JUSTICE MOHIT S. SHAH)<\/p>\n<p>\tThis<br \/>\nLetters Patent Appeal is directed against interlocutory order dated<br \/>\n12.3.1998 of the learned Single Judge directing the appellant herein<br \/>\nto accept forms of the petitioner   students  of Hardik Vidyalaya<br \/>\n(who are respondent Nos.1 to 40 herein) through any other recognized<br \/>\nschool.\n<\/p>\n<p>2.\tThe<br \/>\nabove order was passed by the learned Single Judge in Special Civil<br \/>\nApplication No.1894 of 1998 filed by the 40 students in view of the<br \/>\nfact that Hardik Vidyalaya where they were studying in the Standard X<br \/>\n was not recognized by the appellant   Board and, therefore, the<br \/>\nstudents were not permitted to appear at the Std. X examination which<br \/>\nwas to be conducted by the appellant   Board in March 1998.<br \/>\nAggrieved by the above interim order dated 12.3.1998, the appellant<br \/>\nmoved this Letters Patent Appeal, which was admitted, and on<br \/>\n31.3.1998, this Court granted interim stay against declaration of the<br \/>\nresult.\n<\/p>\n<p>3.\tWhen<br \/>\nthe appeal reached hearing on 18.9.2008, the learned counsel for<br \/>\nrespondent Nos.1 to 40 sought time to seek instructions whether the<br \/>\nstudents were still interested in the appeal being heard on merits.\n<\/p>\n<p>4.\tMr<br \/>\nSunil K. Shah, learned counsel for the respondent   students states<br \/>\nthat though he had written to one of the guardians at the residential<br \/>\naddress indicated in the appeal memo, he has not received any<br \/>\ninstructions in the matter.\n<\/p>\n<p>5.\tMr<br \/>\nAD Oza, learned counsel for the appellant   Board states that the<br \/>\nBoard had by letter dated 18.9.2008 requested the Principal of Smt.<br \/>\nLH Gandhi High School, C\/o. Bright Star School through which the<br \/>\nstudents were permitted to appear at the examination in compliance<br \/>\nwith the interim order of the learned Single Judge to inform the<br \/>\nappellant   Board about further developments in the matter. In<br \/>\nresponse thereto, by letter dated 27.9.2008, the Principal of Smt. LH<br \/>\nGandhi High School has informed the appellant   Board that though<br \/>\nthe students were permitted to appear at the Std. X examination in<br \/>\nMarch 1998, the results were not declared in view of the interim stay<br \/>\ngranted in this appeal. The Principal further stated that he had no<br \/>\ndetails about the students who were originally admitted to Hardik<br \/>\nVidyalaya.\n<\/p>\n<p>6.\tIn<br \/>\n CBSE vs. P Sunil Kumar, (1998) 5 SCC 377, the Apex Court held as<br \/>\nunder :-\n<\/p>\n<p> ..\n<\/p>\n<p>&#8230; We are conscious of the fact that our order setting aside the<br \/>\nimpugned directions of the High Court would cause injustice to these<br \/>\nstudents. But to permit students of an unaffiliated institution to<br \/>\nappear at the examination conducted by the Board under orders of the<br \/>\nCourt and then to compel the Board to issue certificates in favour of<br \/>\nthose who have undertaken examination would tantamount to subversion<br \/>\nof law and this Court will not be justified to sustain the orders<br \/>\nissued by the High Court on misplaced sympathy in favour of the<br \/>\nstudents.\n<\/p>\n<p>7.\tConsidering<br \/>\nthe undisputed fact that Hardik Vidyalaya was not recognized by the<br \/>\nappellant   Board to establish and run a High school and having<br \/>\nregard to the decision of the Apex Court in CBSE vs. P Sunil Kumar,<br \/>\n(1998) 5 SCC 377, we allow the appeal and set aside the order dated<br \/>\n12.3.1998 of the learned Single Judge.\n<\/p>\n<p>\t\t\t\t\t\t(M.S.\n<\/p>\n<p>SHAH, J.)\t\t<\/p>\n<p>\t\t\t\t\t\t(HARSHA<br \/>\nDEVANI, J.)<\/p>\n<p>zgs\/-\n<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<blockquote><p>\t\t   Top<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Gujaat vs Minor on 13 October, 2008 Author: Mohit S.
