DAVE\n\t\t\n\t\n\n \n\nDate\n: 09\/11\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\npetition under Article 226 of the Constitution of India is filed by<br \/>\nthe petitioner, who was initially appointed as Kendra Sanchalak with<br \/>\nrespondent no.2 &#8211; Rural Labour Welfare Board, Manchod, Taluka<br \/>\nSantrampur, District Panchmahal,  whose service came to be terminated<br \/>\nby order dated 09.03.2009 and 26.08.2010 by respondent authority<br \/>\nafter issuing a show cause notice and seeking an explanation for<br \/>\ncertain alleged irregularities in the matter of granting of financial<br \/>\nassistance to beneficiaries under Labour Security Scheme. By order<br \/>\ndated 01.03.2001, the petitioner was appointed as Kendra Sanchalak to<br \/>\nrender honorary service on terms and conditions of the appointment<br \/>\norder which revealed that the said honorary service  was not of<br \/>\npermanent nature and being voluntary could be terminated by either of<br \/>\nthe parties.\n<\/p>\n<p>2.\tIt<br \/>\nis the case of the respondent-Board that the petitioner, who was duty<br \/>\nbound to disburse the amount of compensation to the claimant under<br \/>\nLabour Welfare Scheme, had, in fact, misappropriated an amount of<br \/>\nRs.1 lakh by taking active participation by disbursing the said<br \/>\namount to the claimant, who was not entitled to receive such amount.<br \/>\nNot only that, the petitioner participated in getting the bank<br \/>\naccount opened and depositing the cheque and therefore, after issuing<br \/>\nshow cause notice and seeking reply from the petitioner, the service<br \/>\ncame to be terminated and no provision of any rule and regulation<br \/>\nframed by the Board mandate the authority for initiating any<br \/>\ndepartmental inquiry for the alleged charge of misappropriation in a<br \/>\ncase of a person who is appointed to render honorary service.\n<\/p>\n<p>3.\tHowever,<br \/>\nthe learned advocate for the petitioner would contend that the<br \/>\npetitioner was not responsible for the alleged handing over the<br \/>\namount of compensation to the claimant other than, who was  entitled<br \/>\nand in fact after a lapse of about two years of the alleged incident,<br \/>\nthe service of the petitioner is terminated without holding<br \/>\ndepartmental inquiry.\n<\/p>\n<p>4.\tIt<br \/>\nis further submitted that in absence of any material on record<br \/>\nproduced by the respondents revealing his specific role in commission<br \/>\nof alleged mistake,  the petitioner was not duty bound to verify the<br \/>\ndetails about person receiving the amount of compensation and at no<br \/>\npoint of time, the petitioner participated in getting the bank<br \/>\naccount opened and depositing the cheque as alleged, the action taken<br \/>\nby the respondents without establishing the charge against the<br \/>\npetitioner is nothing but an arbitrary and unreasonable exercise of<br \/>\npowers in violation of Article 14 of the Constitution of India and<br \/>\nsuch action deserves to be quashed and set aside.\n<\/p>\n<p>5.\tIt<br \/>\nis therefore submitted that issuance of show cause notice to the<br \/>\npetitioner which was duly replied and an explanation was rendered to<br \/>\nthe authority about dispelling the allegation and therefore, the<br \/>\norder impugned deserves to be quashed and set aside.\n<\/p>\n<p>6.\tMr.\n<\/p>\n<p>Thaker, learned advocate for respondent nos.2 and 3, relied on the<br \/>\ndecision of the Apex Court and submitted that in a case of fraud and<br \/>\nmisappropriation by an employee who is not appointed on regular or<br \/>\npermanent basis and in absence of specific role mandating the<br \/>\nrespondent-Board to hold full-fledged departmental inquiry in such<br \/>\nkind of cases beyond the issuance of show cause notice, no other duty<br \/>\nis cast upon the board, and therefore, in a case like this when the<br \/>\nbenefit accruing out of Labour Welfare Scheme is given to a person<br \/>\nother than the lawful claimant and further service of the petitioner<br \/>\nwas purely honorary and liable to be terminated without any further<br \/>\nnotice, the action taken by the respondent authority cannot be said<br \/>\nto be unreasonable and arbitrary exercise<br \/>\nof powers in violation of<br \/>\nArticle 14 of the Constitution of India, and therefore, the petition<br \/>\ndeserves to be rejected.\n<\/p>\n<p>7.\tHaving<br \/>\nheard the learned counsel for the parties and on perusal of the<br \/>\nrecord and rule governing the service condition of the employee<br \/>\nrespondent-Board approved by the department of Labour and Welfare,<br \/>\nState of Gujarat on 05.03.1984, I find no merit in substance of<br \/>\nsubmission of the learned advocate for the petitioner inasmuch as the<br \/>\nterms and conditions of the appointment letter dated 01.03.2001 by<br \/>\nwhich the petitioner was appointed to render honorary service as<br \/>\nKendra Sanchalak and such service was liable to be terminated without<br \/>\nany notice, no duty is cast upon the respondent-Board to follow any<br \/>\nprocedure of holding full-fledged departmental inquiry as contended<br \/>\nby the learned advocate for the petitioner in absence of specific<br \/>\nrules in this regards. The board has given a notice and on receipt of<br \/>\nreply, satisfaction was reached to the extent that the explanation<br \/>\nrendered by the petitioner was not satisfactory and service was<br \/>\nrequired to be put to an end.\n<\/p>\n<p>8.\tIn<br \/>\nthe above circumstances, the petition being devoid of any merit<br \/>\ndeserves to be rejected and accordingly it is hereby rejected.
