SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 31\/01\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tPresent<br \/>\nFirst Appeal arise out of the impugned judgment and order dated<br \/>\n30.10.2010 passed by the learned Motor Accidents Claims Tribunal<br \/>\n(Auxi), Fast Track Court, No.1., Bhavnagar passed below Exh. 5 in<br \/>\nMACP No.520 of 2009 awarding Rs.25,000\/- to the original claimant by<br \/>\nway of interim compensation under Section 140 of the Motor Vehicles<br \/>\nAct.\n<\/p>\n<p>2.\tHaving<br \/>\nheard learned advocate Shri Nanavati, learned advocate for the<br \/>\nappellant-original opponent no.3, as the impugned order is passed<br \/>\nunder Section 140 of the Motor Vehicles Act, the same is not<br \/>\nentertained. However, it is observed that the same shall be without<br \/>\nprejudice to<br \/>\nthe rights and contentions of the respective parties in the main<br \/>\nclaim petition and all the<br \/>\ndefences and contentions, which are available to the respective<br \/>\nparties are kept open and the same shall be considered by the<br \/>\nTribunal while deciding the main claim petition.<br \/>\nSo far as the amount to be deposited by the appellant under the<br \/>\nimpugned order passed by the Tribunal is concerned, it is ordered<br \/>\nthat the Tribunal shall invest the entire amount of interim<br \/>\ncompensation in a fixed deposit in any Nationalized Bank initially<br \/>\nfor a period five years in the name of original applicant, however<br \/>\noriginal applicant shall be entitled to withdraw the periodical<br \/>\ninterest on the same. It is further ordered that if the claimant is<br \/>\ninterested in getting the interest on the aforesaid fixed deposit,<br \/>\nthe applicant shall not withdraw the main claim petition.\n<\/p>\n<p>3.\tWith<br \/>\nthis, present appeal is disposed of.
