ASTHAWAN,\n                       DISTRICT NALANDA.............RESPONDENTS\n\n                    For the petitioner    : M\/s Basant Chaudhary and Rabindra Kumar,\n                                            Advocates.\n                    For the State         : Mr. Manoj Kumar Jha, AC to GA-I\n                    For respondent no.8 : M\/s Vidya Sagar and Samir Kumar Ranjan,\n                                            Advocates.\n                                       -----------\n\n                                        ORDER\n<\/pre>\n<p>08\/   20.12.2010                 This writ petition has been filed challenging order<\/p>\n<p>                   dated 09.08.2010 (Annexure-1) passed by the Principal<\/p>\n<p>                   Secretary, Panchayati Raj Department, Government of Bihar,<\/p>\n<p>                   Patna (respondent no.2) by which the petitioner was removed<\/p>\n<p>                   from the post of Mukhiya of Raj Dumrawan Gram Panchayat<\/p>\n<p>                   (hereinafter referred to as &#8216;the Gram Panchayat&#8217; for the sake of<\/p>\n<p>                   brevity) in the district of Nalanda under the provision of<\/p>\n<p>                   section 18(5) of the Bihar Panchayat Raj Act, 2006 (hereinafter<\/p>\n<p>                   referred to as &#8216;the Act&#8217; for the sake of brevity) and for other<\/p>\n<p>                   ancillary reliefs.\n<\/p>\n<p><span class=\"hidden_text\">                      -2-<\/span><\/p>\n<p>             2. I.A. No.7600 of 2010 was filed on 19.08.2010<\/p>\n<p>on behalf of the petitioner for stay of the operation of the<\/p>\n<p>impugned order but the said interlocutory application was<\/p>\n<p>directed vide order dated 07.09.2010 to be considered along<\/p>\n<p>with the admission matter. However, by the said order<\/p>\n<p>respondent no.8 was added to the writ petition as he was not<\/p>\n<p>considered for appointment to the post of Panchayat Shikshak<\/p>\n<p>and on his representation the enquiry was conducted and the<\/p>\n<p>impugned order was passed against the petitioner.<\/p>\n<p>             3. Learned counsel for the petitioner has<\/p>\n<p>submitted that he was duly elected as Mukhiya of the Gram<\/p>\n<p>Panchayat in the election of 2006 and since then he has been<\/p>\n<p>functioning as such. He further stated that in the year 2007<\/p>\n<p>Panchayat Shikshak was to be appointed in the Gram<\/p>\n<p>Panchayat and for that purpose a Selection Committee of five<\/p>\n<p>members, including the petitioner as ex-officio Mukhiya was<\/p>\n<p>appointed by the government and after interview and<\/p>\n<p>verification of certificates and materials one Sudhir Kumar was<\/p>\n<p>selected for the post of Panchayat Shikshak.<\/p>\n<p>             4. Learned counsel for the petitioner averred that<\/p>\n<p>the said Sudhir Kumar did not suppress any fact and had<\/p>\n<p>mentioned that he passed his Intermediate Examination<\/p>\n<p>obtaining 63.35 per cent marks, whereafter for increasing his<\/p>\n<p>marks he also appeared in Madhyama Examination conducted<\/p>\n<p>by Hindi Sahitya Sammelan and obtained 75 per cent marks. In<\/p>\n<p>the said circumstances, a tentative merit list was prepared and<br \/>\n<span class=\"hidden_text\">                       -3-<\/span><\/p>\n<p>published for inviting objections and accordingly the said<\/p>\n<p>Sudhir Kumar submitted his objection relying upon a decision<\/p>\n<p>of this High Court passed in C.W.J.C. No.1074 of 2008 and<\/p>\n<p>C.W.J.C. No.6353 of 2009 in which it was held that certificate<\/p>\n<p>of Hindi Sahitya Sammelan has to be considered for the<\/p>\n<p>purpose of selecting a person on the post of Panchayat<\/p>\n<p>Shikshak. Thereafter, a final gradation list was prepared and<\/p>\n<p>roster clearance was also done. Learned counsel for the<\/p>\n<p>petitioner also averred that there is no illegality in preparation<\/p>\n<p>of the said list.\n<\/p>\n<p>               5. Learned counsel for the petitioner further<\/p>\n<p>claimed that the impugned order of the Principal Secretary<\/p>\n<p>(respondent no.2) is mechanical in nature without considering<\/p>\n<p>the explanation of the petitioner (Annexure-8) and the evidence<\/p>\n<p>produced by the petitioner which were only enumerated<\/p>\n<p>without valid consideration. He also stated that there was no<\/p>\n<p>material before the Principal Secretary (respondent no.2)<\/p>\n<p>except the report of the District Magistrate which was also<\/p>\n<p>dependent upon the report of Superintendent of Police. The<\/p>\n<p>aforesaid two reports and the impugned order were all based on<\/p>\n<p>the only ground that two merit lists were prepared, but in none<\/p>\n<p>of those reports and order the authorities could find that any of<\/p>\n<p>those lists was illegal or any irregularity was committed in<\/p>\n<p>them.\n<\/p>\n<p>               6. It was also claimed by learned counsel for the<\/p>\n<p>petitioner that the Principal Secretary (respondent no.2) in his<br \/>\n<span class=\"hidden_text\">                      -4-<\/span><\/p>\n<p>impugned order dated 09.08.2010 (Annexure-1) observed that<\/p>\n<p>Selection Committee should not have accepted the second<\/p>\n<p>mark sheet of Sudhir Kumar failing to appreciate that the<\/p>\n<p>second mark sheet being legal and valid, there was no occasion<\/p>\n<p>for discarding the same, specially when he had every right to<\/p>\n<p>improve his qualification in 1993 from the qualification he had<\/p>\n<p>in 1992 and he has been working since 2007.\n<\/p>\n<p>             7. Learned counsel for the petitioner further<\/p>\n<p>argued that misconduct means continuance of conscious<\/p>\n<p>illegalities but in the instant case there is only a singular act<\/p>\n<p>and that too by a Selection Committee of five persons,<\/p>\n<p>including the Mukhiya (petitioner), Panchayat Secretary<\/p>\n<p>(Government        Officer),      Member        selected      by<\/p>\n<p>D.S.E.(Government Officer), Teachers Representative and<\/p>\n<p>Ward Member, but in the instant case only the petitioner and<\/p>\n<p>the Panchayat Secretary have been chosen to be punished<\/p>\n<p>which shows the arbitrariness and malafide of the persons<\/p>\n<p>concerned. Thus, learned counsel for the petitioner claimed<\/p>\n<p>that the petitioner being a democratically elected officer, his<\/p>\n<p>removal from the office, which is an extreme step, could have<\/p>\n<p>been resorted to only in grave and exceptional circumstances<\/p>\n<p>and not for any such minor irregularity.\n<\/p>\n<p>             8. On the other hand, learned counsel for<\/p>\n<p>respondent no.8 vehemently contested the claim of the<\/p>\n<p>petitioner and stated that he was also a candidate for Panchayat<\/p>\n<p>Shikshak as extremely backward class having 55 per cent<br \/>\n<span class=\"hidden_text\">                      -5-<\/span><\/p>\n<p>marks, but was not considered in either of two lists by the<\/p>\n<p>Selection Committee, although he had appeared for counseling<\/p>\n<p>on 28.11.2006 and two other extremely backward class<\/p>\n<p>candidates, namely, Manoj Kumar Sharma and Vinay Kumar<\/p>\n<p>having lesser marks were included in the list. He also states<\/p>\n<p>that in the said circumstances, both the lists (Annexure-5 and 6<\/p>\n<p>to the interlocutory application dated 06.08.2010 filed by<\/p>\n<p>respondent no.8) were illegal and hence direction was given for<\/p>\n<p>lodging an F.I.R. (Annexure-9), whereafter steps were taken by<\/p>\n<p>the authorities concerned which are clear from Annexures-10,<\/p>\n<p>11, 12, 13, 14, 15 and 16 of the said interlocutory application.<\/p>\n<p>             9. Learned counsel for respondent no.8 also<\/p>\n<p>averred that the impugned order was passed by the Principal<\/p>\n<p>Secretary (respondent no.2) after giving notice to the<\/p>\n<p>petitioner, whereafter the petitioner filed show-cause, which<\/p>\n<p>was considered. He further stated that the impugned order is<\/p>\n<p>quite justified as Sudhir Kumar, who was of a different<\/p>\n<p>Panchayat, was appointed and his appointment was annulled<\/p>\n<p>by the Member, Zila Shiksha Niyojan Pradhikar, Nalanda in<\/p>\n<p>Case No.23 of 2008-09 on 10.01.2009 which was sent to<\/p>\n<p>respondent no.8 vide letter dated 22.07.2009 (Annexure-15).<\/p>\n<p>He relied upon a decision of this court in the case of<\/p>\n<p>Bindeshwar Prasad vs. The State of Bihar &amp; Ors., reported<\/p>\n<p>in 2010 (4) P.L.J.R. 314.\n<\/p>\n<p>             10. Learned counsel for the State of Bihar and its<\/p>\n<p>authorities (respondent nos.1 to 7) supported the arguments<br \/>\n<span class=\"hidden_text\">                       -6-<\/span><\/p>\n<p>made by learned counsel for respondent no.8 and raised same<\/p>\n<p>points against the claim of the writ petitioner.<\/p>\n<p>             11. Considering the arguments of learned counsel<\/p>\n<p>for the parties as well as the materials on record, it is quite<\/p>\n<p>apparent that the impugned order was passed under section 18<\/p>\n<p>(5) of the Act and the authorities concerned, namely, the<\/p>\n<p>Principal Secretary (respondent no.2) and the District<\/p>\n<p>Magistrate (respondent no.4) were the authorities to take<\/p>\n<p>necessary steps under the Act, but the question involved in this<\/p>\n<p>case is whether they have exercised their jurisdiction in<\/p>\n<p>accordance with law not violating any settled principles of law<\/p>\n<p>and whether there existed any grave and exceptional<\/p>\n<p>circumstances for which such an extreme step was necessary to<\/p>\n<p>be resorted to.\n<\/p>\n<p>             12. It is quite apparent from the impugned order<\/p>\n<p>of the Principal Secretary (respondent no.2) as well as from<\/p>\n<p>other orders of the authorities concerned that the only<\/p>\n<p>allegation against the Selection Committee, including the<\/p>\n<p>petitioner was that two merit lists were prepared; one in the<\/p>\n<p>year 1992 in which Sudhir Kumar was shown to have obtained<\/p>\n<p>63.35 per cent marks, whereas in the second list he had been<\/p>\n<p>shown to have secured 75 per cent marks and on the basis of<\/p>\n<p>the second list he was appointed on the post of Panchayat<\/p>\n<p>Shikshak, which, according to the respondents, was against the<\/p>\n<p>legal procedure and was a gross irregularity.<\/p>\n<p>             13. So far genuineness of the said two lists are<br \/>\n<span class=\"hidden_text\">                       -7-<\/span><\/p>\n<p>concerned, the first list was on the basis of 63.35 per cent<\/p>\n<p>marks obtained by Sudhir Kumar in his Intermediate<\/p>\n<p>Examination in the year 1992, but since subsequently he had<\/p>\n<p>improved his marks in the year 1993 by getting 75 per cent<\/p>\n<p>marks in the Madhyama Examination conducted by Hindi<\/p>\n<p>Sahitya Sammelan which was a recognized institution, the<\/p>\n<p>second merit list showed the said Sudhir Kumar having<\/p>\n<p>obtained 75 per cent marks. Neither respondents authorities nor<\/p>\n<p>the private respondent had ever raised any objection that the<\/p>\n<p>certificates of the said Sudhir Kumar were illegal or forged or<\/p>\n<p>it had no value in the eye of law. Hence, there is no falsehood<\/p>\n<p>in the facts given in the two merit lists.\n<\/p>\n<p>              14. So far the validity of the two merit lists are<\/p>\n<p>concerned, it has been specifically stated by the petitioner that<\/p>\n<p>the said Sudhir Kumar did not suppress any fact and had<\/p>\n<p>mentioned that he passed his Intermediate Examination in the<\/p>\n<p>year 1992 having obtained 63.35 per cent marks, but<\/p>\n<p>subsequently for enhancing his qualification he appeared in<\/p>\n<p>Madhyama Examination of 1993 conducted by the Hindi<\/p>\n<p>Sahitya Sammelan obtaining 75 per cent marks. In the said<\/p>\n<p>circumstances a tentative list was prepared and published for<\/p>\n<p>inviting objections showing the said Sudhir Kumar to have<\/p>\n<p>obtained 63.35 per cent marks, whereafter the said Sudhir<\/p>\n<p>Kumar raised objections that the result in the Madhyama<\/p>\n<p>Examination was legal and valid and had to be considered and<\/p>\n<p>only thereafter the final gradation list was prepared showing<br \/>\n<span class=\"hidden_text\">                      -8-<\/span><\/p>\n<p>the petitioner to have obtained 75 per cent marks and<\/p>\n<p>accordingly, the roster clearance was done. This fact is fully<\/p>\n<p>proved by the petitioner but the respondents have failed to<\/p>\n<p>disprove the said fact by any material whatsoever, nor they<\/p>\n<p>could even show that the appearance of the petitioner in the<\/p>\n<p>Madhyama Examination of Hindi Sahitya Sammelan after<\/p>\n<p>passing the Intermediate Examination in 1992 was illegal or it<\/p>\n<p>was not to be considered for appointment of a Panchayat<\/p>\n<p>Shikshak. Accordingly, the second list prepared by the<\/p>\n<p>Selection Committee was legal and valid and the ground on the<\/p>\n<p>basis of which the petitioner was removed, is absolutely<\/p>\n<p>frivolous and misconceived.\n<\/p>\n<p>             15. So far the claim of respondent no.8 that he<\/p>\n<p>had appeared for counselling before the Selection Committee<\/p>\n<p>on 28.11.2006 is concerned, it is completely falsified by the<\/p>\n<p>materials produced by the petitioner, which clearly showed that<\/p>\n<p>he had never appeared in the counselling held by the Selection<\/p>\n<p>Committee in which other candidates had appeared. In the said<\/p>\n<p>circumstances, only those candidates were included in the two<\/p>\n<p>lists who had appeared in the counselling held by the Selection<\/p>\n<p>Committee. In any view of the matter, admittedly respondent<\/p>\n<p>no.8 had obtained only 55 per cent marks in his Intermediate<\/p>\n<p>Examination, whereas there were at least three candidates who<\/p>\n<p>had obtained more marks than him, namely the petitioner, Rubi<\/p>\n<p>Kumari (69.55 per cent marks) and Sushma Kumari (56.44 per<\/p>\n<p>cent marks), but the said two other candidates did not object to<br \/>\n<span class=\"hidden_text\">                      -9-<\/span><\/p>\n<p>the petitioner&#8217;s appointment on the basis of his obtaining 75<\/p>\n<p>per cent marks. If the candidature of the petitioner was rejected<\/p>\n<p>it was only one of the aforesaid two other candidates, namely<\/p>\n<p>Rubi Kumari or Sushma Kumari, who could have got the<\/p>\n<p>benefit, whereas respondent no.8 was nowhere in picture.<\/p>\n<p>Accordingly, respondent no.8 was not entitled at all to raise<\/p>\n<p>any objection against the appointment of petitioner and the<\/p>\n<p>authorities concerned were not justified in entertaining<\/p>\n<p>objections\/applications filed by him against the petitioner.<\/p>\n<p>             16. Furthermore, respondent no.8 has also failed<\/p>\n<p>to prove by any valid material that the petitioner was not<\/p>\n<p>entitled to be appointed as he belonged to a different<\/p>\n<p>Panchayat, whereas the petitioner has been able to show that he<\/p>\n<p>also belonged to the same area within Ashthawan police station<\/p>\n<p>of the district of Nalanda. Respondent no.8 has also relied<\/p>\n<p>upon a decision of this court in the case of Bindeshwar<\/p>\n<p>Prasad vs. The State of Bihar &amp; Ors., reported in 2010 (4)<\/p>\n<p>P.L.J.R. 314, but in the said case very serious allegations were<\/p>\n<p>proved which was detrimental to the interest of the people of<\/p>\n<p>the Panchayat which he represented due to which it was found<\/p>\n<p>that the petitioner of that case not only committed grave<\/p>\n<p>illegality but also eroded the confidence of people who had<\/p>\n<p>elected him as Mukhiya. Thus, the said case law is not<\/p>\n<p>applicable to the facts and circumstances of this case.<\/p>\n<p>             17. It is also an admitted fact that the appointment<\/p>\n<p>of Sudhir Kumar was made by Selection Committee which\n<\/p>\n<p>                      &#8211; 10 &#8211;\n<\/p>\n<p>apart from the Mukhiya (petitioner) included Panchayat<\/p>\n<p>Secretary (Government Officer), Member selected by D.S.E.<\/p>\n<p>(Government Officer), Teachers Representatives and Ward<\/p>\n<p>Member and hence there is nothing to show that the said<\/p>\n<p>appointment was made solely at the instance of the petitioner.<\/p>\n<p>Hence, it cannot be legally said that the petitioner has<\/p>\n<p>committed any grave illegality at his own instance favouring<\/p>\n<p>the said candidate Sudhir Kumar for which no reason could<\/p>\n<p>also be shown.\n<\/p>\n<p>             18. Apart from the aforesaid facts, the provisions<\/p>\n<p>of section 18(5) of the Act confer power upon the State<\/p>\n<p>Government for removal of Mukhiya with no provision of<\/p>\n<p>appeal and in furtherance thereof such removal as per the Act<\/p>\n<p>casts a serious stigma on the personal and public life of the<\/p>\n<p>concerned person resulting in his permanent disqualification to<\/p>\n<p>hold such office in future. Hence, the power which is exercised<\/p>\n<p>by the authorities concerned under the aforesaid provision of<\/p>\n<p>law has serious civil consequences on the status of Mukhiya<\/p>\n<p>and his entire career.\n<\/p>\n<p>             19. Furthermore in the said provision of law,<\/p>\n<p>namely section 18 (5) of the Act, no sufficient guidelines have<\/p>\n<p>been given as to the manner in which such power has to be<\/p>\n<p>exercised and hence the authorities of the State Government<\/p>\n<p>should invoke such power only in a very extreme case with<\/p>\n<p>strong reason and should not exercise it in case of minor<\/p>\n<p>irregularities in discharge of duties by the holder of the elected\n<\/p>\n<p>                                 &#8211; 11 &#8211;\n<\/p>\n<p>         post, namely Mukhiya specially because he occupies the said<\/p>\n<p>         post by election and he is deprived of the office by an<\/p>\n<p>         executive order in a proceeding in which the electorate has no<\/p>\n<p>         chance of participation. This view has been very clearly and<\/p>\n<p>         specifically held by the Apex Court in the case of <a href=\"\/doc\/1466975\/\">Sharda<\/p>\n<p>         Kailash Mittal vs. State of Madhya Pradesh &amp; Ors.,<\/a><\/p>\n<p>         reported in (2010) 2 Supreme Court Cases 319 as well as in<\/p>\n<p>         the case of <a href=\"\/doc\/1389589\/\">Tarlochan Dev Sharma vs. State of Punjab and<\/p>\n<p>         others<\/a>, reported in (2001) 6 Supreme Court Cases 260.<\/p>\n<p>                      20.   In     view   of   the   aforesaid   facts   and<\/p>\n<p>         circumstances as well as the law laid down by the Hon&#8217;ble<\/p>\n<p>         Supreme Court, this court is constrained to quash the impugned<\/p>\n<p>         order of removal of petitioner passed by the Principal<\/p>\n<p>         Secretary, Panchayat Raj Department, Government of Bihar<\/p>\n<p>         (respondent no.2) as contained in Memo No.148 dated<\/p>\n<p>         09.08.2010 (Annexure-1) and also the consequential steps<\/p>\n<p>         taken by the respondents authorities. Accordingly, this writ<\/p>\n<p>         petition is allowed.\n<\/p>\n<\/p>\n<pre>Harish                                         (S.N.
