03   13.10.2011                    Heard learned counsel for the petitioners as well as<\/p>\n
                    learned Additional Public Prosecutor for the State.<\/p>\n
                                   None appears on behalf of the opposite party no. 2<\/p>\n
                    in spite of service of notice on her personally as reported by the<\/p>\n
                    process server.\n<\/p>\n
                                   Learned counsel for the petitioners submits that the<\/p>\n
                    impugned order dated 13.07.2007 passed by Sri Rakesh Chandra<\/p>\n
                    Shrivastava,      learned   Sub   Divisional   Judicial   Magistrate,<\/p>\n
                    Lakhisarai in Complaint Case No. 24 C of 2007 is an illegal order<\/p>\n
                    because the aforesaid Magistrate had got no jurisdiction to pass<\/p>\n
                    order in respect of an offence which had taken place outside his<\/p>\n
                    jurisdiction. Learned counsel for the petitioners drew my attention<\/p>\n
                    towards contents of complaint petition and submitted that as per<\/p>\n
                    complaint petition itself, the entire occurrence took place under<\/p>\n
                    the jurisdiction of Barh, District-Patna whereas the complaint case<\/p>\n
                    has been filed in the court of Additional Chief Judicial Magistrate,
\n                       2<\/span><\/p>\n
Lakhisarai who had got no jurisdiction to take cognizance of the<\/p>\n
aforesaid complaint case. To fortify his above stated contention,<\/p>\n
he referred a decision reported in 2008 (3) PLJR SC 367 in which<\/p>\n
it has been held by the Apex Court of this country that offences<\/p>\n
under Sections 498 (A) 406 and 147 of the Indian Penal Code<\/p>\n
cannot be tried by the court where cause of action has not accrued<\/p>\n
at all. On the strength of above stated decision, he prays for<\/p>\n
quashing the impugned order dated 13.07.2007 passed in<\/p>\n
Complaint Case No. 24 C of 2007.\n<\/p>\n
              On the other hand, learned Additional Public<\/p>\n
Prosecutor appearing for the State submitted that offence under<\/p>\n
Section 498 (A) is a continuing offence and according to<\/p>\n
complaint case, after ouster from matrimonial home, the<\/p>\n
complainant is residing at Lakhisarai. So, she rightly chose to file<\/p>\n
complaint case in the court of Additional Chief Judicial<\/p>\n
Magistrate, Lakhisarai. It is also contended by him that even if, it<\/p>\n
assumed that learned Additional Chief Judicial Magistrate,<\/p>\n
Lakhisarai\/Judicial Magistrate, Lakhisarai had got no jurisdiction<\/p>\n
to try the above stated complaint case, then also, cognizance taken<\/p>\n
by the court of Lakhisarai is not bad in the eye of law and, at best,<\/p>\n
this court may transfer the aforesaid complaint petition to the<\/p>\n
concerned court which has got jurisdiction to try the offence of<\/p>\n
complaint case no. 24 C of 2007.\n<\/p>\n
              As I have already stated that on behalf of the<\/p>\n
Opposite Party No. 2 none has appeared before this Court in spite
\n                       3<\/span><\/p>\n
of service of notice. So, in my view, this petition can be disposed<\/p>\n
of on admission stage itself on the basis of materials available on<\/p>\n
the record as well as submissions of the parties.<\/p>\n
              It is manifest from perusal of contents of complaint<\/p>\n
petition that the entire occurrence took place under the<\/p>\n
jurisdiction of Barh, District-Patna whereas complaint case has<\/p>\n
been filed in the court of District-Lakhisarai. It is apparent from<\/p>\n
the above stated decision reported in 2008(3) PLJR SC 367 that<\/p>\n
the court in whose jurisdiction the cause of action has not<\/p>\n
accrued, has got no jurisdiction to proceed with the case. In the<\/p>\n
present case, admittedly, the court of Lakhisarai had got no<\/p>\n
jurisdiction to proceed with the complaint case no. 24 C of 2007<\/p>\n
as much as the entire occurrence had taken place under the<\/p>\n
jurisdiction of Barh, District-Patna and, therefore, I am of the<\/p>\n
considered opinion that learned counsel for the petitioners has<\/p>\n
rightly submitted that the impugned order passed by learned Sub<\/p>\n
Divisional Judicial Magistrate, Lakhisarai is bad in law and<\/p>\n
cannot sustain in the eye of law.\n<\/p>\n
              So far as the submission of learned Additional<\/p>\n
Public Prosecutor is concerned, in my view, the same are not<\/p>\n
tenable because as per complaint case itself, the alleged<\/p>\n
occurrence had taken place under the jurisdiction of Barh,<\/p>\n
District-Patna and, therefore, it cannot be said that the Lakhisaria<\/p>\n
Court has also got jurisdiction to proceed with the case as an<\/p>\n
offence under Section 498 (A) of the Indian Penal Code is a
\n                                 4<\/span><\/p>\n
          continuing offence.\n<\/p>\n
                        On the basis of aforesaid discussions, in my view, it<\/p>\n
          is a fit case in which this Court must exercise its power vested<\/p>\n
          under Section 482 of the Cr.P.C. and, accordingly, this petition is<\/p>\n
          allowed and the impugned order dated 13.07.2007 passed by Sri<\/p>\n
          Rakesh Chandra Shrivastava, learned Sub Divisional Judicial<\/p>\n
          Magistrate, Lakhisarai in Complaint Case No. 24 C of 2007 is<\/p>\n
          quashed.\n<\/p>\n
                        However, the Complaint Case No. 24 C of 2007 be<\/p>\n
          returned to the complainant, if she is available. Furthermore, she<\/p>\n
          may file fresh complaint case before the court of Barh, District-<\/p>\n
          Patna, if she is so advised.\n<\/p>\n<\/p>\n
