No. 1323 OF 2006\n                             * * * * * * * * * * * * * * * *\n                             Dated: 30-07-2008\n\n\n                                       ORDER\n<\/pre>\n<p>       The accused in C.C. 256 OF 2001 on the file of the Chief Judicial<br \/>\nMagistrate, Kasaragod for an offence punishable under Section 138 of the<br \/>\nNegotiable Instruments Act, 1881, challenges the conviction entered and<br \/>\nthe sentence passed against him concurrently by the courts below.\n<\/p>\n<p>       2.     Pending this revision, the parties have settled the matter.<br \/>\nCrl.M.A.No.    7595 of 2007         has been filed under Section 147 of the<br \/>\nNegotiable Instruments        Act, 1881 seeking permission to record the<br \/>\ncomposition entered into           between the revision petitioner and the<br \/>\ncomplainant.     The said petition has been signed by both the revision<br \/>\npetitioner as well as the complainant and their respective counsels. In the<br \/>\nlight of this development, the aforementioned composition is recorded and<br \/>\nit will have the effect of an acquittal of the revision petitioner within the<br \/>\nmeaning of Sec. 320 (8) Cr.P.C. Money, if any, deposited by the revision<br \/>\npetitioner pursuant to the orders, if any, passed by the lower appellate<br \/>\ncourt shall be refunded to the revision petitioner\/accused.\n<\/p>\n<p>       This Crl.
