deputy  Medical Officer of Health<br \/>\nand Dr. V.N. Reu, Chief Medical Officer.\n<\/p>\n<p>2.   We\t direct\t Government  of\t India,\t through  Secretary,<br \/>\nMinistry of Health, Government of National Capital Territory<br \/>\nof Delhi through Secretary, medical and Public Health, MCD<br \/>\nthrough its  Commissioner and NDMC through its Administrator<br \/>\nto  construct\tand  install   incinerators   in   all\t the<br \/>\nhospitals\/nursing homes, with 50 beds and above, under their<br \/>\nadministrative control.\t This may  be done preferably within<br \/>\nnine  months.\tA  responsible\tofficer\t of  each  of  these<br \/>\nauthorities shall file an affidavit in this Court within two<br \/>\nmonths indicating the progress made in this respect.\n<\/p>\n<p>3.   We direct\tthe All India Institute of Medical Sciences,<br \/>\nNew Delhi  through its Director to install sufficient number<br \/>\nof incinerators,  or  an  equally  effective  alternate,  to<br \/>\ndispose of  the hospital  waste.   to indicate\tthe progress<br \/>\nmade in this respect.\n<\/p>\n<p>4.   We direct\tthe MCD and NDMC to issue notices to all the<br \/>\nprivate hospitals\/nursing  homes in  Delhi to make their own<br \/>\narrangements for  the disposal of their garbage and hospital<br \/>\nwaste. They be asked to construct their own incinerators. In<br \/>\ncase these  hospitals are  permitted to\t use facilities (for<br \/>\ncollection, transportation and disposal of garbage) provided<br \/>\nby the\tMCD and\t NDMC then they may be asked to pay suitable<br \/>\ncharges for the service rendered in accordance with law.\n<\/p>\n<p>5.   We direct\tthe Central  Pollution Control Board and the<br \/>\nDelhi Pollution\t Committee to  regularly send its inspection<br \/>\nteams in  different areas  of Delhi\/New\t Delhi to  ascertain<br \/>\nthat  the   collection,\t transportation\t  and  disposal\t  of<br \/>\ngarbage\/waste is  carried out  satisfactorily. The Board and<br \/>\nthe Committee shall file the reports in this Court by way of<br \/>\nan affidavit  after every  two months  for a  period of\t two<br \/>\nyears.\n<\/p>\n<p>6.   We\t direct\t the  Government  of  the  National  Capital<br \/>\nTerritory  of\tDelhi  to   appoint  Municipal\t Magistrates<br \/>\n(Metropolitan Magistrates)  under Section  469 of  the Delhi<br \/>\nAct and\t Section 375  of the  New Delhi Act for the trial of<br \/>\noffence under  these Acts.  Residents of  Delhi be  educated<br \/>\nthrough Doordarshan  and by  way  of  announcements  in\t the<br \/>\nlocalities that\t they shall  be liable\tfor penalty  in case<br \/>\nthey violate  any provisions  of the  Act in  the matter  of<br \/>\ncollecting and disposal of garbage and other wastes.\n<\/p>\n<p>7.   We direct\tthe Doordarshan through its Director General<br \/>\nto undertake a programme of educating the residents of Delhi<br \/>\nregarding their civic duties under the Delhi Act and the New<br \/>\nDelhi  Act.   This  shall  be  done  by\t making\t appropriate<br \/>\nannouncements, displays\t on the television. The residents of<br \/>\nDelhi  shall   be  educated  regarding\ttheir  duties  under<br \/>\nSections 354,  356 and\t357 of\tthe Delhi  Act\tand  similar<br \/>\nduties under  the New Delhi Act. They shall also be informed<br \/>\nabout the  penalties which  can be imposed under Section 465<br \/>\nof Delhi Act and similar provisions under the New Delhi Act.<br \/>\nThe MCD\t and the  NDMC shall also have announcements made by<br \/>\nway of\tpublic address\tsystem in  various  areas  in  Delhi<br \/>\ninforming the  residents of  their  duties  and\t obligations<br \/>\nunder the Delhi Act and the New Delhi Act.\n<\/p>\n<p>8.   The MCD  has placed  order for  the supply of about 200<br \/>\nTippers\t with\tthe  Ordinance\t Vehicle  Factory,  Jabalpur<br \/>\n(Government of\tIndia) in May, 1995. The Tippers have not as<br \/>\nyet been  supplied. We direct Secretary, Ministry of Defence<br \/>\nProduction, Government of India to have the Tippers supplied<br \/>\nto the\tMCD as\texpeditiously  as  possible  and  preferably<br \/>\nwithin three  months. The  Secretary shall file an affidavit<br \/>\nin this\t Court within six weeks indicating the progress made<br \/>\nin this respect.\n<\/p>\n<p>9.   The MCD has indicated that three SLF sites have already<br \/>\nbeen approved  by the Technical Committee of the DDA but the<br \/>\nsame have not been handed over to the MCD by the Development<br \/>\nCommissioner, Government of NCT of Delhi. Since Bhatti mines<br \/>\nare situated  within the  ridge area,  we do  not permit the<br \/>\nsame to\t be utilised  for the disposal of the solid waste as<br \/>\nat   present.\t We,   however,\t  direct   the\t Development<br \/>\nCommissioner, Government  of NCT  Delhi to hand over the two<br \/>\nsites, near  Badarpur on Jaitpur\/Tejpur Quiry Pits and Mandi<br \/>\nvillage near  Jaunpur Quiry  Pits. The sites shall be handed<br \/>\nover  to  the  MCD  within  three  months.  The\t Development<br \/>\nCommissioner shall  file an  affidavit in  this Court before<br \/>\nMarch 31, 1996 indicating the progress made in this respect.\n<\/p>\n<p>10.  The compost  plant at  Okhla be  revived and  put\tinto<br \/>\noperation. The\tMCD shall  start operating the plant, if not<br \/>\nalready operating,  with effect\t from June  1, 1996. The MCD<br \/>\nshall also  examine  the  construction\tof  four  additional<br \/>\ncompost plants\tas recommended\tby Jag\tMohan Committee. The<br \/>\nMCD shall  file an  affidavit in this Court within six weeks<br \/>\nindicating  the\t progress  made\t in  re-starting  the  Okhla<br \/>\ncompost plant and in the construction of four new plants.\n<\/p>\n<p>11. The\t MCD shall  not use the filled-up SLFs for any other<br \/>\npurpose\t except\t  forestry.  There  are\t twelve\t such  sites<br \/>\nincluding Rajiv\t Gandhi Smriti\tVan. We\t direct the  MCD  to<br \/>\ndevelop forests\t and gardens  on these 12 sites. The work of<br \/>\nafforestation shall  be undertaken  by the  MCD with  effect<br \/>\nfrom April  1, 1996.  An affidavit shall be filed by the end<br \/>\nof April indicating the progress made in this respect.\n<\/p>\n<p>12.  The MCD  and NDMC\tshall  construct\/install  additional<br \/>\ngarbage\t   collection\t  centers    in\t   the\t  form\t  of<br \/>\ndhalaos\/trolley\/steelbins within  four months.\tAn affidavit<br \/>\nin this\t respect shall\tbe filed by a responsible officer of<br \/>\neach of\t these authorities  within two months indicating the<br \/>\nprogress.\n<\/p>\n<p>13.  We\t direct\t  the  Union   of  India   and\t NCT   Delhi<br \/>\nAdministration\t through    their   respective\t appropriate<br \/>\nSecretaries to\tconsider, the requests from MCD and NDMC for<br \/>\nfinancial assistance,  in a  just  and\tfair  manner.  These<br \/>\nGovernments shall consider the grant of financial assistance<br \/>\nto the MCD and NDMC by way of subvention or any other manner<br \/>\nto enable  these authorities  to  fulfil  their\t obligations<br \/>\nunder law as directed by us.\n<\/p>\n<p>14. After  some time  it may  not be  possible to dispose of<br \/>\ngarbage\t  and\tsolid-waste   by   &#8216;SLF&#8217;   method   due\t  to<br \/>\nnonavailability\t of   sites.  We   direct  the\t NCT   Delhi<br \/>\nAdministration through\tits Chief Secretary and also the MCD<br \/>\nand NDMC  to join hands and engage an expert body like NEERI<br \/>\nto find\t out alternate\tmethod\/methods of  garbage and solid<br \/>\nwaste disposal.\t The NCT  Delhi\t Administration\t shall\tfile<br \/>\naffidavit  in\tthis  Court  within  two  months  indicating<br \/>\nprogress made  in this\trespect modalities  in\tour  interim<br \/>\norders from  time  to  time  have  been\t in  the  nature  of<br \/>\nsuggestions. We,  however, reiterate  that the\tMCD and\t the<br \/>\nNDMC must  keep the city clean by deploying all the means at<br \/>\ntheir disposal.\t We are\t issuing binding  directions in this<br \/>\nrespect in the operative part of the judgment.\n<\/p>\n<p>     It would  be  useful  at  this  stage  to\texamine\t the<br \/>\nrelevant provisions of the Delhi Act.\n<\/p>\n<blockquote><p>     &#8220;42, Obligatory  functions\t of  the<br \/>\n     Corporation-   [Subject\tto   the<br \/>\n     provisions\t of  this  Act\tand  any<br \/>\n     other law\tfor the\t time  being  it<br \/>\n     shall   be\t   incumbent]\ton   the<br \/>\n     Corporation   to\t make\tadequate<br \/>\n     provision by  any means or measures<br \/>\n     which it  may lawfully use or take,<br \/>\n     for each  of the following matters,<br \/>\n     namely:\n<\/p><\/blockquote>\n<blockquote><p>\t  (a)\t  the\t   construction,<br \/>\n     maintenance and  cleaning of drains<br \/>\n     and drainage  works and  of  public<br \/>\n     latrines,\t urinals   and\t similar<br \/>\n     conveniences;\n<\/p><\/blockquote>\n<blockquote><p>\t  (c)  the  scavenging,\t removal<br \/>\n     and disposal  of filth, rubbish and<br \/>\n     other   obnoxious\t  or\tpolluted<br \/>\n     matters;\n<\/p><\/blockquote>\n<blockquote><p>\t  (e)\tthe    reclamation    of<br \/>\n     unhealthy localities,  the\t removal<br \/>\n     of noxious vegetation and generally<br \/>\n     the abatement of all nuisances;\n<\/p><\/blockquote>\n<blockquote><p>\t  (o) the lighting, watering and<br \/>\n     cleaning  of   public  streets  and<br \/>\n     other public places;\n<\/p><\/blockquote>\n<blockquote><p>\t  (t)  the  laying  out\t or  the<br \/>\n     maintenance   of\t public\t  parks,<br \/>\n     gardens or recreation grounds,<br \/>\n\t  (wa) the  preparation of plans<br \/>\n     for economic development and social<br \/>\n     justice.\n<\/p><\/blockquote>\n<blockquote><p>     43. Discretionary\tfunctions of the<br \/>\n     Corporation &#8211;\n<\/p><\/blockquote>\n<blockquote><p>\t  (b)  the   establishment   and<br \/>\n     maintenance   of,\t and   aid,   to<br \/>\n     libraries, museums,  art galleries,<br \/>\n     botanical\t     or\t      zoological<br \/>\n     collections;\n<\/p><\/blockquote>\n<blockquote><p>\t  (c)  the   establishment   and<br \/>\n     maintenance of, and aid, to stadia,<br \/>\n     gymnasia, akharas\tand  places  for<br \/>\n     sports and games;\n<\/p><\/blockquote>\n<blockquote><p>\t  (d) the  planting and\t care of<br \/>\n     trees on roadsides and elsewhere;\n<\/p><\/blockquote>\n<blockquote><p>\t  (i) the  providing of music or<br \/>\n     other  entertainments   in\t  public<br \/>\n     places or\tplaces of  public resort<br \/>\n     and the  establishment of\ttheaters<br \/>\n     and cinemas;\n<\/p><\/blockquote>\n<pre>     (1)    the\t    construction     and\n     maintenance of\n     i) rest - houses,\n     ii) poor-houses,\n     iii) infirmaries,\n     iv) children's homes,\n<\/pre>\n<blockquote><p>     v) houses for the deaf and dumb and<br \/>\n     for   disabled    and   handicapped<br \/>\n     children,\n<\/p><\/blockquote>\n<blockquote><p>     vi)  shelters   for  destitute  and<br \/>\n     disabled persons,\n<\/p><\/blockquote>\n<blockquote><p>     vii) asylums for persons of unsound<br \/>\n     mind;\n<\/p><\/blockquote>\n<blockquote><p>     (q) the  provision\t for  relief  to<br \/>\n     destitute and disabled persons;\n<\/p><\/blockquote>\n<blockquote><p>     (s) the organization, construction,<br \/>\n     maintenance   and\t management   of<br \/>\n     swimming pools, public wash houses,<br \/>\n     bathing\tplaces\t   and\t   other<br \/>\n     institutions   designed   for   the<br \/>\n     improvement of public health;<br \/>\n     (z)  the\tprovisions  of\t housing<br \/>\n     accommodation for\tthe  inhabitants<br \/>\n     of any  area or  for any  class  of<br \/>\n     inhabitants; and<br \/>\n     (za) any  measure not  hereinbefore<br \/>\n     specifically mentioned,  likely  to<br \/>\n     promote  public   safety,\t health,<br \/>\n     convenience or general welfare.\n<\/p><\/blockquote>\n<blockquote><p>     59. Functions  of the Commissioner-<br \/>\n     Save as  otherwise provided in this<br \/>\n     Act, the entire executive power for<br \/>\n     the purpose  of  carrying\tout  the<br \/>\n     provisions of  this Act  and of any<br \/>\n     other Act\tfor the\t time  being  in<br \/>\n     force which  confers, any\tpower or<br \/>\n     imposes\tany    duty    on    the<br \/>\n     Corporation,  shall   vest\t in  the<br \/>\n     Commissioner who shall also-<br \/>\n     107A.   Constitution   of\t Finance<br \/>\n     Commission- (1)  The  Administrator<br \/>\n     shall, as\tsoon as\t may be,  within<br \/>\n     one year  from the\t commencement of<br \/>\n     the   Constitution\t  (Seventy-third<br \/>\n     Amendment) Act, 1992 and thereafter<br \/>\n     at the  expiration of  every  fifth<br \/>\n     year    constitute\t    a\t Finance<br \/>\n     Commission to  review the financial<br \/>\n     position of  the Corporation and to<br \/>\n     make   recommendations    to    the<br \/>\n     Administrator as to, &#8211;\n<\/p><\/blockquote>\n<blockquote><p>     (a)  The\tprinciple  which  should<br \/>\n     govern,-\n<\/p><\/blockquote>\n<blockquote><p>\t  (i) the  distribution\t between<br \/>\n     the National  Capital Territory  of<br \/>\n     Delhi and\tthe Corporation\t of  the<br \/>\n     net proceeds  of the taxes, duties,<br \/>\n     tolls  and\t fees  leviable\t by  the<br \/>\n     National Capital Territory of Delhi<br \/>\n     which may be divided between them;\n<\/p><\/blockquote>\n<blockquote><p>\t  (ii) the  determination of the<br \/>\n     taxes, duties  tolls and fees which<br \/>\n     may be  assigned to or appropriated<br \/>\n     by the Corporation;\n<\/p><\/blockquote>\n<blockquote><p>\t  (iii) the grants-in-aid to the<br \/>\n     Corporation from  the  consolidated<br \/>\n     fund  of\tthe   National\t Capital<br \/>\n     Territory of Delhi.\n<\/p><\/blockquote>\n<blockquote><p>     108. Constitution of special funds-\n<\/p><\/blockquote>\n<blockquote><p>     (1)    The\t   Corporation\t  shall,<br \/>\n     constitute\t such  special\tfund  or<br \/>\n     funds  as\t may  be  prescribed  by<br \/>\n     regulations and  such  other  funds<br \/>\n     necessary for  the purposes of this<br \/>\n     Act as may be so prescribed.<br \/>\n     (2) The  constitution and\tdisposal<br \/>\n     of such  funds shall be effected in<br \/>\n     the    manner    laid    down    by<br \/>\n     regulations.\n<\/p><\/blockquote>\n<blockquote><p>     353.Duty of owners and occupiers to<br \/>\n     collect and  deposit rubbish,  etc.<br \/>\n     It shall  be the duty of the owners<br \/>\n     and occupiers of all premises &#8211;\n<\/p><\/blockquote>\n<blockquote><p>     (a) to  have the premises swept and<br \/>\n     cleaned;\n<\/p><\/blockquote>\n<blockquote><p>     (b) to cause all filth, rubbish and<br \/>\n     other polluted and obnoxious matter<br \/>\n     to\t  be\tcollected   from   their<br \/>\n     respective\t premises   and\t to   be<br \/>\n     deposited\tat  such  times\t as  the<br \/>\n     Commissioner,  by\t public\t  notice<br \/>\n     prescribes, in  public receptacles,<br \/>\n     depots  or\t  places   provided   or<br \/>\n     appointed under section 352 for the<br \/>\n     temporary deposit or final disposal<br \/>\n     thereof;\n<\/p><\/blockquote>\n<blockquote><p>     (c) to  provide receptacles  of the<br \/>\n     type and  in the  manner prescribed<br \/>\n     by\t  the\tCommissioner   for   the<br \/>\n     collection therein\t of  all  filth,<br \/>\n     rubbish  and   other  polluted  and<br \/>\n     obnoxious matter from such premises<br \/>\n     and to  keep  such\t receptacles  in<br \/>\n     good condition and repair.\n<\/p><\/blockquote>\n<blockquote><p>     354.  Collection\tand  removal  of<br \/>\n     filth and\tpolluted matter-It shall<br \/>\n     be\t the   duty  of\t the  owner  and<br \/>\n     occupier of  every premises situate<br \/>\n     in any  portion of\t Delhi in  which<br \/>\n     there is  not a  latrine, or urinal<br \/>\n     connected\tby   a\tdrain\twith   a<br \/>\n     municipal drain, to cause all filth<br \/>\n     and polluted  and obnoxious  matter<br \/>\n     accumulation upon\tsuch premises to<br \/>\n     be collected  and\tremoved\t to  the<br \/>\n     nearest   receptacle    or\t   depot<br \/>\n     provided  for  this  purpose  under<br \/>\n     section 352  at such times, in such<br \/>\n     vehicle or vessel by such route and<br \/>\n     with  such\t  precautions\tas   the<br \/>\n     Commissioner may  by public  notice<br \/>\n     prescribe.\n<\/p><\/blockquote>\n<blockquote><p>     356.Removal   of\trubbish,   etc.,<br \/>\n     accumulated  on  premises\tused  as<br \/>\n     factories,\t workshops   etc.   -The<br \/>\n     Commissioner may, if he thinks fit,\n<\/p><\/blockquote>\n<blockquote><p>     (a) by  written notice  require the<br \/>\n     owner or  occupier of  any premises<br \/>\n     used   for\t   carrying    on    any<br \/>\n     manufacture, trade\t or business  or<br \/>\n     used as  factory,\tworkshop,  trade<br \/>\n     premises or market or in any way so<br \/>\n     that  rubbish,   filth  and   other<br \/>\n     polluted and  obnoxious matter  are<br \/>\n     accumulated in large quantities, to<br \/>\n     collect all such rubbish, filth and<br \/>\n     other polluted and obnoxious matter<br \/>\n     accumulating thereon  and to remove<br \/>\n     the same  at such times and in such<br \/>\n     carts or  receptacles and\tby  such<br \/>\n     routes as\tmay be\tspecified in the<br \/>\n     notice to a depot or place provided<br \/>\n     or appointed under section 352, or\n<\/p><\/blockquote>\n<blockquote><p>     (b)  after\t giving\t such  owner  or<br \/>\n     occupier notice  of his  intention,<br \/>\n     cause all\trubbish, filth and other<br \/>\n     polluted\tand   obnoxious\t  matter<br \/>\n     accumulated in  such premises to be<br \/>\n     removed, and  charge the said owner<br \/>\n     or occupier  for such  removal such<br \/>\n     fee as  may, with\tthe sanction  of<br \/>\n     the    Standing\tCommittee,    be<br \/>\n     specified\tin   the  notice  issued<br \/>\n     under clause (a)\n<\/p><\/blockquote>\n<blockquote><p>     357.      Prohibition\t against<br \/>\n     accumulation of  rubbish, etc.-  No<br \/>\n     owner or  occupier of  any premises<br \/>\n     shall keep\t or allow to be kept for<br \/>\n     more  than\t twenty\t four  hours  or<br \/>\n     otherwise\t than\t in   receptacle<br \/>\n     approved by  the Commissioner,  any<br \/>\n     rubbish, filth  and other\tpolluted<br \/>\n     and  obnoxious   matter   on   such<br \/>\n     premises  or  any\tplace  belonging<br \/>\n     thereto or neglect to employ proper<br \/>\n     means to remove such rubbish, filth<br \/>\n     and other\tpolluted  and  obnoxious<br \/>\n     matter  from,  or\tto  clean,  such<br \/>\n     receptacle and  to dispose\t of such<br \/>\n     rubbish, filth  and other\tpolluted<br \/>\n     and obnoxious  matter in the manner<br \/>\n     directed by  the  Commissioner,  or<br \/>\n     fail to comply with any requisition<br \/>\n     of\t the   Commissioner  as\t to  the<br \/>\n     construction,  repair,  payment  or<br \/>\n     cleaning of  any latrine, or urinal<br \/>\n     on or belonging to the premises.\n<\/p><\/blockquote>\n<blockquote><p>     465. General  penalty-  Whoever  in<br \/>\n     any case  in which a penalty is not<br \/>\n     expressly\tprovided  by  this  act,<br \/>\n     fails to  comply with  any\t notice,<br \/>\n     order or  requisition issued  under<br \/>\n     any provision thereof, or otherwise<br \/>\n     contravenes any of the provision of<br \/>\n     this Act  shall be\t punishable with<br \/>\n     fine  which   may\textend\t to  one<br \/>\n     hundred rupees  and in  the case of<br \/>\n     continuing failure or contravention<br \/>\n     with an  additional fine  which may<br \/>\n     extend to\ttwenty rupees  for every<br \/>\n     day after the first during which he<br \/>\n     has persisted  in\tthe  failure  or<br \/>\n     contravention.\n<\/p><\/blockquote>\n<blockquote><p>     469. Municipal magistrates- (1) The<br \/>\n     Government may  appoint one or more<br \/>\n     [Metropolitan Magistrates]\t for the<br \/>\n     trial of  offences against this act<br \/>\n     and against any rule, regulation or<br \/>\n     bye-law  made  thereunder\tand  may<br \/>\n     prescribe the  time  and  place  at<br \/>\n     which    such     magistrate     or<br \/>\n     magistrates  shall\t  sit  for   the<br \/>\n     despatch of business.\n<\/p><\/blockquote>\n<blockquote><p>     486. Inspection   &#8211;   The\t Central<br \/>\n     Government [or  the Government] may<br \/>\n     depute any person in the service of<br \/>\n     government to  inspect  or\t examine<br \/>\n     any municipal  department or office<br \/>\n     or any  service or\t work undertaken<br \/>\n     by the  Corporation or  any of  the<br \/>\n     Municipal\t authorities\tor   any<br \/>\n     property\tbelong\t  in   got   the<br \/>\n     Corporation and  to report\t thereon<br \/>\n     and  the\tCorporation  and   every<br \/>\n     municipal\t authority    and    all<br \/>\n     municipal\t officers    and   other<br \/>\n     municipal employees  shall be bound<br \/>\n     to afford\tthe  person  so\t deputed<br \/>\n     access at\tall reasonable\ttimes to<br \/>\n     the premises  and properties of the<br \/>\n     Corporation  and  to  all\trecords,<br \/>\n     accounts and  other  documents  the<br \/>\n     inspection of which he may consider<br \/>\n     necessary\t to    enable\thim   to<br \/>\n     discharge his duties.\n<\/p><\/blockquote>\n<blockquote><p>     487.    Directions\t   by\t Central<br \/>\n     Government &#8211;  (1)\tIf  [whether  or<br \/>\n     receipt of\t a report  or on receipt<br \/>\n     of]  any\tinformation  or\t  report<br \/>\n     obtained  under   section\t485   of<br \/>\n     section  486   or\totherwise,   the<br \/>\n     Central Government is of opinion &#8211;\n<\/p><\/blockquote>\n<blockquote><p>     (a) that  any duty\t imposed on  the<br \/>\n     Corporation   or\t any   municipal<br \/>\n     authority by  or under this Act has<br \/>\n     not  been\tperformed  or  has  been<br \/>\n     performed\t  in\tan    imperfect,<br \/>\n     insufficient or  unsuitable manner,<br \/>\n     or\n<\/p><\/blockquote>\n<blockquote><p>     (b)   that\t   adequate    financial<br \/>\n     provision has not been made for the<br \/>\n     performance of  any such  duty,  it<br \/>\n     may direct\t the Corporation  or the<br \/>\n     municipal\t authority    concerned,<br \/>\n     within such  period  as  it  thinks<br \/>\n     fit, to  make  arrangements  to  it<br \/>\n     satisfaction   for\t   the\t  proper<br \/>\n     performance of  the duty, or as the<br \/>\n     case  may\tbe,  to\t make  financial<br \/>\n     provision to  its satisfaction  for<br \/>\n     the performance of the duty and the<br \/>\n     Corporation   or\t the   municipal<br \/>\n     authority\tconcerned  shall  comply<br \/>\n     with such direction.\n<\/p><\/blockquote>\n<blockquote><p>\t  Provided that,  unless in  the<br \/>\n     opinion of\t the Central  Government<br \/>\n     the  immediate  execution\tof  such<br \/>\n     order is necessary, it shall before<br \/>\n     making  any  direction  under  this<br \/>\n     section give the Corporation or the<br \/>\n     municipal\tauthority  concerned  an<br \/>\n     opportunity of  showing  cause  why<br \/>\n     such direction should not be made\n<\/p><\/blockquote>\n<blockquote><p>     488.Power\t  to\t provide     for<br \/>\n     enforcement  of   direction   under<br \/>\n     section 487-  If, within the period<br \/>\n     fixed by  a  direction  made  under<br \/>\n     sub-section (1) of section 487, any<br \/>\n     action the taking of which has been<br \/>\n     directed under that sub section has<br \/>\n     not been  duly taken,  the\t Central<br \/>\n     Government\t may  make  arrangements<br \/>\n     for the  taking of\t such action and<br \/>\n     may  direct   that\t  all\texpenses<br \/>\n     connected\t therewith    shall   be<br \/>\n     defrayed  out   of\t the   Municipal<br \/>\n     Fund.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>     Similarly, NDMC  is governed  by  the  New\t Delhi\tAct.\n<\/p><\/blockquote>\n<p>Sections 11,  12, 53, 261, 263, 264, 265, 266, 267 &amp; 375 are<br \/>\nsome of the provisions of the New Delhi Act which are pari<br \/>\nmateria to  the relevant  provisions of the Delhi Act. It is<br \/>\nclear from  various provisions\tof the Delhi Act and the New<br \/>\nDelhi Act that the MCD and the NDMC are under a statutory<br \/>\nobligation to  scavenge and  clean the\tcity of Delhi. It is<br \/>\nmandatory for  these authorities  to collect  and dispose of<br \/>\nthe garbage\/waste  generated from  various  sources  in\t the<br \/>\ncity. We  have no  hesitation in  observing that the MCD and<br \/>\nthe NDMC have been wholly remiss in the performance of their<br \/>\nstatutory duties. Apart from the rights guaranteed under the<br \/>\nConstitution the  residents of\tDelhi have a statutory right<br \/>\nto live\t in a  clean  city.  The  courts  are  justified  in<br \/>\ndirecting the MCD and NDMC to perform their duties under the<br \/>\nlaw. Non  availability of  funds, inadequacy or inefficiency<br \/>\nof the\tstaff, insufficiency  of machinery  etc.  cannot  be<br \/>\npleaded as  grounds for\t non-performance of  their statutory<br \/>\nobligations .\n<\/p>\n<p>     <a href=\"\/doc\/440471\/\">In Ratlam\tMunicipality vs.  Vardhichand  AIR<\/a>  1980  SC<br \/>\n1622, the  question before  this Court was whether the order<br \/>\nof the trial court as upheld by the High Court directing the<br \/>\nRatlam Municipality  to draft  a plan  within six months for<br \/>\nthe removal of nuisance caused by the open drains and public<br \/>\nexcretion by  the nearby  slum dwellers\t could be sustained.<br \/>\nThis Court  speaking through  Krishna Iyer,J.  dismissed the<br \/>\nappeal of the municipality and held as under:\n<\/p>\n<blockquote><p>     &#8220;Why drive\t common people to public<br \/>\n     interest  action?\tWhere  Directive<br \/>\n     Principles\t have\tfound  statutory<br \/>\n     expression in  Do&#8217;s and  Dont&#8217;s the<br \/>\n     court will\t not  sit  idly\t by  and<br \/>\n     allow   municipal\t government   to<br \/>\n     become a statutory mockery. The law<br \/>\n     will relentlessly\tbe enforced  and<br \/>\n     the plea  of poor\tfinance will  be<br \/>\n     poor alibi\t when people  in  misery<br \/>\n     cry for  justice. The  dynamics  of<br \/>\n     the  judicial  process  has  a  new<br \/>\n     &#8216;enforcement&#8217; dimension  not merely<br \/>\n     through some  of the  provisions of<br \/>\n     the  Criminal  Procedure  Code  (as<br \/>\n     here), but\t also through  activated<br \/>\n     tort consciousness. The officers in<br \/>\n     charge   and   even   the\t elected<br \/>\n     representatives will  have to  face<br \/>\n     the penalty  of the law if what the<br \/>\n     Constitution     and      follow-up<br \/>\n     legislation direct\t them to  do are<br \/>\n     defied or\tdefied\twrongfully.  The<br \/>\n     wages of  violation is  punishment,<br \/>\n     corporate and personal.&#8221;\n<\/p><\/blockquote>\n<p>Reminding the  State Government\t of  its  duties  under\t the<br \/>\nConstitution of India, Krishna Iyer, J. observed as under:-\n<\/p>\n<blockquote><p>     &#8220;We  are\tsure  that   the   State<br \/>\n     Government will  make available  by<br \/>\n     way of  loans or  grants sufficient<br \/>\n     financial\t aid   to   the\t  Ratlam<br \/>\n     Municipality to enable it to fulfil<br \/>\n     its obligations  under this  order.<br \/>\n     The State will realise that Art. 47<br \/>\n     makes it  a paramount  principle of<br \/>\n     governance\t that  steps  are  taken<br \/>\n     &#8216;for  the\t improvement  of  public<br \/>\n     health  as\t  amongst  its\t primary<br \/>\n     duties&#8217;. The municipality also will<br \/>\n     slim its  budget  on  low\tpriority<br \/>\n     items and\telitist projects  to use<br \/>\n     the  savings   on\tsanitation   and<br \/>\n     public  health.   It  is\tnot  our<br \/>\n     intention that  the ward  which has<br \/>\n     woken up  to its  rights alone need<br \/>\n     be\t  afforded    these   elementary<br \/>\n     facilities. We expect all the wards<br \/>\n     to\t    be\t   benefited\t without<br \/>\n     litigation.&#8221;<\/p><\/blockquote>\n<p>     In the  light of  the facts  and circumstances  noticed<br \/>\nabove and  also keeping\t in view the suggestions made by the<br \/>\nlearned counsel\t assisting us in this petition, we issue the<br \/>\nfollowing directions:-\n<\/p>\n<p>1. We  approve the  experimental schemes  placed before this<br \/>\nCourt by  MCD and  NDMC whereunder  certain localities\thave<br \/>\nbeen selected  for distribution\t of polythene  bags, door to<br \/>\ndoor collection of garbage and its disposal.\n<\/p>\n<p>     We direct\tthe MCD through Commissioner appointed under<br \/>\nSection 54  of the  Delhi Act  and all other officers of the<br \/>\nMCD (particularly  Mr. Narang  and  Mr.\t Tirath\t Raj.  Joint<br \/>\nDirectors) to  have the\t city of Delhi scavenged and cleaned<br \/>\neveryday. The  garbage\/waste shall be lifted from collection<br \/>\ncenters every  day and\ttransported to\tthe designated place<br \/>\nfor disposal.\n<\/p>\n<p>     All recepticals\/collection\t centers shall be kept clean<br \/>\nand tidy  everyday. The\t garbage\/rubbish shall\tnot be found<br \/>\nspread around the collection centers and on the roads.\n<\/p>\n<p>     We issue  similar directions to the NDMC through S\/Shri<br \/>\nBaleshwar Rai,\tAdministrator,\tLal  Chand,  Chief  Sanitary<br \/>\nInspector, Dr.G.S.  Thind, Deputy  Medical Officer of Health<br \/>\nand Dr. V.N. Reu, Chief Medical Officer.\n<\/p>\n<p>2.   We\t direct\t Government  of\t India,\t through  Secretary,<br \/>\nMinistry of Health, Government of National Capital Territory<br \/>\nof Delhi through Secretary, medical and Public Health, MCD<br \/>\nthrough its  Commissioner and NDMC through its Administrator<br \/>\nto  construct\tand  install   incinerators   in   all\t the<br \/>\nhospitals\/nursing homes, with 50 beds and above, under their<br \/>\nadministrative control.\t This may  be done preferably within<br \/>\nnine  months.\tA  responsible\tofficer\t of  each  of  these<br \/>\nauthorities shall file an affidavit in this Court within two<br \/>\nmonths indicating the progress made in this respect.\n<\/p>\n<p>3.   We direct\tthe All India Institute of Medical Sciences,<br \/>\nNew Delhi  through its Director to install sufficient number<br \/>\nof incinerators,  or  an  equally  effective  alternate,  to<br \/>\ndispose of  the hospital  waste.   to indicate\tthe progress<br \/>\nmade in this respect.\n<\/p>\n<p>4.   We direct\tthe MCD and NDMC to issue notices to all the<br \/>\nprivate hospitals\/nursing  homes in  Delhi to make their own<br \/>\narrangements for  the disposal of their garbage and hospital<br \/>\nwaste. They be asked to construct their own incinerators. In<br \/>\ncase these  hospitals are  permitted to\t use facilities (for<br \/>\ncollection, transportation and disposal of garbage) provided<br \/>\nby the\tMCD and\t NDMC then they may be asked to pay suitable<br \/>\ncharges for the service rendered in accordance with law.\n<\/p>\n<p>5.   We direct\tthe Central  Pollution Control Board and the<br \/>\nDelhi Pollution\t Committee to  regularly send its inspection<br \/>\nteams in  different areas  of Delhi\/New\t Delhi to  ascertain<br \/>\nthat  the   collection,\t transportation\t  and  disposal\t  of<br \/>\ngarbage\/waste is  carried out  satisfactorily. The Board and<br \/>\nthe Committee shall file the reports in this Court by way of<br \/>\nan affidavit  after every  two months  for a  period of\t two<br \/>\nyears.\n<\/p>\n<p>6.   We\t direct\t the  Government  of  the  National  Capital<br \/>\nTerritory  of\tDelhi  to   appoint  Municipal\t Magistrates<br \/>\n(Metropolitan Magistrates)  under Section  469 of  the Delhi<br \/>\nAct and\t Section 375  of the  New Delhi Act for the trial of<br \/>\noffence under  these Acts.  Residents of  Delhi be  educated<br \/>\nthrough Doordarshan  and by  way  of  announcements  in\t the<br \/>\nlocalities that\t they shall  be liable\tfor penalty  in case<br \/>\nthey violate  any provisions  of the  Act in  the matter  of<br \/>\ncollecting and disposal of garbage and other wastes.\n<\/p>\n<p>7.   We direct\tthe Doordarshan through its Director General<br \/>\nto undertake a programme of educating the residents of Delhi<br \/>\nregarding their civic duties under the Delhi Act and the New<br \/>\nDelhi  Act.   This  shall  be  done  by\t making\t appropriate<br \/>\nannouncements, displays\t on the television. The residents of<br \/>\nDelhi  shall   be  educated  regarding\ttheir  duties  under<br \/>\nSections 354,  356 and\t357 of\tthe Delhi  Act\tand  similar<br \/>\nduties under  the New Delhi Act. They shall also be informed<br \/>\nabout the  penalties which  can be imposed under Section 465<br \/>\nof Delhi Act and similar provisions under the New Delhi Act.<br \/>\nThe MCD\t and the  NDMC shall also have announcements made by<br \/>\nway of\tpublic address\tsystem in  various  areas  in  Delhi<br \/>\ninforming the  residents of  their  duties  and\t obligations<br \/>\nunder the Delhi Act and the New Delhi Act.\n<\/p>\n<p>8.   The MCD  has placed  order for  the supply of about 200<br \/>\nTippers\t with\tthe  Ordinance\t Vehicle  Factory,  Jabalpur<br \/>\n(Government of\tIndia) in May, 1995. The Tippers have not as<br \/>\nyet been  supplied. We direct Secretary, Ministry of Defence<br \/>\nProduction, Government of India to have the Tippers supplied<br \/>\nto the\tMCD as\texpeditiously  as  possible  and  preferably<br \/>\nwithin three  months. The  Secretary shall file an affidavit<br \/>\nin this\t Court within six weeks indicating the progress made<br \/>\nin this respect.\n<\/p>\n<p>9.   The MCD has indicated that three SLF sites have already<br \/>\nbeen approved  by the Technical Committee of the DDA but the<br \/>\nsame have not been handed over to the MCD by the Development<br \/>\nCommissioner, Government of NCT of Delhi. Since Bhatti mines<br \/>\nare situated  within the  ridge area,  we do  not permit the<br \/>\nsame to\t be utilised  for the disposal of the solid waste as<br \/>\nat   present.\t We,   however,\t  direct   the\t Development<br \/>\nCommissioner, Government  of NCT  Delhi to hand over the two<br \/>\nsites, near  Badarpur on Jaitpur\/Tejpur Quiry Pits and Mandi<br \/>\nvillage near  Jaunpur Quiry  Pits. The sites shall be handed<br \/>\nover  to  the  MCD  within  three  months.  The\t Development<br \/>\nCommissioner shall  file an  affidavit in  this Court before<br \/>\nMarch 31, 1996 indicating the progress made in this respect.\n<\/p>\n<p>10.  The compost  plant at  Okhla be  revived and  put\tinto<br \/>\noperation. The\tMCD shall  start operating the plant, if not<br \/>\nalready operating,  with effect\t from June  1, 1996. The MCD<br \/>\nshall also  examine  the  construction\tof  four  additional<br \/>\ncompost plants\tas recommended\tby Jag\tMohan Committee. The<br \/>\nMCD shall  file an  affidavit in this Court within six weeks<br \/>\nindicating  the\t progress  made\t in  re-starting  the  Okhla<br \/>\ncompost plant and in the construction of four new plants.\n<\/p>\n<p>11. The\t MCD shall  not use the filled-up SLFs for any other<br \/>\npurpose\t except\t  forestry.  There  are\t twelve\t such  sites<br \/>\nincluding Rajiv\t Gandhi Smriti\tVan. We\t direct the  MCD  to<br \/>\ndevelop forests\t and gardens  on these 12 sites. The work of<br \/>\nafforestation shall  be undertaken  by the  MCD with  effect<br \/>\nfrom April  1, 1996.  An affidavit shall be filed by the end<br \/>\nof April indicating the progress made in this respect.\n<\/p>\n<p>12.  The MCD  and NDMC\tshall  construct\/install  additional<br \/>\ngarbage\t   collection\t  centers    in\t   the\t  form\t  of<br \/>\ndhalaos\/trolley\/steelbins within  four months.\tAn affidavit<br \/>\nin this\t respect shall\tbe filed by a responsible officer of<br \/>\neach of\t these authorities  within two months indicating the<br \/>\nprogress.\n<\/p>\n<p>13.  We\t direct\t  the  Union   of  India   and\t NCT   Delhi<br \/>\nAdministration\t through    their   respective\t appropriate<br \/>\nSecretaries to\tconsider, the requests from MCD and NDMC for<br \/>\nfinancial assistance,  in a  just  and\tfair  manner.  These<br \/>\nGovernments shall consider the grant of financial assistance<br \/>\nto the MCD and NDMC by way of subvention or any other manner<br \/>\nto enable  these authorities  to  fulfil  their\t obligations<br \/>\nunder law as directed by us.\n<\/p>\n<p>14. After  some time  it may  not be  possible to dispose of<br \/>\ngarbage\t  and\tsolid-waste   by   &#8216;SLF&#8217;   method   due\t  to<br \/>\nnonavailability\t of   sites.
