Sen Choudhary\n           For the U.O.I.            : Mr. Mokhtar Khan\n                              ---\n\n3. 4.02.2010<\/pre>\n<p>:    Mrs. Choudhary, appearing for the petitioner submitted that<br \/>\n           though the petitioner has challenged the order dated 27\/10.2008<br \/>\n           in this writ petition, but against such order an appeal has also<br \/>\n           been preferred by the petitioner before the Inspector General,<br \/>\n           North Frontier, Indo Tibetan Border Police force, Seemadwar,<br \/>\n           Dehradun (Respondent No. 3) through registered cover dated<br \/>\n           10.11.2003, but petitioner has not been received any order on the<br \/>\n           same till date and therefore, she confines her prayer for a<br \/>\n           direction for disposal of the appeal at an early date.\n<\/p>\n<p>                 Counsel for the respondents submitted that in the absence<br \/>\n           of instruction, he is not in a position to say whether such appeal<br \/>\n           has been received by the authority and\/or whether the appeal has<br \/>\n           been disposed of till date or not.\n<\/p>\n<p>                 In the circumstances, petitioner is permitted to file appeal<br \/>\n           afresh through speed post with A.D. before the respondent No. 3<br \/>\n           along with a copy of the earlier appeal and copy of this order.\n<\/p>\n<p>                 If any order has already been passed on the earlier appeal<br \/>\n           preferred by the petitioner, the same should be communicated to<br \/>\n           him. If no order has been passed in the earlier appeal, the<br \/>\n           respondent No. 3 will dispose of the same\/or fresh appeal in<br \/>\n           accordance with law, as early as possible and preferably within<br \/>\n           three months form the date of receipt of fresh appeal.\n<\/p>\n<p>                 It is made clear that this Court has not gone into the merits<br \/>\n           of the case of the petitioner.\n<\/p>\n<p>                 With these observations and directions, this writ petition is<br \/>\n           disposed of.\n<\/p>\n<pre>MK                                                      (R.
