PATTANAIK (J)\n\nCITATION:\n 1996 SCALE  (5)804\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t    AND<br \/>\n      SPECIAL LEAVE PETITION (CIVIL) NO. 14275 OF 1996<br \/>\n\t\t\t O R D E R<br \/>\n     The petitioner,  Pirthi @\tSansi admittedly had entered<br \/>\ninto an\t agreement or May 6, 1988 to sell 16 kanal 16 marlas<br \/>\nof agricultural\t land for a consideration of Rs.50,000\/- per<br \/>\nkilla and  received a  sum of  Rs.24,000\/- as earnest money.<br \/>\nThe respondent\tfiled a\t suit for  specific  performance  in<br \/>\nApril 1993  against the\t petitioner. It\t was  his  plea\t and<br \/>\naccepted by  all courts that he was always ready and willing<br \/>\nto perform  his part  of the  contract and  was willing\t and<br \/>\nready to  pay the  balance consideration  or  Rs.  81,000\/-.<br \/>\nAccepting the  case  of\t the  respondent,  the\ttrial  Court<br \/>\ndecreed the  suit. On  appeal, the Additional District Judge<br \/>\nby his\tjudgment dated November 15, 1994 reversed the decree<br \/>\nholding that  Ramesh and  others had come into possession of<br \/>\nthe land.  They were  in possession  of\t the  land  and\t the<br \/>\nagreement came to be executed in their favour on December 5,<br \/>\n1994 after  the judgment  of the appellate Court. Therefore,<br \/>\nthe decree  for specific  performance  was  not\t proper\t and<br \/>\ninstead the  alternative relief of recovery and compensation<br \/>\nwas held  appropriate remedy.  In second  appeal,  the\tHigh<br \/>\nCourt reversed the decree by the impugned judgment dated May<br \/>\n15, 1996  in R.S.A.  NO.425\/95 and  restored the judgment of<br \/>\nthe trial Court.\n<\/p>\n<p>     Shri Mahabir Singh, learned counsel for the petitioner,<br \/>\ncontended  that\t  consideration\t of  granting  for  specific<br \/>\nperformance is\ta discretion  of the  court and\t the  courts<br \/>\ngranting the decree for specific performance should exercise<br \/>\nthe discretion\ton sound principles of law. The Court should<br \/>\ngrant alternative  relief instead  of  granting\t decree\t for<br \/>\nspecific  performance.\t In  view  of  the  facts  that\t the<br \/>\npetitioner had\talready inducted  third party  in possession<br \/>\nand they  remained in  possession and also taking possession<br \/>\ninvolves  further  litigation,\tthe  first  appellate  court<br \/>\nrightly refused\t to grant  specific  performance.  The\tHigh<br \/>\nCourt committed\t an error  of law in reversing the decree of<br \/>\nthe  first   appellate\tCourt.\tWe  rind  no  force  in\t the<br \/>\ncontention. It\tis an  admitted fact  that Ramesh and Shashi<br \/>\nKapoor, respondent  Nos.2 and  3 had  come  into  possession<br \/>\nafter the  suit was  instituted and  agreement to  sell\t was<br \/>\nentered into.  Therefore, the High Court rightly allowed the<br \/>\nappeal holding\tthem to\t be not\t a bona\t fide purchasers and<br \/>\ndirected decree\t for specific  performance in  pursuance  of<br \/>\nagreement to  sell dated  6.5.1988. If the contention of the<br \/>\nrespondents is given acceptance, no contract can be enforced<br \/>\nand the party will seek to avoid contract by inducting third<br \/>\nparty into possession. Therefore the view taken by the first<br \/>\nappellate Court\t in that  behalf is  clearly illegal. Having<br \/>\nregard to  the fact that respondent Nos.2 and 3 are not bona<br \/>\nfide purchaser and admittedly came into possession after the<br \/>\nsuit was  instituted and  the agreement was entered into the<br \/>\nHigh  Court  has  rightly  rejected  their  contention.\t The<br \/>\ncontention since  have come  into possession  the  suit\t for<br \/>\nspecific performance  will be  an impediment in that behalf,<br \/>\nbears no force<br \/>\n     The special leave petitions are accordingly dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Pirthi @ Sansi Etc vs Jati Ram &amp; Ors.
