Mahajan, J. <\/p>\n<p> 1. This is a suit filed by the plaintiff for<br \/>\nrecovery of US $ 42,371.15.\n<\/p>\n<p> 2. Briefly the facts are that on 18.1.1996, an<br \/>\norder was placed on the plaintiff by one M\/s. Inaa<br \/>\nTrading &amp; Company, Dhaka, Bangladesh in the name of<br \/>\ndefendant No. 2 for exporting to Bangladesh the goods<br \/>\ndescribed as &#8220;Cotton combed Yarn on Autocone&#8221;.A<br \/>\nletter of credit for Us $ 40,680\/- was advised on<br \/>\n24.1.1996  through State Bank of India, Overseas<br \/>\nBranch, New Delhi. As per the terms of the Letter of<br \/>\nCredit, the goods were shipped to defendant No. 2. An<br \/>\nauthorised representative of defendant No. 2, M\/s.<br \/>\nSincere Export conducted pre-shipment inspection of<br \/>\nthe consignments and confirmed that the merchandise<br \/>\nhad been shipped strictly as per<br \/>\nspecifications\/quality\/quantity and others terms as per<br \/>\nthe terms of Letter of Credit dated 18.1.1996. Vide<br \/>\nletters dated 12.2.1996 and 13.2.1996, plaintiff<br \/>\nadvised the defendant No. 3 that the consignments had<br \/>\nbeen properly shipped to defendant No. 2 and the same<br \/>\nwere delivered to the authorities at Land Customs<br \/>\nStation, Benapole, Bangladesh as per the terms of the<br \/>\nLetter of Credit. Thereafter, the export documents<br \/>\nunder the terms of Letter of Credit were sent to<br \/>\ndefendant No. 1 for reimbursement on 3.4.1996 by the<br \/>\nbank of plaintiff. Vide letter dated 6.4.1996, the<br \/>\nplaintiff requested defendant No. 2 to accept the<br \/>\ndocuments and to sent the payment by due date. But<br \/>\nthe defendants No. 1 and 2 have failed to make the<br \/>\npayment in spite of repeated requests and reminders.<br \/>\nEven the defendants No. 1 returned the documents without<br \/>\nassigning any reason and declined to make the payment<br \/>\nof the goods exported by the plaintiff. Vide another<br \/>\nletter dated 3.3.1997, the bank of the plaintiff again<br \/>\nrequested the defendant No. 1 to remit the payment<br \/>\ntogether with interest. Vide letter dated 17.3.1997,<br \/>\ndefendant No. 1 informed the plaintiff and the bank of<br \/>\nthe plaintiff that defendant No. 2 had not accepted the<br \/>\ndocuments as they were discrepant and had not cleared<br \/>\nthe goods from the customs. Vide letter dated<br \/>\n3.6.1997, the forwarding agents M\/s. Abdul Haque &amp;<br \/>\nSons informed the plaintiff that goods worth US $<br \/>\n27,000\/- had been burnt into ashes while lying at the<br \/>\nplace of stores at Mongal Port Authority at the time<br \/>\nof accidental fire at godown which occurred on<br \/>\n18.3.1996 and the goods worth US $ 13,680\/- had been<br \/>\ndelivered by them to defendant No. 2 on 9.4.1996.<br \/>\nThereafter, the defendant No. 1 on 12.9.1997  made the<br \/>\npayment of US $ 13,595\/- against the export documents<br \/>\nfor the value of US $ 13,680\/- thereby making a short<br \/>\npayment of US $ 85\/-. Hence the present suit.\n<\/p>\n<p> 3. Summons of the suit were issued to the<br \/>\ndefendant and they were served. Since the defendant<br \/>\nNo. 1 having been served did not file the written<br \/>\nstatement within the stipulated time, the written<br \/>\nstatement was ordered to be taken on record subject to<br \/>\npayment of Rs. 500\/- as costs. However, later on none<br \/>\nappeared on behalf of the defendants. The defendants<br \/>\nwere proceeded ex parte and the plaintiff was allowed<br \/>\nto lead ex parte evidence by way of affidavits.\n<\/p>\n<p> 4. The plaintiff has filed affidavits of Mr.<br \/>\nRikhab Chand Jain, Chairman and Managing Director of<br \/>\nthe plaintiff and of Mr. V.N. Suryanarayanan, Asstt.<br \/>\nGeneral Manager of the Oriental Bank of Commerce to<br \/>\nprove its case.\n<\/p>\n<p> 5. Mr. Rikhab Chand Jain has proved that the<br \/>\ngoods were shipped to defendant No. 2 under Invoice<br \/>\nNo. GEX\/165 dated 6.2.1996 for US $ 27,000\/- and goods<br \/>\nworth US $ 13,680\/- under Invoice No. GEX\/169 dated<br \/>\n12.2.1996. He has proved packing lists and invoices<br \/>\nin respect thereof as Exh. PW-1\/2 PW-1\/3, PW-1\/5 and<br \/>\nPW-1\/6 respectively. He has also proved the<br \/>\ncertificate Exh. PW-1\/8 issued by the authorised<br \/>\nrepresentative of defendant No. 2 on 8.2.1996 to the<br \/>\neffect that the merchandise had been shipped strictly<br \/>\nas per the specifications\/quality\/quantity and other<br \/>\nterms as stipulated in the Letter of Credit. He has<br \/>\nalso proved that vide letter dated 7.3.1996 (Exh.<br \/>\nPW-1\/9), the plaintiff requested its bank to negotiable<br \/>\nthe documents in respect of shipment made to defendant<br \/>\nNo. 2. It has also been proved that vide letter dated<br \/>\n6.4.1996 (Exh. Pw-1\/10), the plaintiff informed<br \/>\ndefendant No. 2 that the documents pertaining to the<br \/>\nconsignment shipped to it against the Letter of Credit<br \/>\nhad been forwarded by the bank of the plaintiff t o<br \/>\ndefendant No. 1. Vide letter dated 12.12.1996<br \/>\n(Exh. PW-1\/11), plaintiff informed the defendant that<br \/>\ntill date the bank of the plaintiff had not received<br \/>\npayment of the goods. He has also proved that vide<br \/>\nletter dated 3.3.1997 (Exh. PW-1\/12) addressed to<br \/>\ndefendant No. 1, the bank of the plaintiff reiterated<br \/>\nits request to remit the payment of the shipments<br \/>\ntogether with interest. It has also been proved that<br \/>\ndefendant No. 1 vide letter dated 17.3.1997 (Exh.PW-1\/3)<br \/>\ninformed the plaintiff and its bank that<br \/>\ndefendant No. 2 had not accepted the documents as they<br \/>\nwere discrepant and the shipping documents were thus<br \/>\nreturned unpaid. He has also proved that vide letter<br \/>\ndated 24.5.1997 (Exh. PW-1\/14), the bank of the<br \/>\nplaintiff asked the Joint Commissioner, Land Customs<br \/>\nStation Benapole, Bangladesh to give information about<br \/>\ndelivery of the goods to defendant No. 2. The deponent<br \/>\nhas also proved the certificate (Exh. PW-1\/15) issued<br \/>\nby Mongal Port Authority to the effect that goods had<br \/>\nbeen lost. He has also proved two letter dated<br \/>\n18.6.1997 (Exh. PW-1\/16 &amp; Exh. PW-1\/17). The statement<br \/>\nof account showing the amount due to the plaintiff has<br \/>\nalso been proved by the deponent as Exh. PW-1\/18. The<br \/>\ndeponent has also proved the export overdue statement<br \/>\nmaintained by the bank of the plaintiff duly certified<br \/>\nby the Bankers&#8217; Books Evidence Act as Exh. PW-1\/19.\n<\/p>\n<p> 6. Mr. V.N. Suryanarayanan, Asstt. General<br \/>\nManager of the plaintiff&#8217;s bank in his affidavit has<br \/>\nproved letter of credit dated 18.1.1996 for US $<br \/>\n46,080\/- and the credit advice as Exh. PW\/2\/1 and<br \/>\nPW-2\/2 respectively. He has also proved that<br \/>\ndefendant No. 1 made the payment of US $ 13,595\/-<br \/>\nagainst invoice No. GEX\/169 12.2.1996 of the plaintiff.\n<\/p>\n<p> 7. From the averments made in the plaint as<br \/>\nwell as the affidavit filed by way of ex parte<br \/>\nevidence and in the absence of any evidence in<br \/>\nrebuttal, I have no reason to disbelieve the<br \/>\ncontentions of the plaintiff. It is clear that the<br \/>\ngoods were shipped by the plaintiff to defendant No. 2.<br \/>\nIt is also proved that defendant No. 2 took delivery of<br \/>\nsome of the goods while part of the goods were<br \/>\ndestroyed in fire. It has also been proved that the<br \/>\nplaintiff received payment of US $ 13,595\/- against<br \/>\ninvoice No. GEX\/169 for Rs. 13,680\/- and the remaining<br \/>\nbalance of US $ 85\/- remained to be paid and the<br \/>\nplaintiff has not received payment of US $ 27,000\/-<br \/>\nagainst Invoice No. GEX\/165 dated 6.2.1996. Thus, it<br \/>\nis proved that the plaintiff is entitled to recover US<br \/>\n$ 27,085\/-.\n<\/p>\n<p> 8. In the circumstances, a decree for US $<br \/>\n27,085\/- is passed in favor of the plaintiff and<br \/>\nagainst the defendants jointly as well as severally.<br \/>\nThe plaintiff shall also be entitled to interest @ 12%<br \/>\nper annum from the date of filing of the suit till the<br \/>\ndate of decree. In case the decretal amount is not<br \/>\npaid within three months from today, the plaintiff<br \/>\nshall also be entitled to interest on the decretal<br \/>\namount @ 12% per annum from the date of decree till<br \/>\nrealisation.\n<\/p>\n<p> 9.
