PUJ\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 19\/05\/2010  \n \nORAL ORDER<\/pre>\n<p>\tThe petitioner has<br \/>\n\tinitially filed Special Civil Application No.5202 of 2010 wherein<br \/>\n\tnotice was issued by this Court on 5.5.2010 making it returnable on<br \/>\n\t6.7.2010. Thereafter, the petitioner has filed Civil Application<br \/>\n\tNo.5126 of 2010 on 7.5.2010 making prayer against the respondents<br \/>\n\tfrom taking over the management or appointing any Administrator of<br \/>\n\tthe school and interfering in the educational activities of the<br \/>\n\tapplicant trust.  In the said application, the Court has asked the<br \/>\n\tlearned Assistant Government Pleader to take instructions regarding<br \/>\n\tapprehension of the petitioner that an Administrator is being<br \/>\n\tappointed for the petitioner institution. The said application was<br \/>\n\tadjourned to 14.5.2010 and, thereafter, to 15.6.2010.  Thereafter,<br \/>\n\tthe applicant has filed present Civil Application i.e. Civil<br \/>\n\tApplication No.5573 of 2010 making more or less similar prayer and<br \/>\n\trequesting the Court to hear Civil Application No.5126 of 2010 and<br \/>\n\tissue necessary direction to the opponents during pendency and\/or<br \/>\n\tfinal disposal of the main petition.\n<\/p>\n<p>\tHeard Mr.G.M.Amin,<br \/>\n\tlearned advocate appearing for the applicant trust and Ms.Jirga<br \/>\n\tJhaveri, learned Assistant Government Pleader for the State.\n<\/p>\n<p>\tThe applicant&#8217;s<br \/>\n\tapprehension with regard to appointment of Administrator or taking<br \/>\n\tsome action by the opponents for taking over the management of the<br \/>\n\tapplicant trust is premature at this stage in view of the statement<br \/>\n\tmade by the learned Assistant Government Pleader under instructions<br \/>\n\tof Mr.R.G.Aghera   Principal, Kamribai High School, Jetpur for<br \/>\n\tDistrict Education Officer, Rajkot, respondent No.2, that before<br \/>\n\ttaking any action in this regard, the authority will issue notice<br \/>\n\tunder Section-33 of the Gujarat Secondary Education Act, 1972<br \/>\n\tcalling for explanation of the applicant trust.  As and when such<br \/>\n\tnotice is issued the applicant trust will give its explanation and<br \/>\n\tafter considering the said explanation and\/or hearing the applicant,<br \/>\n\tan appropriate order will be passed in the matter. It is always open<br \/>\n\tto challenge the said order, if it is adverse to the applicant.\n<\/p>\n<p>\tIn the above view of the<br \/>\n\tmatter, no order is required to be passed in these two Civil<br \/>\n\tApplications at this stage.\n<\/p>\n<p>\tIn the above view of the<br \/>\n\tmatter and in view of the statement  made by the learned Assistant<br \/>\n\tGovernment Pleader under instructions of Mr.R.G.Aghera<br \/>\n\tPrincipal, Kamribai High School, Jetpur for District Education<br \/>\n\tOfficer, Rajkot, respondent No.2, both these applications are<br \/>\n\taccordingly disposed of without any order as to costs.
