The petitioner in the said appeal has challenged  the<br \/>\nvalidity of the order  of the Joint Charity Commissioner, Surat,<br \/>\nconfirming the  sale in favour of respondent No.4 herein of property<br \/>\nof a public trust for an amount of Rs.65 lacs.\n<\/p>\n<p>\tThe<br \/>\npetitioner though had also applied for bid in the public action, he<br \/>\ndid not participate in the auction on the ground that the documents<br \/>\nregarding the property in question were not made available to him.<br \/>\nBe that as it may.  The petitioner challenged  the order passed by<br \/>\nthe Joint Charity Commissioner confirming the sale  in favour of the<br \/>\nhighest bidder.  In the appeal, he also prayed for  an interim stay.<br \/>\nThe Tribunal, however,  in the impugned order  found that the sale<br \/>\nconsideration has already been paid over and the sale is also<br \/>\nexecuted.  These, besides others, were the reasons for refusing<br \/>\ninterim relief.\n<\/p>\n<p>\tWhen<br \/>\nthe order of the Joint Charity Commissioner was already executed  by<br \/>\nthe time the Tribunal took up the prayer for stay  by biparte<br \/>\nhearing, I do not find that the Tribunal committed any error in<br \/>\nrefusing such prayer.  I have perused the  interim prayers made which<br \/>\npertained to staying of the order of the Joint Charity Commissioner<br \/>\nand directing not to execute the sale pursuant to  such an order.<br \/>\nUnder the circumstances, no relief can be granted in this petition.<br \/>\nIt would be open for the petitioner, however,  to make further<br \/>\nsuitable  interim prayer or seek early hearing of the appeal.
