PATTANAIK\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     We have heard learned counsel on both sides.<br \/>\n     This appeals  by special  arises from  the judgment and<br \/>\norder passed  by the  Orissa Administrative Tribunal in O.A.<br \/>\nNo.340\/87 on  July 18, 1992. The respondent while working as<br \/>\nAssistant Conservator  of Forests  was compulsorily  retired<br \/>\nfrom service  by proceedings dated August 1, 1983 which came<br \/>\nto be challenged by the respondent in the above proceedings.<br \/>\nThe Tribunal  allowed the  application on three grounds; (1)<br \/>\nthe respondent was allowed to cross the efficiency bar; (ii)<br \/>\nsince he  was promoted, after the adverse remarks were made,<br \/>\nthe records  were wiped\t out; and  (iii) the  entire, record<br \/>\noverall consideration  thereof was not done  and, therefore,<br \/>\nthe exercise  of the  power of\tcompulsory retirement  under<br \/>\nSection 71(a) was not valid in law. The question is: whether<br \/>\nthe view  taken by  the Tribunal  is correct  in law&#8221;  It is<br \/>\nneedless to reiterate that the settled leal position is that<br \/>\nthe  Government\t is  empowered\tand  would  be\tentitled  to<br \/>\ncompulsorily retire  a Government servant in public interest<br \/>\nwith a\tview to\t improve efficiency of the administration or<br \/>\nto weed\t out the people of doubtful integrity or corrupt but<br \/>\nsufficiency evidence  was not available to take disciplinary<br \/>\naction in  accordance with  the rules  so as  to inculcate a<br \/>\nsense of  discipline in\t  the  service. But  the Government,<br \/>\nbefore taking  such decision to retire a Government employee<br \/>\ncompulsorily from  service,  have  to  consider\t the  entire<br \/>\nrecord\tof  the\t Government  servant  including\t the  latest<br \/>\nreports.\n<\/p>\n<p>     Rule 71  (a) of  the Orissa  Service Code\tempowers the<br \/>\nGovernment to do the needful and reads as under:\n<\/p>\n<blockquote><p>     &#8220;Rule-71(a) &#8211;  Except as  otherwise<br \/>\n     provided in  the other  clauses  of<br \/>\n     this rule\tthe date  of  compulsory<br \/>\n     retirement of a Government Servant,<br \/>\n     except a  ministerial  servant  who<br \/>\n     was in  Government service\t on  the<br \/>\n     31st  March,   1939  and  Class  IV<br \/>\n     Government servant,  is the date on<br \/>\n     which he  or she attains the age of<br \/>\n     50 years  subject o  the  condition<br \/>\n     that a review shall be conducted in<br \/>\n     respect of\t the Government\t servant<br \/>\n     in the 55th year of age in order to<br \/>\n     remain in service up to the date of<br \/>\n     the completion  of the  age  of  50<br \/>\n     years or  retired on completing the<br \/>\n     of 55 years in public interest.&#8221;<\/p><\/blockquote>\n<p>     A reading\tthereof would  indicate that  the Government<br \/>\nhas been  empowered, in the public interest, to compulsorily<br \/>\nretire a  Government servant  on his attaining the age of 50<br \/>\nyears or  on completion of 55 years by review of the service<br \/>\nrecord.\n<\/p>\n<p>     It is  seen that  though the  respondent has  contended<br \/>\nthat neither  the entire record of service was placed before<br \/>\nthe Review  Committee, nor  the Committee had gone into, nor<br \/>\nhad the\t advantage of it; and it considered only the adverse<br \/>\nremarks for  the years\t1980-81 and 1981-82 in the rejoinder<br \/>\naffidavit filed\t in this  Court, it  was specifically stated<br \/>\nthat the  entire record\t of service  from 1964-65 to 1981-82<br \/>\nand also the pending proceedings in the departmental enquiry<br \/>\nagainst\t the   respondent  were\t placed\t before\t the  Review<br \/>\nCommittee and  the same\t were duly  considered by  it. It is<br \/>\nalso seen that when the case was argued before the Tribunal,<br \/>\nthe copy  of proceedings  and report of the Review Committee<br \/>\nand record was produced. The Tribunal had also noted in para<br \/>\n5 of the order thus:\n<\/p>\n<blockquote><p>     &#8220;Learned\t Government\tAdvocate<br \/>\n     produced before  us a  copy of  the<br \/>\n     proceedings of the Review Committee<br \/>\n     meeting held  on 8.6.83. On perusal<br \/>\n     of\t the  same,  we\t find  that  the<br \/>\n     Committee\tperused\t  the\tC.C.Rs.,<br \/>\n     entries of\t the applicant\tand took<br \/>\n     consideration    the    allegations<br \/>\n     against  him  in  the  departmental<br \/>\n     proceedings on charges of misses of<br \/>\n     powers, suppression  of facts, etc.<br \/>\n     which were\t pending enquiry  before<br \/>\n     the Administrative\t Tribunal on the<br \/>\n     basis of  the aforesaid  materials,<br \/>\n     the committee felt that continuance<br \/>\n     of\t the   applicant  in  Government<br \/>\n     service  would  not  be  in  public<br \/>\n     interest\tand,   therefore,   they<br \/>\n     recommended  that\t he  should   be<br \/>\n     prematurely retired.&#8221;<\/p><\/blockquote>\n<p>     It is contended for the respondent that adverse entries<br \/>\nfor  the   two\tyears\treferred  to   earlier\tand  pending<br \/>\ndepartmental  proceedings   would  not\t be  sufficient\t  to<br \/>\ncompulsorily retire  the Government  servant on\t the premise<br \/>\nthat after  promotion they would become irrelevant and minor<br \/>\npenalty was  imposed. It is true that the Government servant<br \/>\nwas allowed  to cross  the efficiency  bar to  enable him to<br \/>\navail the  benefits  to\t draw  higher  scale  of  pay  after<br \/>\ncrossing the  efficiency bar.  The adverse  remarks made are<br \/>\nafter promotion.  Even otherwise,  the remarks\tform part of<br \/>\nservice record\tand character role. The record of enquiry on<br \/>\nconduct also  would be material. Though minor penalty may be<br \/>\nimposed\t on   given  facts   and  circumstances\t to  act  of<br \/>\nmisconduct, nevertheless  remains part\tof  the\t record\t for<br \/>\noverall\t consideration\t to  retire   a\t Government  servant<br \/>\ncompulsorily. The  object always  is  public  interest.\t The<br \/>\nmaterial question  is: whether\tthe entire record of service<br \/>\nwas considered\tor not?\t It is not for the court\/tribunal to<br \/>\nsee whether  the decision  of the Government to compulsorily<br \/>\nretire the Government servant is justified or not. It is for<br \/>\nthe Government\tto consider  the  same\tand  take  a  proper<br \/>\ndecision in  that behalf.  As stated  earlier, it is settled<br \/>\nlaw that  the Government  is required to consider the entire<br \/>\nrecord of  service Merely because a promotion has been given<br \/>\neven after  adverse entires were made, cannot be a ground to<br \/>\nnote that  compulsorily retirement of the Government servant<br \/>\ncould  not   be\t ordered.   The\t evidence  does\t not  become<br \/>\ninadmissible or\t irrelevant as\topined by the Tribunal. what<br \/>\nwould be  relevant is whether upon that state of record as a<br \/>\nreasonable prudent  man would  the Government  or  competent<br \/>\nofficer reach that decision. We find that self-same material<br \/>\nafter promotion\t may not be taken into consideration only to<br \/>\ndeny him  further  promotion,  if  any.\t But  that  material<br \/>\nundoubtedly would be available to the Government to consider<br \/>\nthe  overall   expediency  or\tnecessity  to  continue\t the<br \/>\nGovernment  servant  in\t   service  after  he  attained\t the<br \/>\nrequired length\t of service  or qualified  period of service<br \/>\nfor pension. It is also made clear that in this case adverse<br \/>\nentries were  made only\t after promotion  and not earlier to<br \/>\npromotion. Compulsory  retirement is not a punishment. He is<br \/>\nentitled to all the pensionary benefits.\n<\/p>\n<p>     Under these  circumstances, we  are of  the  considered<br \/>\nview that the Tribunal was wholly unjustified in interfering<br \/>\nwith the decision to retire the respondent compulsorily from<br \/>\nservice on the aforesaid grounds.\n<\/p>\n<p>     The  appeal   is  accordingly   allowed  but,   in\t the<br \/>\ncircumstances, without costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India State Of Orissa &amp; Ors vs Ram Chandra Das on 8 May, 1996 Bench: K.
