RAMKUMAR, J.\n\n                      = = = = = = = = = = = = =\n\n                          Crl.M.C.No.47 of 2008\n\n                     = = = = = = = = = = = = = =\n\n              Dated this the 4th day of January, 2008\n\n\n                                     ORDER\n<\/pre>\n<p>      Petitioner who was the 2nd accused in CrimeNo.758 of 2000 of<\/p>\n<p>Kannur Town Police Station for offences punishable under Sections<\/p>\n<p>143,147,341,323 read with 34 IPC and whose case was split up and<\/p>\n<p>transferred   to   the   list   of   Long   Pending   Register   as   L.P.No.165   of<\/p>\n<p>2003   before   the   J.F.C.M-I,   Kannur,   seeks   a   direction   to   the<\/p>\n<p>Magistrate  to consider his application for regular  bail on the date<\/p>\n<p>of  his surrender  itself  after  recalling the  non bailable warrants of<\/p>\n<p>arrest against him.   According to the petitioner,   he was employed<\/p>\n<p>abroad   and   that   was   the   reason   why   non   bailable   warrants   of<\/p>\n<p>arrest happened to be issued  against him.\n<\/p>\n<\/p>\n<p>       2.  Accordingly this Criminal Miscellaneous Case is disposed<\/p>\n<p>of   permitting   the   petitioner   to   surrender   before   the   learned<\/p>\n<p>Magistrate and file an application for regular bail within a period of<\/p>\n<p>two weeks from today.  In case he does so, his bail application shall<\/p>\n<p>be   considered   and   disposed   of   by   the   learned   Magistrate,   on<\/p>\n<p>merits,  preferably   on  the  same  date   on  which  the   petition  is  filed<\/p>\n<p>after  considering   the   explanation   offered   by   the  petitioner  for  his<\/p>\n<p>previous non-appearance.\n<\/p>\n<\/p>\n<p>                                                V.
