No. 1177 of 2009\n                    ------------------------------------------\n                  Dated, this the 9th day of June, 2009\n\n                               JUDGMENT\n<\/pre>\n<p>Kurian Joseph, J.\n<\/p>\n<p>            The appellant is the writ petitioner. The writ petition was<\/p>\n<p>filed with the following prayers:\n<\/p>\n<blockquote><p>                   &#8220;a) call for the records of the case leading upto<\/p>\n<p>            Exhibit P10 and also the necessary permission<\/p>\n<p>            granted by the respondents 2 and 3 to the respondents<\/p>\n<p>            4 and 5 for change of activity and for the induction of<\/p>\n<p>            two new partners and to quash the same by the<\/p>\n<p>            issuance of a writ of certiorari or any other<\/p>\n<p>            appropriate writ, order or direction.<\/p>\n<\/blockquote>\n<blockquote><p>                   b) issue a writ of mandamus or any other<\/p>\n<p>            appropriate writ order or direction directing the<\/p>\n<p>            respondents 1 to 3 to forthwith resume the land<\/p>\n<p>            allotted to the respondents 4 and 5 in the development<\/p>\n<p>            plot, Kalamassery since they have not complied with<\/p>\n<p>            the terms and conditions stipulated in the allotment<\/p>\n<p>            and also in the Rules for allotment.<\/p><\/blockquote>\n<p>                   c) issue a writ of mandamus or any other<\/p>\n<p>            appropriate writ order or direction directing the<\/p>\n<p>W.A.No.1177 of 2009\n<\/p>\n<p>                                   &#8211; 2 &#8211;\n<\/p>\n<p>            respondents 1 to 3 to consider the petitioner&#8217;s request<\/p>\n<p>            for allotment of additional land and to pass<\/p>\n<p>            appropriate orders thereon as expeditiously as<\/p>\n<p>            possible, within a time limit to be fixed by this<\/p>\n<p>            Hon&#8217;ble Court.&#8221;\n<\/p>\n<p>            2. The learned Single Judge after elaborately considering<\/p>\n<p>the matter and after hearing the learned counsel appearing for both<\/p>\n<p>sides and also the learned Government Pleader, disposed of the writ<\/p>\n<p>petition with the following directions:<\/p>\n<blockquote><p>                  &#8220;(a) The 2nd respondent Director of Industries<\/p>\n<p>            and Commerce shall consider the objections raised by<\/p>\n<p>            the petitioner as regards the change of user sanctioned<\/p>\n<p>            in favour of respondents 4 and 5 as per Ext.P10<\/p>\n<p>            [Ext.R4(c)].\n<\/p><\/blockquote>\n<blockquote><p>                  (b) In doing so, the 2nd respondent shall<\/p>\n<p>            consider whether such change of user as such might<\/p>\n<p>            result in any prejudice or detriment being caused to<\/p>\n<p>            the garment manufacturing unit run by the petitioner.<\/p><\/blockquote>\n<p>                  (c) If the Director comes to the conclusion that<\/p>\n<p>            such prejudice or detriment would be caused by the<\/p>\n<p>            change of user permitted in favour of respondents 4<\/p>\n<p>            and 5 then there would be no restraint on the Director<\/p>\n<p>W.A.No.1177 of 2009\n<\/p>\n<p>                                   &#8211; 3 &#8211;\n<\/p>\n<p>            revoking the permission already granted.<\/p>\n<p>                  (d) Further, it shall also be open to the Director<\/p>\n<p>            to consider any other steps that may have to be taken<\/p>\n<p>            by respondents 4 and 5 to see that no hardship is<\/p>\n<p>            caused to the petitioners.      In the alternative, the<\/p>\n<p>            Director shall consider whether any other suitable<\/p>\n<p>            extent of land situated in the vicinity could be allotted<\/p>\n<p>            in favour of the petitioner, satisfying its claim for<\/p>\n<p>            expansion of the unit as made in Exts.P3 and P5.<\/p>\n<p>                  (e) Orders in this regard shall be passed by the<\/p>\n<p>            Director within two months from the date of receipt<\/p>\n<p>            of a copy of this judgment. Respondents 4 and 5 may<\/p>\n<p>            be permitted to continue with the civil construction<\/p>\n<p>            which they have already undertaken. But, they shall<\/p>\n<p>            not start any activity except on permission being<\/p>\n<p>            granted by the Director.&#8221;\n<\/p>\n<p>            3. The learned senior counsel appearing for the appellant<\/p>\n<p>submits that since the second respondent is again relegated to consider<\/p>\n<p>the matter afresh, no meaningful purpose will be served since the order<\/p>\n<p>of the second respondent was under challenge. On a suggestion that if<\/p>\n<p>the first respondent can consider the matter afresh, learned counsel<\/p>\n<p>appearing for both sides and the learned senior Government Pleader<\/p>\n<p>W.A.No.1177 of 2009\n<\/p>\n<p>                                   &#8211; 4 &#8211;\n<\/p>\n<p>agree that the directions given by the learned Single Judge can be<\/p>\n<p>considered by the first respondent instead of the second respondent.<\/p>\n<p>            4. Yet another apprehension of the learned senior counsel<\/p>\n<p>for the appellant is that some of the findings in the judgment would<\/p>\n<p>stand in the way of the first respondent in considering the matter in an<\/p>\n<p>open mind. We do not find any basis on that apprehension also. When<\/p>\n<p>the first respondent considers the matter, the same will be done<\/p>\n<p>untrammelled by the findings, if any, in the judgment, but taking note<\/p>\n<p>of the directions of the learned Single Judge.<\/p>\n<p>            5.
