Misra and  Manoj<br \/>\nSwarup, Advs. for the Respondents.\n<\/p>\n<p>\t\t\t O R D E R<br \/>\n     The following Order of the Court was delivered:<br \/>\n     Delay condoned.\n<\/p>\n<p>     Leave granted.\n<\/p>\n<p>     This appeal  by special  leave arises from the judgment<br \/>\nof the\tHigh Court  of Allahabad, made on September 22, 1995<br \/>\nin Second  Appeal No.1959  of 1991. The admitted position is<br \/>\nthat Mahadeo  Prasad Vishwanath\t Prasad\t Girls\tHigh  School<br \/>\nHarraiya was functioning as an upgraded school from July 14,<br \/>\n1977. It  is the  case of  the first respondent that she was<br \/>\nappointed as  a teacher and therefore, she is entitled to be<br \/>\npermanent teacher  and therefore,  she\tis  entitled  to  be<br \/>\npermanent teacher  in the School with consequential benefits<br \/>\nas she was regularly appointed. The courts below granted the<br \/>\ndecree which  has been,\t on appeal,  confirmed by  the\tHigh<br \/>\nCourt. Thus, this appeal by special leave.\n<\/p>\n<p>     We directed  the respondents  to produce  the record of<br \/>\nthe returns  given by  the Management  with  regard  to\t the<br \/>\nteachers working  in the  institution after  the upgradation<br \/>\nw.e.f. July 14, 1977. The record have been placed before us.<br \/>\nThe records  indicate that for the year 1977-78 and 1978-79,<br \/>\nadmittedly, the\t name of  the first respondent does not find<br \/>\nplace. With  regard to\t1979-80, it  is seen  that  she\t was<br \/>\nworking against\t a leave  vacancy. On September 9, 1982, the<br \/>\napproval consisting  of 9  names in  respect of the teachers<br \/>\nworking in  the High School was given but it did not mention<br \/>\nthe name  of the first respondent. This factual position was<br \/>\nalso accepted  by the]\tDistrict Judge\tbut he held that she<br \/>\ncannot be  penaalised for  the mistake\tof the Management in<br \/>\nnot sending  the name  of the  first respondent.  We fail to<br \/>\nappreciate the view taken by the District Judge and approved<br \/>\nby the\tHigh Court  as correct. The official reports reflect<br \/>\nthe correct  state of  affairs. Since  the approval  of\t the<br \/>\nauthorities  is\t required  under  the]\tU.P.  Intermediation<br \/>\nEducation Act,\t1921, after upgradation of the school w.e.f.<br \/>\nJuly 14, 1977, it would be axiomatic that appointment of the<br \/>\nstaff working  in the  school  would  get  approved  by\t the<br \/>\ncompetent  authority.\tOtherwise,  the\t  same\t cannot\t  be<br \/>\nrecognised and\ttreated as  regular go\tas to be entitled to<br \/>\nreceive aid  from the  Government. It is not is dispute that<br \/>\nWrit Petition No.798\/1983 was filed by the respondent in the<br \/>\nHigh Court  claiming payment  of the  arrears of the salary.<br \/>\nThe Regional Inspectors of Girls School, Gorakhpur had filed<br \/>\nthe counter-affidavit  in  the\tHigh  Court  disputing\tthat<br \/>\ncorrectness of\ther status as she had been duly appointed by<br \/>\nthe Management.\t The Division  Bench of\t the High  Court  by<br \/>\norder dated  August 9, 1983 dismissed the Writ Petition with<br \/>\nthe observation as under:\n<\/p>\n<blockquote><p>     &#8220;In view  of the  averments made in<br \/>\n     paragraph No.5  and  6  of\t counter<br \/>\n     affidavit filed  on behalf\t of  the<br \/>\n     Regional\tInspectors    of   Girls<br \/>\n     Schools, we  find no  merit in  the<br \/>\n     writ petition.&#8221;<\/p><\/blockquote>\n<p>     It would,\tthus, be  seen that  the] contention  of the<br \/>\nfirst  respondent   that  she  was  duly  appointed  by\t the<br \/>\nManagement was not accepted by the High Court. Consequently,<br \/>\nthe claim for payment of the arrears of salary was rejected.<br \/>\nIn view\t of the\t above decision\t and in\t view of the records<br \/>\nplaced before  us, obviously,  the courts below have misread<br \/>\nthe documentary\t evidence and did not consider the effect of<br \/>\nthe Division  Bench judgment  of the  High Court. The single<br \/>\nJudge of  the High Court did not advert to the effect of the<br \/>\njudgment at  all on the ground that it was a finding of fact<br \/>\nand came  to the  conclusion that  the first  respondent was<br \/>\nduly appointed to the post of teacher.\n<\/p>\n<p>     The appeal\t is accordingly\t allowed. The  decree of the<br \/>\ncourts below as well as High Court judgment stand set aside.<br \/>\nThe suit stands dismissed.
