Justice K.K.DENESAN\n\n Dated :15\/02\/2007\n\n O R D E R\n                              K.K.DENESAN, J\n\n                     --------------------------------------------\n\n                      W.P.(C)NO. 34536 of 2006\n\n                     ---------------------------------------------\n\n\n\n           Dated this the 15th   day  of  February, 2007\n\n\n\n                                  JUDGMENT\n<\/pre>\n<p>      The petitioner retired 8 years ago from the post of Resurvey<\/p>\n<p>Superintendent.   It   is   alleged   that   about   10   years   ago,   one<\/p>\n<p>Kuriakose   assaulted   him   and   he   made   a   complaint   before   the<\/p>\n<p>police. Pursuant to the complaint lodged simultaneously with the<\/p>\n<p>departmental   authorities,   disciplinary   proceedings   were   taken<\/p>\n<p>against   the   above   named   Kuriakose   and   one   Krishnan   alleging<\/p>\n<p>misconduct   on   their   part.   They   were   found   guilty   in   the<\/p>\n<p>disciplinary   proceedings   and   the   penalty   of   barring     increment<\/p>\n<p>was inflicted on them.   Feeling aggrieved by the order imposing<\/p>\n<p>penalty,   they   invoked   the   statutory   remedies.     Ultimately,   the<\/p>\n<p>statutory   petition   filed   by   them   was   disposed   of   reducing   the<\/p>\n<p>penalty of barring of increment to that of censure. The petitioner<\/p>\n<p>says that he feels aggrieved by the order reducing the quantum<\/p>\n<p>of punishment and has got a right to demand that those who had<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.34536\/2006                                            :2:<\/span><\/p>\n<p>alleged   to   have   assaulted   him   should   not   get   the   benefit   of   a<\/p>\n<p>lenient   view   taken   by   the   statutory   authorities.   He   has<\/p>\n<p>approached this Court with   this writ petition for a   direction to<\/p>\n<p>the   sole respondent, namely, the Survey Director to dispose of<\/p>\n<p>Exts.P3 and P4 review petitions filed by him.\n<\/p>\n<p>        2.   The   petitioner   has   filed   copies   of   two   petitions   said   to<\/p>\n<p>have  been  filed  by  him  before   the  police  in  respect  of   the  very<\/p>\n<p>same   incident.   However,   he   does   not   know   what   happened   to<\/p>\n<p>those petitions. He has  not even cared to verify whether a crime<\/p>\n<p>case was registered and what exactly is the result of his lodging<\/p>\n<p>complaints before the police.\n<\/p>\n<p>        3.   For   two   reasons,   I   am   not   inclined   to   allow   the   prayer<\/p>\n<p>made   by   the   petitioner.   Neither   Krishnan   nor   Kuriakose   is   a<\/p>\n<p>respondent in this writ petition. The effect of allowing the prayer<\/p>\n<p>made   in   this   writ   petition   will   be   once   again   calling   upon   the<\/p>\n<p>above   named   persons   to   face   proceedings   which   have   become<\/p>\n<p>final.   The   respondent   has   put   a   quietus   to   the   departmental<\/p>\n<p>proceedings  by inflicting on the delinquent Officers, such penalty<\/p>\n<p>which according to the department was found appropriate in the<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.34536\/2006                                            :3:<\/span><\/p>\n<p>circumstances. In the absence of the above named persons, it is<\/p>\n<p>not     proper   for   this   court   to   examine   the   merits   of   the<\/p>\n<p>contentions of the petitioner. Hence, for non-impleadment of the<\/p>\n<p>necessary   parties,   this   writ   petition   must   fail.   Secondly,   in   a<\/p>\n<p>matter   of   this   nature,   the   defacto   complainant   has   no   locus<\/p>\n<p>standi to demand that the penalty imposed by the department on<\/p>\n<p>another   government servant shall be enhanced.     For these two<\/p>\n<p>reasons, this writ petition is liable to be dismissed. I do so.
